This Office has reviewed your application and has conducted a site visit and is placing your project on hold until
we receive the following additional information:
1) An overall site plan that shows avoidance and minimization for wetland impacts for the
wetlands indicated, on the signed plat by the Corps of Engineers, as Wetlands "B", "D", "F",
"H"and "G". Why must these wetlands be impacted? There looks to be enough width for a
driveway to access these lots and on "G" the placement of the house could be moved to avoid
any wetland impacts.
2) On what is shown as wetland "C" on the drawing labeled as Figure 2 Topsail Cove
Development Plan is actually a contiguous wetland on the signed plat by the Corps. Please
define the minimal impact needed for the development of the lot.
3) These separated wetlands can continue to function if you work with the stormwater section of
water quality and allow water to sheet flow into these areas. Please address how you will
continue to promote the viability of these wetlands as shown on the Plat as wetland "B" and
possibly wetlands "B", "D", "F;',"H" and "G".
4) Restrictive covenants are to be placed on remaining wetlands. A sample deed notification is
located on our website at htip:Hh2o.enr.state.nc.us/ncwetlands/download.htmi.
Please respond within three weeks of the date of this letter by sending a copy of the information to myself and to
Cyndi Karoly, Raleigh Wetlands Unit (919) 733-9721. If we do not hear from you within three weeks, we will assume

9. PROJECT DESCRIPTION:
The project site is an 11.5 acre tract of land located on NC Highway 210, within the Town of Surf City. The
property is located adjacent to Topsail Sound and lies approximately 3/4 of a mile north from the intersection of
NC Highway 50 and 210. The property is located at the intersection of NC Highway 210 and Wilmington Avenue,
directly across NC Highway 210 from the Surf City Baptist Church.
The property has 100' of road frontage along Highway 210, located at the intersection of Wilmington Avenue.
This 100' wide strip extends to the northwest for approximately 200'and widens to a peninsula of land measuring
approximately 1000' long by approximately 350' wide at the widest point. This peninsula is bordered on the north
by a tidal creek off the AIWW and is separated from NC Highway 210 by a shallow tidal embayment measuring
approximately 400' across. The site has an elevation which averages approximately 3' above mean sea level
(MSL). The higher areas of the property are vegetated with typical maritime scrub thicket species, including:
Live Oak (Quercus virginiana), Yaupon Holly (Rex vomitoria), Red Bay (Persea borbonia), and Southern
Waxmyrtle (Myrica cerifera).. A Section 404 Wetland delineation has been conducted for the property and the
boundary survey of 404 jurisdiction was approved by the U.S. Army Corps of Engineers on March 12, 2002.
The entrance to the property from NC Highway 210 consists of a strip of land measuring approximately 80' wide
by approximately 300' long. This area. appears to have been created by past fill activity, as this feature appears
to be present, but well vegetated on the 1978 aerial photography. The first 70' of this entrance area adjacent to
the highway. is high ground. The next 150' of this, moving towards the northwest, is Section 404 wetlands. On
each side of the entrance, the high ground and 404 areas are bordered by coastal wetlands. These coastal wetland
areas consist primarily of Bulrush (Scirpus, spp) along the higher areas of the entrance with Black Needlerush
(Juncus roemerianus) and Cord Grass (Spartina alterni, flora) dominating along the waters edge. Vehicular traffic
has inhibited wetland vegetation growth along most of the higher areas of the entrance.
The entirepeninsula portion of theproperty, which contains the majority of the high ground, is surrounded by both
Section 404, and Coastal Wetlands. In addition to the 404 fringe areas, there are eight (8) Section 404 Wetland
pockets along the interior of the peninsula. The largest of these pockets measures 898 sq. ft. and the smallest
measures 289 sq. ft. The Section 404/Coastal Wetland borders around the peninsula typically consist of Salt
Meadow Grass (Spartinapatens), Sea Oxeye (Borrichia frutescens), Spike Grass (Distichlis spicata) and Giant
Cord Grass (Spartina cynosuroides). Closer to the open water areas, Black Needlerush and Cord Grass dominate.
The waters of Topsail are classified "SA" by the Division of Water Quality. The area is designated as a Primary
Nursery Area by the Division of Marine Fisheries and is open- to the taking of shellfish.
The applicant is proposing the development of a 14 lot, residential subdivision known as Topsail Cove.
Development wound include the initial grading and filling of approximately 2.6 -acres of the tract for road
construction, utility.installation and lot grading. This grading and filling would -include the eight 'interior .404
Wetland pockets, as well as an area of 404 Wetlands for the entrance road measuring: approximately 25' wide by
approximately 145'.in length. Individual lots will have a minimum lot size of S,OOO sq. ft., at a density of 0.823
units/acre for the development area. Access to the lots will be provided by a single private road (Wilmington
Street) entering from NC Highway 210. Wilmington Street would terminate in a cul-de-sac at the northeastern
comer of the property. One side street (Anchor.Drive) would run to the western side of the peninsula and would
also terminate in a cul-de-sac. A portion of the property at the end of this cul-de-sac, adjacent to Lot #1, has been
designated as a Conservation Easement/Public Access Easement.
The subdivision's sanitary sewer system and drinking water supply would be connected to the existing Surf City
Municipal Sewer System and Surf City Water System, respectively. Water and sewer lines would be run within
the 25' road right-of-way on opposite sides of the street.

10. ANTICIPATED BWACTS
The construction of the proposed roadways and utilities would disturb approximately 2.45 acres of high ground
and approximately 0.18 acres of Section 404 Wetlands. The construction of the entrance road would require the
filling of approximately 4,060 sq. ft. of Section 404 Wetlands. The applicant has avoided Coastal Wetland impacts
for this project.' The misalignment of Wilmington Avenue with the proposed subdivision entrance road
(Wilmington Street) is partially the result of the avoidance of Coastal Wetland impacts along this causeway. The
shifting of the roadway to the northeast also eliminated any impacts within the 30' Coastal Shoreline buffer area.
Total impervious surfaces within the 75' Estuarine Shoreline AEC would be 2.5 %. The applicant was issued State
Stormwater Permit No. SW8010637, on March 1, 2002. That Permit limits the maximum built-upon area per lot
to 3,872 sq. ft., with a total built-upon area for the subdivision of 25%.

Dear Tim,
As you brought to my attention via telephone on Thursday April 4, 2002, our plans for the
subject subdivision show an area of wetlands fill adjacent to the intersection of Anchor Drive
and Wilmington St. that includes some CAMA wetlands. It was an oversight on our part and
it was not intended that any fill was shown in CAMA wetlands. This letter serves as
notification to your office and TP Inc. that fill is not to be placed in the CAMA wetlands
portion of the subject location.
