PROJECT SUMMARY: The applicant proposes to perform maintenance excavation of an existing boat basin adjacent to the AIWW and Middle Sound. Hughes Page 2 9. PROJECT DESCRIPTION: The project site is located at 1941 Middle Sound Loop Road, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highway17), turn onto Middle Sound Loop Road and turn right at Ogden Elementary School. Travel east approximately 2.5 miles and the property of interest will be located on the right. The lot is approximately 4.0 acres with approximately 430 feet of shoreline frontage. The lot averages 15 feet above mean sea level and the shoreline is stabilized by vegetation. The applicant maintains a single-family residence. The highground vegetation consists primarily of live oak, lawn grass, and ornamental landscaping. The highground along the southeast property boundary transitions to a footpath on an upland berm that is approximately 10 feet in width. The berm is bordered to the north and south by coastal wetland vegetation. This area is both marsh and inter-tidal creeks. The marsh consists of smooth cordgrass (artina alterniflora) which transitions to high coastal marsh adjacent to the highground. This high marsh consists of intermixed Spike Grass (Distichlis seicata), Sea Lavender (Limonium, spp.), Saltwort (Salicornia, spp.), Sea Oxeye (Borrichia frutescens), and Salt Meadow Grass (Spartina patens) that transition to occasional shrubs, marsh elder (Iva frutescens), grounsel-bush (Baccharus halimifolia) and wax myrtle (Myrica cerifera) along the marsh's interface with the mowed lawn grass. On January 8, 1991 CAMA General Permit #7120-D was issued authorizing the construction of an approximately 320 feet long by 6 feet wide pier with a 20 feet square t-head and boatlift on the south. The work plan drawing submitted by Ed Flynn, acting agent for a previous property owner Stephen Robertson, indicates the water depths to have been -1.75 feet at Normal Low Water (NLW). After sustaining damage to the pier during Hurricane Fran, then owner Frank Daniels III contracted Duncan Marine Contractors to rebuild the damaged pier. The work plan drawing submitted by Charles Duncan, on behalf of Frank Daniels, indicate the water depths to be "4 feet Mean Low Water (MLW)". On March 11, 1997 CAMA General Permit #015846D was issued authorizing an approximately 300 feet long by 6 feet wide pier with fixed t-head platform, two boatlifts on the north and south sides of the platform, and a 32 feet long by 6 feet wide floating access dock located to the north of the pier and landward of the fixed platform. The water depths on the contractors' submitted work plan drawings for both General Permits do not appear to have been verified by the Field Representatives. No water depths were transcribed or indicated by the Field Representative on the General Permit Form drawings issued to the acting agents. Therefore, it is unclear as to what the historical water depths are in the area adjacent to the existing pier and boatlifts. Water depths adjacent to the existing pier range from 0.0 feet at NLW on the landward side of the "t-head" platform to 0.0 feet to -1.5 feet at NLW on the waterward side of the boatlifts. No dredging has been previously authorized in association with the existing docking facility. The existing docking facility is located approximately 155 feet from the edge of the federally maintained USACE Navigation Channel. The adjacent riparian properties to the north and south are developed single-family residences without private docking facilities. There are known archaeological resources within the project area, NH3 is located within a half of mile of the project site. The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. The open water of the AIWW and Middle Sound is approximately 660 feet wide at this location. Hughes Page 3 10. PROPOSED PROJECT: The applicant proposes to perform excavation of the area adjacent to the existing docking facility located adjacent to the AIWW and Middle Sound. The dimensions of the proposed boat basin would be 85 feet in length by 45 feet in width, to a final project depth of -3' at normal low water (NLW). Excavation of the basin would be accomplished by barge mounted mechanical excavator. Excavated material would be placed on the barge for dewatering and then shipped to an approved offsite location, to be determined at a later date. The structure would continue to provide docking space for up to (3) vessels. 11. ANTICIPATED IMPACTS: The proposed dredging would result in the excavation of approximately 4,000 square feet of shallow bottom. Short term increases in turbidity can be expected during dredging activity. The excavation of the basin by mechanical means will create steep side slopes and subsequent sloughing, thereby increasing the top width dimensions of the proposed project. Approximately 220 cubic yards of spoils material would be generated from the project and placed at an off-site spoil location, to be approved prior to project commencement. The proposed dredge footprint would encroach slightly into the adjacent riparian corridor 15 foot setback and into the 80-foot setback from the AIWW. Dredging Project Tom Hughes, Applicant New Hanover County, NC Mr. Tom Hughes, Applicant, proposes to excavate approximately 0.09 acres (4,000 sq. ft.) of subtidal sandy bottom at the waterward extent of the existing three slip dock structure comprised of two boat lifts and one floating dock for temporary dockage during mid to high tide situations. As described by the applicant, the area proposed to be dredged once provided sufficient depths for use of his 26' Grady White fishing boat launched from a boat lift at all tidal ranges. The area around the existing boat lifts and floating dock has experience excessive accretion over the recent past and depths now limit the use of the slips to mid/high tide situations. It is believed that dredging to a depth of -3.0' mlw would be considered as a maintenance activity as it will restore the area to its former depth range. The proposed project is located on the AIWW off of Middle Sound Loop Road in New Hanover Count, NC. Area waters are designated as SA, open to shellfishing, and Outstanding Resource Waters (ORW) by the Environmental Management Commission (EMC). The site is not located within Primary Nursery Areas (PNA) nor would the proposed dredging initiate any closures to shellfishing. There was no SAV observed near the site nor were there any shellfish observed near the dredging area. The applicant proposes to use a bucket to barge dredging operation to excavate subtidal sandy bottom from an irregular shaped area encompassing the distal end of the existing floating dock and boat lifts. Area depths range from -0.0' to - 12.0' mlw with an average existing depth of -1.5' mlw. Approximately 4,000 sq.ft. (220 cubic yards) will be dredged to an average depth of -3.0 ft. mlw. All dredge spoil will be placed upon a barge and shipped to an offsite disposal area to be determined at a later date. No upland development is proposed and all current uses will remain the same.
