ProjectNo. 02-6932 Honeycutt Creek [83-04-02, 27-20-(1), WS-IV (Water Supply) NSW (Nutrient Sensitive)] Request for Guidance on the ApplicabiiVq of the Neuse River Basin: Nutrient Sensitive Waters Management Strategy: Protection and Maintenance o#Existing Riparian Buffers Rule (Neuse Buffer Rule; 15A NCAC 26 .0233) to the Proposed City of Raleigh Greenway Easement. Dear Mr. Martin: On April 8, 2002, at your request DIfQ staff (including Mr. Steve Mitchell and Ms. Deborah Edwards of the Division of Water Quality (DWQ) Raleigh Regional Office and Mr. Bob Zarzecki of the Wetlands / 401 Unit) met with you on the subject property to provide guidanceon the applicability of the Neuse River Buffer Rule on the proposed City of Raleigh greenway easement. DWQ staff determined that the streams indicated as "A' and "B" on the attached map. (stamped and initialed by DWQ staff on Apel 8, 2002) are streams subject to the Neuse River Buffer Rule. The purpose of this rule is to protect and preserve existing riparian buffers in the Neuse River Basin to maintain their nutrient removal functions. The rules protect 50-foot wide r"garian buffers starting at the top of bank of subject streams. The construction of a greenway trail within the protected buffers is designated as "allowable" under the Neuse Buffer Rule (15A NCAC 213 .0233(6)). "Allowable" uses require written authorization from the DWQ. The property owner or responsible party (e.g., City of Raleigh) will be required to submit arequest for a "no practical alternatives" determination to the DWQ. The current procedure to submit this request isihrough the use of the Pre-Construction Notification Application Fgfm (PCN Form). The DWQ is required to review theproposed project and make a finding of fact as to whether the requirements for a "no practical alternatives" determination are met. These requirements include what's commonly inferred to as a "minimization/avoidance" review and maylequire the use of best management practices for stormwiftter WON control. In this review the DWQ must make a determ-Ilration that the proposed use has minimized disturbance to ft buff*r much as practicable. During our site visit, we discussedthree possible alignments for the proposed greenway trail as indicated on the attached map as 1", "2" and "3". It appeam through a preliminary review that alignment "1" appears to have the feast amount of disturbance to the buffers. It's fiat entirely clear, but it appears that this alignment will have less disturbance to the-buffers associated with Floneymitt Creek than alignment "Y. It appears that alignment "3" has the next least amount of disturbance to the buffers. However, it h unclear as to the amount of disturbance the alignment would have to the buffers associated with Honeycutt Creek rear the Honeycutt Rd. / Durant Rd. intersection (e.g. potential parallel impacts on the northwest corner of Honeycutt Rd. and Durant Rd.). Also, depending on its exact alignment it may potentially require more cut-and-fill of the adjacent hibide west of creek "A". Alignment "2" appears to have the greatest amount of disturbance to the buffers. However, it is difficult to make this determination since we do not have the exact alignment, the scale of the map is too large to perform a detailed review and it appears that less cut-and-fill will be required than alignment "3" but possibly more than aligment"1". In conclusion, the proposed greerwaywill require a "no practical alternatives" request and review by the DWQ if impacts to the protected buffers are proposed- The DWO will be happy to review any of the proposed alignments mentioned above (or any other alignment not mentioned above). The request should include justification for any and all proposed impacts to the protected buffers.. It may help to provide alternative alignments (including an alignment that has no parallel impacts to the protected buffers'C-e.r perpendicular crossings only)) to justify the preferred alignment. Nor does this letter approve any activity Mthin Waters of the United States or Waters of the State. Please be aware that even if no direct impacts are proposed to the protected buffers, diffuse flow of all stormwater runoff as per 15A NCAC 2B .0233(5) is required. Also, please be aware that any impacts to the streams or adjacent wetlands will require the use of a Nationwide Permit and Water Quality Certftation (WQC) and most likely will require written approval from the DWQ for at least the WQC. In addition, the surface waters within the proposed project area are classified as WS-IV, water supply waters. The project must comply with the State and local water supply regulations.
