This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following items were incorporated into this Final permit: • Addition of weekly dissolved oxygen monitoring of the effluent. • Addition of monthly effluent monitoring for total nitrogen (TN) and total phosphorus (TP), due to nutrient enrichment problems in downstream High Rock Lake. • Deletion of instream monitoring for conductivity. • Change monitoring frequency for fecal coliform from 2/Month to Monthly at instream stations (U,D). • Change in permit expiration date to April 30, 2004. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition,. conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or pemlits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. Summary: Minor facility (mobile home park- 77 spaces) discharges 100% domestic wastewater to a 0.016 MGD septic tank/sand filter system to Rich Fork Creek in the Yadkin -Pee Dee River Basin. Rich Fork Creek is classified C waters (index 12-119-7), and this segment (from source to Abbotts Creek) is listed in the 1998 303(d) list as a Partially Supporting waterbody due to Fecal coliforms. All major streams in this subbasin (030707- Abbotts Creek Watershed) are either threatened or impaired. Surface waters eventually discharge to High Rock Lake. The 1998 Basinwide Plan identified a large number of dischargers in this small subbasin, which was reflected in only Good -Fair water quality. Fish community structure in Rich Fork was rated Fair; degradation of habitat and discharge from High Point Westside WWTP are having an adverse affect on the Rich Fork fish community. Ambient stations on Rich Fork exhibit frequent high levels of fecal coliform bacteria. Substandard DO concentrations have been reported in Rich Fork since the early 1980's. QUAL2E model predictions and instream data confirm that Rich Fork is over -allocated with the most pronounced DO sag occuring just above the confluence with Hamby Creek. The 1998 Basinwide Plan recommends that no additional loadings of oxygen -consuming wastes to Rich Fork be al I owed. Permit Changes. Changed NH3 limits to reflect current IWC result. Due to unclear DO situation at this facility (see DMR Data below), add DO monitoring of effluent in addition to the current instream data collection. BOD secondary limit (and lack of DO limit) should be reevaluated pending results of future instream DO data (see DMR Data below). Recent NPDES Policy is to require nutrient monitoring (TN,TP) for facilities discharging to High Rock Lake; monthly monitoring required for QD > 10,000 gpd. DMR Data. No permit limit violations reported between 8/97 — 9/98. Recently facility has been at 75% of permitted flow. WSRO- Two comments on the DMR data. • Have you ever conducted split sampling to verify the treatment results reported for BOD5 and NH3? In 8 of 13 months, the facility reported BOD5 near 1 mg/l, and in 10 b of 13 months reported NH3 at <1 mg/l. These are excellent results for a septic tank/sand filter system. Why does this system appear to work so well? • Please discuss DO measurement procedures with the permittee- are they measuring correctly? Over the past 20 months, the facility has reported weekly DO measurements for both upstream/downstream stations ranging between a narrow span of 13-14 mg/l, even during summer months. Given the overallocation of this waterbody and potential for low instream DOs, we should make sure the permittee is collecting accurate instream DO data. The facilitycurrently has secondary BOD limits and no DO limit, therefore we need to make sure that the facility's discharge is not impacting instream DO levels. r sv,sQe,JZ`C Staff Report/CEI. The last staff report on file was conducted 2/93. Facility Class rated as I. Facility was operating properly and well -maintained at the time. WSRO conducted a Compliance Evaluation Inspection in 7/98- review of DMRs for period 9/97-4/98 showed compliance with all permit limits. No concerns or problems with operation of facility were noted. WLA. The last WLA was conducted in 1993 using the current design flow of 0.016 MGD. Secondary limits (30/45 mg/1) were recommended for BOD/TSS. NH3 limits for summer/winter were based on potential for instream toxicity. There is no DO limit. Instream monitoring was recommended for temp, DO, Cond, Fecal. Facility requested deletion of instream monitoring for DO/conductivity during 1993 permit round. However, Technical Support denied due to possibility of instream water quality problems (low DO) caused by large number of dischargers to Rich Fork Creek. An examination of the basin planning schedule has revealed that the timing of permit renewals does not allow an evenly distributed workload as first envisioned. This results in problems with the efficiency and effectiveness of the NPDES program.
