Dear Mr_Goldman:
The Division has reviewed your request, received October 8, 1996, for the installation of an aeration unit at Hess'
Charlotte Terminal. This letter provides authorization from the Division to install a single aeration unit in the first stage
stormwater retention lagoon. This unit shall be operated such that all current NPDES permit conditions are met. If the
facility experiences episodes-of non-compliance and it is determined that those episodes-are a direct or indirect result of the
installation of the aerator,its use will be discontinued immediately.
