Dear Mr. Avery:
On May 22, 2006, the NC Division of Water Quality (DWQ) received your application for an Individual 401 Water Quality
Certification for wetland impacts associated Corolla Bay project in Currituck County. An Individual 404 Permit will be required for this
project. Please note that the following must be received prior to issuance of a 401 Water Quality Certification:
1. The 401 Certification cannot be processed until a copy of the Corps of Engineers Public Notice for this project is received at the
DWQ Central Office in Raleigh. No action is required on your part. The Corps of Engineers will forward the Public Notice to
this Office when it is published.
2. The 401 Certification cannot be processed until the appropriate fee is submitted. Please note that beginning January 1, 1999, the
NC General Assembly passed legislation requiring payment for all 401 applications. The fee for applications is $200 for projects
impacting less than an acre of wetland and less than 150 linear feet of streams. For projects impacting one or more acres of
wetland or 150 linear feet or more of streams, the fee is $475.
Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this
project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)).
