The memo identified two (2)primary areas of concern. They were: 1. Areas of the site, specifically the upper end of the project, are in mature forest and therefore do not generate Riparian Buffer Mitigation or Nutrient Offset Credit. Response: As shown on attached Figure 1 and Figure 2 the upper end of the project that was included in the original estimate of buffer credit has been excluded. The area in the middle of the project and the lower end of the project with existing vegetation, and the stream crossings have also been excluded. 2. Verification that areas of the site being used for Wetland Mitigation would not be used for Buffer Mitigation. Response: As shown on the attached Figure 2, the "Stream Corridor" (50' on each side) is not being used for wetland mitigation and therefore qualifies as Riparian Buffer Mitigation. There are 11.75 acres within the stream corridor that qualifies as buffer mitigation. Based on the above information, the Debit Ledger will list this site with 11.75 Riparian Buffer Mitigation Units. According to the monitoring report,7,292 linear feet of stream restoration, 350 linear feet of stream enhancement,26.8 acres of riverine wetland restoration and 16.9 acres of non- riverine wetland restoration were done on the site. An unreported amount of buffer mitigation is apparently available on the site as well. Buffer width was greater than 50 feet in the reports except along the unnamed tributary. Guy Pearce from EEP as well as two staff from EBX,LLC and Katie Merritt from DWQ were also present on site. The site is in its third year of monitoring. The monitoring report stated that all monitoring plots met vegetation success criteria and that the stream was stable. The stream appears to be stable and the vegetation in good condition at this site. Buffer widths were measured at several locations and were always equal to or greater than 50 feet. ITEMS TO ADDRESS: The upper end of the site(stream enhancement section)is in mature forest and therefore not eligible for buffer mitigation credit. This area must be determined and removed from the site ledger. DWQ will need to be copied on a letter from EEP to this effect. EEP should also determine the amount of buffer mitigation on this site and inform DWQ of that determination in the same letter.
