Enclosed is the Agent Authorization form for the DWQ Project # 09-1060 that Mr.
Edwards requested. It authorizes Darrel Partner to act as our agent for this project. (four
copies )
Division of Land Resources Trout Buffer Compliance: An approval letter from T
Gray Houser, dated November 20, 2009, is attached.
Darrel Partner spoke to Chuck Cranford and he indicated that providing the above
information should meet all remaining requirements. I have mailed him a copy of the
signature authorization, as well.

Subject: Trout Buffer Zone Waiver
Panner Property, 2125 Buffalo Shoals Road, Lake Lure
Rutherford County
Dear Mr. and Mrs. Panner:
This office has received your plan for the Panner Property, 2125 Buffalo Shoals Road, Lake
Lure, in Rutherford County, North Carolina. Your plan was submitted to this office for approval
because of the proposed encroachments into the buffer zone of designated trout waters. In
accordance with NCGS 113A-57(1) and Title 15A NCAC 4B .0125(c) this letter will serve as
written approval to encroach on the buffer zone of Lake Lure Class C, Trout. This authority has
been delegated to me by the Director, Division of Land Resources, James D. Simons, in
accordance with NCGS 143B-10. The following conditions will apply to this approval:
1. This approval is based on the plans by Kim Warner, PE, dated October 23, 2009, and
received via electronic mail November 11, 2009, and the planting plan by Darrel Panner received
by facsimile on November 18, 2009.
2. The planting plan lists plants identified as Redbud, Dogwood, Blueberry, Camellia,
Rhododendron, Mountain Laurel and Azalea. Acceptable native species with these common
names are Eastern Redbud, Cercis canadensis, Flowering Dogwood, Cornus florida, Alternate-
leaf Dogwood, Cornus alternifolia, Silky Dogwood, Cornus amomum, High-bush Blueberry,
Vaccinium corymbosum, Mountain Camellia, Stewartia ovata, Silky Camellia, Stewartia
malacodendron, Catawba Rhododendron, Rhododendron catawbiense, Rosebay Rhododendron,
Rhododendron maximum, Mountian Laurel, Kalmia latifolia, Dwarf Azelea, Rhododendron
atlanticum, Flame Azelea, Rhododendron calendulaceum, Pinxter Flower, Rhododendron
periclymenoides and Swamp Azalea, Rhododendron viscosum.
3. This approval does not absolve the permittee from compliance with the surface water
quality turbidity standard. More protective erosion and sedimentation control measures may be
required in order to comply with this water quality standard.
