By memo dated June 1, 2009 (attached), Cyndi Karoly - NCDENR-DWQ - 401
Oversight and Express Permitting Unit, requested that the Ecosystem Enhancement Program
(EEP) verify the amount(s) of Riparian Buffer Mitigation and/or Nutrient Offset Credit the
subject site would be able to provide. The memo identified one primary area of concern:
1. It appeared portions of the buffers were less than 50 feet wide.
Response: Areas of riparian buffer determined to be less than 50 feet wide along the Smith and
Austin Creeks project were assessed using GIS and are depicted as orange polygons on the
attached figure. In addition, there were two buffer areas that extended beyond 200 ft wide
(depicted as yellow polygons on the figure) and are thus similarly not eligible for buffer credit.
The remaining area that exists outside of the project stream channels and within the project
conservation easement is eligible for riparian buffer restoration credit.
Based on this information, the Debit Ledger will list this site with 27.7 Riparian
Buffer Mitigation Units.

The Smith and Austin Creeks site consists of approximately 11,000 linear feet of stream restoration in an urban setting. The
Year 6 monitoring report for the project does not indicate the amount of riparian buffer credit proposed for this site.
The Year 6 Monitoring Report states that the overall vegetation density is 835 stems per acre, and all vegetation plots
exceeded the target density of 320 stems per acre. Planted trees appeared healthy, and diversity was acceptable.
The easement did not appear to be 50 feet wide throughout the site. Encroachment in the easement has occurred along the
golf course and the soccer fields.
The easement was marked with signs at the site of the site visit.
ITEMS TO ADDRESS: Please provide a total amount of buffer credit to be generated on this site. This will require
verification of the easement widths and planted area widths. It appeared that portions of the buffers were less than 50
feet wide.
