This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) CAMA permits. This approval is only valid for the purpose and design that you described in your variance application form except as modified below. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: No impacts (except for those uses classified as "exempt' within the Table of Uses (15A NCAC 2B .0259(6)) shall occur within Zone 1 of the protected buffers unless otherwise approved by the DWQ. 2. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified within 15A NCAC 2B .0259(5). No new ditching or piping of stormwater through the protected buffers is allowed. The soils on the site are mapped as Duckston and Carteret; both are hydric. The site visit determined the site to be highly disturbed. There were several small depressional pockets within the buffer zone vegetated with Typha sp., Baccharis halimifolia, and Dichromena colorata which are all wetland species. Within the depressional pockets, approximately 30 to 40 sgft. each, the soils exhibited hydric soil characteristics with redoximorphic features. Due to the disturbed nature of the tract and that the adjacent lots had been recently filled within the same approximate area as this lot proposes to fill, Tom and I determined not to hold this project for the "General" Variance as long as wording was put in the conditions concerning fill in 404 wetlands. Tom wasn't available so I spoke to Rolf Blizzard. I told Rolf that there was some miscommunication between Tom Sri, the Wetlands Unit and the WaRO. I explained to him that John told Tom Sri that we will approve the variance today. However, I explained to him that we would have to condition it per the Coastal "General" so that no wetlands would be impacted and that we would rather let you conduct your site visit on Wednesday (5/8) to see if any wetlands would need to be impacted by the proposed project. He said that they are fine waiting until you conduct the site visit. Please take a look at the site Wednesday and let us know your findings as soon as possible. I was not aware of this project until Friday afternoon at 2:30 pm when John instructed me to write the approval. He was very explicit to have it approved ASAP (i.e, by Monday). It looks like Rolf Blizzard and Tom Sri of Sen. Basnight's office are the "left and right" hand. I appreciate your concerns and will put a copy of this email and your comments in the file, but John wanted this out by today so that's what I plan to do unless I hear otherwise from Dennis or Coleen. I didn't get the appl. until 419/02. I requested an overnight via E-mail more than 2 weeks ago and a written overnight (because I never heard from the E-mail) last week. I did not receive any notification from Basnight's office until Friday. Tom did not copy me on the notice he got or was I copied on the fax to Tom. Issuing without a field visit on Ocracoke is not good policy. I planned my visit as soon as I could and that is Wed. and Thurs. of this week. DCM is on our back about consistency and enforcement and issuing out of C.O. with no contact from me or especially a field visit could mean "trouble". There is no 30 day clock on variances per the rules. It is too difficult to get to Ocracoke on a weekly or bi-weekly basis. Soil Survey I gave you recently, the area of the project (Williams) is mapped as Duckston and Carteret (entire area). Both of these are hydric soils. Like I said, I am familiar with the area, and it has many wetland areas in the tract. Jim talked to Dennis at about 1:30 pm and asked that the project be held until after we make a site visit. Tom called on 4/26 requesting status. He apparently faxed the request on Sun 4/28 and John reviewed and passed on to me Friday to approve. I'm in the process of writing the approval. Cyndi will sign in John's absence (vacation). Let me know if you would like to see any conditions placed on it. The lot is 50' wide x 135' deep. The CAMA coastal wetlands begin 15 feet from the rear property line. The buffers extend into the lot 35 feet. We plan to issue approval to impact all of Zone 2 (20x50 = 1000sf). This will leave them a 6004 building area (2040st). Conditions proposed will be (1) diffuse flow and (2) no impacts to Zone 1 (except "exempt" uses) unless approved by DWQ. No mitigation if we approve under the Coastal "General". Please respond by 3pm today otherwise I'll write it as indicated above and pass on to Cyndi to sign and mail/fax. - Bob Deborah Sawyer wrote: Bob, Just a "heads-up" on a variance request. Friday, I received a call from Rolf Blizzard (Sen. Basnight's office) about a variance request on Ocracoke. The project is for Larry P. Williams, POA for estate of Myra Wahab. The contact person is B.J. Oelschlegel, sales agent for Ocracoke Island Reality. It was received at WaRO on 4/9/02. I have scheduled a site inspection trip on Ocracoke on 5/8 and 9. I have about 8 sites to visit, 2 are potential violation sites. I told Rolf that I was going this week and he asked me to call him upon my return and tell him whether the project is acceptable or not. I will be off on Friday (going to visit my mother) and may be back late on Thursday. If I can't get up with Rolf on Thursday, I will relay the info. to you via E-mail so that you can call him Friday for me (if that is OK). Otherwise, it will be Monday before I can call him. VARIANCE Prom the Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Fudsftg Lots on Barrier Islands This major variance from the Tar-Pamlico River Riparian Area. Rules (15A NCAC 2B .0259) is hereby issued by the NC Environmental Management Commission to construct homes and related structures such as garages, decks, porches, attached nor imercial. structures and sheds within Zone 1 or 2 of the riparian buffer on lots existing as of January 1, 2000 on barrier islaads in the Tar Pamlico Basin of North Carolina as long as the conditions prescribed below are met. The applicant must submit three copies of the appropriate application form to DWQ staff that describes how the following conditions of this variance will be met. If these conditions can not be met, an individual major variance from the Tar-Pamlico River Riparian Area Rules (15A NCAC 213 .0259) may be sought from the NC Environmental Management Commission. This "Major Variance" shall expire on April 13, 2005 unless it is renewed before that time by the N.C. Environmental Management Commission. Conditions: 1. Applicants must show that they have met the requirements of 15A NCAC 2B .0259(9xaxi)-(iii). 2. The residential lot must have been platted and recorded on or'before January 1, 2000. 3. Construction is. for residential buildings and related structures such as garages, decks, porches, attached commercial building and sheds. 4. Impact to Zone 1 (30 feet immediately adjacent to surface water as ;defined by 15A NCAC 2B .0259(4)(a)] must be minimized to the maximum extent practical. 5. If the applicant is required to obtain a Sedimentation and Erosion Control Permit or a LAMA Major Permit, then a Stormwater Permit may be required from DWQ. 6.
