APPROVAL of 401 Water Quality Certification
Dear Mr. Peele:
You have our approval, in accordance with the attached conditions, to shade 0.15 acre of vegetated wetlands and open water in
order to construct a small boat marina on lot 12 at the NC Seafood Industrial Park in Dare County, as described in your application
received by the Division of Water Quality on May 9, 2002. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3371, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetlands .
This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA
Permit expires unless otherwise specified in the'General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation, may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Proiect Settin
The applicant, the North Carolina Seafood Industrial Park Authority, owns and operates
a commercial industrial park located on 54 acres at the end of Harbor Road (SR 1140),
Wanchese, Roanoke Island, Dare County. The park has an extensive shoreline that fronts a
manmade basin off Mill Landing Creek, Roanoke Sound and Broad Creek. The park was
created by filling an existing marsh with spoil material derived from dredging the basin. The
property is divided into lots that vary in size and are leased to tenants. Lot 12 is
approximately .6 acre in size and is located on the northeast side of Harbor Road and adjacent
to Broad Creek. It has an elevation of approximately 6 ft. above normal water level and has
sandy soils. The lot is vegetated mostly with yard grasses.
The shoreline of Lot 12 has a coastal wetland fringe approximately 35 ft. wide that is
vegetated with Spartina alterniflora along the waterline and Juncus roemerianus toward the
upland area. Above the coastal wetland fringe at an elevation of approximately 2 ft. above
normal water level is a possible 404 wetland fringe vegetated with common reed and grasses.
Adjacent property consists of lots of varying sizes and similar physical characteristics.
The lot to the west has a marine repair facility and the lot to the east is vacant.
The waters of Broad Creek are classified as SA by the Division of Environmental
Management and are open to shellfishing. The area of Broad Creek upstream from the
proposed development site is classified as a Primary Nursery Area by the Division of Marine
Fisheries.
Development Proposal
The development proposal is for a 28 boat slip marina for open boats, 24 feet or less in
length, with no heads, and no cabins. Also proposed to protect the moorings is a 190 ft.
stationary breakwater and a travel lift for ingress and egress of boats to and from a proposed
upland dry storage facility.
The upland development of the property consists of a 120' x 110' dry storage building
with capacity for approximately 60 boats with an associated 6,118 sq. ft. of gravel parking and
a septic tank with drainfield wastewater system for patrons and employees. Also proposed is a
1,200 sq. ft. office and bathroom.
The marina development over water includes the construction of an 8' wide 200' long
staging pier and an 8' wide 185' long mooring pier with 28 slips, 14 on each side. The slips
are approximately 28' long and 12' wide and have 14 finger piers 12' long and 3' wide. An 8'
wide 175' long board walk will run generally parallel to the shoreline and connect both piers.

Two 6' wide 30' long trestle piers are proposed to allow a travel lift to operate. The
travel lift trestle will be located between the two main piers. A 60' long 28' wide wooden
platform over the wetlands will provide a connection from the dry storage building to the
travel lift trestles. An 8' wide and approximately 60 ft. long walkway/boardwalk will provide
pedestrian access to the marina dock from the upland area. A 190' long breakwater structure
is proposed to be constructed at the end of the staging pier and to run parallel to the existing
shoreline approximately 250' out into the mouth of Broad Creek.
Anticipated Impacts
The proposed piers will result in the shading of approximately 5180 sq. ft. of Public
Trust Area, Estuarine Waters Areas of Environmental Concern (AECs). The travel lift ramp
and pedestrian boardwalk will cover approximately 900 sq. ft. of Coastal Wetlands AEC and
500 sq. ft. of possible 404 wetlands. The proposed gravel roadway for the travel lift will
result in the covering of approximately 440 sq. ft. of Estuarine Shoreline with semi-impervious
material. The total impervious surface for the lot will be 22,354 sq. ft. and the total water
area captured by the marina and breakwater will be 41,800 sq. ft. Temporary water turbidity
will occur during construction. The project will result in more boating activities and access in
the area.
