RE: Riparian Buffer and Nutrient Offset Mitigation Verification for
McCotter Raines Farm Buffer Restoration Project - Jones County (Meuse 04)

By memo dated June 8, 2009 (attached), Cyndi Karoly - NCDENR-DWQ - 401
Oversight and Express Permitting Unit, requested that the Ecosystem Enhancement Program
(EEP) determine the amount(s) of Riparian Buffer Mitigation and/or Nutrient Offset Credit that
would be available from the subject site. As noted in the memo, the principal concerns were:
1. Confirmation that all credits associated with this project are nutrient offset credits and
that all area generating credit is 0 to 200 feet from a surface water conveyance as measured
perpendicularly from top of bank.
Response: On October 27, 2009, Lia Myott Gilleski of DWQ conducted a stream determination
on this site (copy attached). Based on this determination, the attached Figure 1 depicts the areas
that will generate Riparian Buffer Mitigation and the areas that will generate Nutrient Offset
Credit. Areas greater than 200' from a surface water conveyance have been excluded.
2. DWQ requests that EEP clarify the discrepancy between the credits described in the
restoration plan and monitoring report and those in the June 3, 2009 ledger.
Response: The ledger erroneously listed the site with 26.3 Nutrient Offset Credits. Based on the
DWQ stream determination and GIS analysis, there are 12.65 acres that will generate Riparian
Buffer Mitigation and 10.86 acres that will generate Nutrient Offset Credit.
Based on the above information, the Debit Ledger will list this site with 12.65
Riparian Buffer Mitigation Units and 10.86 Nutrient Offset Credits.

The McCotter/Raines Farm Buffer Restoration is an EEP full-delivery project consisting of forested buffer
restoration on land previously used for agriculture along Beaver Creek and connecting ditches. This is a
grandfathered project with 200 foot wide buffers. The site was visited on February 27, 2008 by Tammy Hill of
DWQ, Guy Pearce and Tim Baumgartner of EEP's full-delivery program, and Brent Manning of Land Management
Group.
At the site visit, vegetation was observed to be growing vigorously with adequate diversity of appropriate species.
The conservation easement is held by the NC Cooperative Extension Service Foundation and includes 10.6 acres of
preserved mature forested buffer that was donated to the easement holder.
The restoration plan (January 2003) and fifth annual monitoring report (November 2007) described 24.4 acres of
woody vegetation planting to restore buffers. The June 3, 2009 ledger indicated that the project has generated 26.3
acres of nutrient offset credit.
ITEMS TO ADDRESS: Clarify the discrepancy between the number of credits described in the restoration
plan and monitoring report and those in the June 3, 2009 ledger. Please confirm that all credits associated
with this project are nutrient offset credits. Please verify that all area generating credit is 0 to 200 feet from a
surface water conveyance as measured perpendicularly from top of bank.

On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B
.0233)
Dear Mr. Baumgartner:
On October 27, 2009, at your request, Lia Myott Gilleski conducted an on-site determination to review
two stream features located on the subject property for applicability to the Neuse Buffer Rules (15A
NCAC 2B .0233). The features are labeled as "A" and "B" on the attached maps initialed by Lia M.
Gilleski on October 29, 2009. The Division of Water Quality (DWQ) has determined that the following:
Feature "A" is subject to the Neuse Buffer Rule at the flag labeled "Al - Intermittent Stream
begins". The feature is a modified natural channel.
Feature "B" is subject to the Neuse Buffer Rule since it is a perennial stream (Beaver Creek).
This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWQ that a surface water exists and that it is subject to
the buffer rule may request a determination by the Director. A request for a determination by the Director
shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review
Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date
that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not
start until the affected party (including downstream and adjacent landowners) is notified of this decision.
This determination is final and binding unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
