Neuse River Buffer Rules [15A NCAC 2B .0233] Compliance Review
Dear Ms. McCullough:
The Division of Water Quality (DWQ) has reviewed your plans to construct the proposed renovations and
improvements at the subject property. It is the determination of the DWQ that the proposed activity as indicated in your
request letter dated May 13, 2002 and associated plans complies the Neuse River Buffer Rules (15A NCAC 2B.0233). In
addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control and Non-Discharge.
This approval is only valid for the purpose and design that you described in your request and additional conditions
listed below. If you change your project, you must notify us and you may be required to send us an application for
authorization. If the property is sold, the new owner must be given a copy of this letter and is thereby responsible for
complying with all conditions. For this confirmation to be valid, you must follow the conditions listed below as well as any
other conditions identified within 15A NCAC 2B .0233.
Conditions:
1. Renovations / maintenance of the existing stormwater discharge pipe has been determined to be in compliance with
the Neuse Buffer Rules (i.e., exempt) as long as no new stormwater from additional impervious surfaces is directed
through the new pipe.
2. Improvements of Thurman Drive and the parking area has been determined to be in compliance with the Neuse Buffer
Rules (i.e., exempt) as long as no new impervious surface is added to the buffer in locations where it did not
previously exist.
Please be aware that any impacts wetlands or surface waters (e.g., streams) will need to comply with the 404 / 401
programs. If you have any questions or would like a copy of the buffer rules, please call Mr. Bob Zarzecki at 919-733-

I am writing in response to your letter dated April 22, 2002 and our meeting (May 9, 2002)
requesting additional information concerning the above-mentioned project.
Enclosed are three maps that illustrate the areas of disturbance, which we discussed during
our meeting. The project proposes to replace the existing 12" RCP pipe with a 30" pipe.
The project does not increase the amount of impervious surface area, nor will the discharge
from the site change. It was simply determined that the 12" pipe was originally undersized
for the site and is now proposed to be upgraded.
As for the roadway/parking area, the removal and replacement of pavement, curb & gutter
and utilities that fall within the buffer, will match the exiting footprint. There will be no
increase to impervious surface area and no loss of vegetation within the buffer. Minimal
grading will be necessary; however, it will be localized within the existing footprint and post-
construction elevations will closely match pre-construction conditions.
I believe the aforementioned construction activities of this project to be exempt from the
Neuse River Buffer Rules. I respectfully request your assessment of the information
regarding this project and provide your conclusions and/or concurrence in writing.

On April 19, 2002, the Division of Water Quality (DWQ) received your letter dated April 19, 2002 requesting that the
proposed activity at the subject property is exempt under the Neuse River Basin: Nutrient Sensitive Waters Management
Strategy: Protection and Maintenance of Existing Riparian Buffers rule (Neuse Buffer Rule; 15A NCAC 2B .0233). The
DWQ has determined that additional information will be required to make a determination that the proposed project is
exempt under the Neuse Buffer Rule. Specifically, please provide additional information including a site plan depicting the
location of the existing Neuse River Buffers (Zone 1 and 2), existing impervious surface within the buffers, the proposed
new. post-construction impervious surface and any removal of vegetation, grading or fill proposed within the buffers. We
will place this project on hold until we receive this additional information. If we do not receive this information within
three (3) weeks of the date of this letter we will assume that you no longer wish to pursue this request.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware any impacts requested within your application are not authorized by the DWQ. Please call Mr.

This letter follows my telephone conversation and e-mail correspondence with
you on April 18, 2002 concerning proposed reconstruction of the
roadway/parking area associated with the Doak Baseball Field/Tennis Court
Renovation Project on North Carolina State University's Main Campus.
The Environmental Assessment/Finding of No Significant Impact for this project has
been reviewed by the State Clearinghouse and concurrence received by our
office on November 7, 2001. However, NC DENR - Division of Land
Resources has placed the review of the Sedimentation & Erosion Control Plan
on hold due to noted encroachments of the Neuse River Buffer. Please refer
to enclosed letter dated April 12, 2002.
The project, in part, proposes to remove and replace all existing pavement,
curb and gutter and associated utilities along Thurman Drive starting from
approximately 40 feet within the buffer and terminating at the northerly
parking lot. The proposed roadway/parking area elevations closely match the
existing elevations and land disturbance within the buffer is limited to the
existing footprint.

Based on our conversation and interpretation of the Neuse River Buffer Rules,
I believe the encroachment noted by the Division of Land Resources to be
exempt from the rules. I would appreciate your confirmation of this in writing.

This office has received an Erosion and Sedimentation Control Plan for the subject project as
required by the Sedimentation Pollution Control Act of 1973.
We have performed a preliminary review of your plan and have noted apparent buffer
encroachments subject to the Neuse River Riparian Area Protection and Maintenance Rule (15A NCAC
26.0233). This rule applies to all perennial and intermittent streams, lakes, ponds, and estuaries In the
River Basin with existing vegetation on the adjacent land or "riparian area." In riparian areas with existing
vegetation In the first 30 feet directly adjacent to the stream, the rule prohibits land disturbance or new
development within the first 30 feet of land next to the water (the remaining 20 feet of the totat buffer must
be revegetated upon completion of any proposed land-disturbing activity). In riparian areas with.existing
vegetation that is less than 30 feet wide, the rule prohibits land disturbance or new development within the
area that contains existing vegetation (but not the entire 50 foot riparian area). Encroachments on the
protected buffers require written approval by the Division of Water Quality (DWQ).
In light of the apparent buffer encroachments shown in your plan, we cannot consider your
application complete until we receive a copy of your DWQ approval or statement of exemption from the
rule. Therefore, we cannot initiate'our 30-day statutory review time period until your application is .
complete. For more information about this riparian area rule, please contact the DWQ's Wetland/401 Unit
at 9191733-1786 or DWQ in our regional office at 919/571-4700. By copy of this letter we are notifying
them that your project will need their attention.
Upon receipt of your DWQ paperwork and any necessary plan revisions related to DWQ review or
our enclosed checklist, we will process your application for plan approval as soon as possible. If you have
any questions or need additional information, please do not hesitate to contact us. Your cooperation in
this matter is appreciated. .
