Dea Ms. Barclay:
In accordance with your written request of December 12, 1996, the
completion date of your Department of the Army (DA) permit to discharge fill
material within Lot Numbers 7, 8, 9, and 10 located off Canterbury Road, in
New Bern, North Carolina, is hereby extended until January 21, 1998.
Nationwide Permit No. 26 would still apply for less than one acre
of fill within each of your families, property boundaries provided it is
accomplished in strict accordance with the conditions which were enclosed
in our previous correspondence to you dated February 18, 1993 and
January 12, 1995. Be advised that Nationwide Permit 26 has been modified.
Accordingly, activities that have commenced (i.e., are under construction)
or are under contract to commence in reliance upon this nationwide permit
will remain authorized provided that construction activity is completed by
January 21, 1998.
Please be reminded that this extension of time applies only to Federal
authorization. As we discussed in our previous correspondence to you, this
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval. If the permitted work is not completed
on or before the date herein specified, the authorization, if not previously
revoked, will cease and become null and void.
