I think I see the problem, now that I am back to my laptop and can accurately see the screen/attachments. The 401
approval you attached has expired. It expired when the NW 14 federal permit expired several years ago. If you look on
page 2 it references General Certification (GC) 3886. In the 401 program, a general certification accompanies the
issuance of the 401 permit. The specific GC that applies depends on which Nationwide permit used by the Corps. Derita
Road was issued a NW 14. When the 401 was issued, GC3886 was the associated certification. But the NW14 expired
and has been renewed by the Corps. DWR issued a new GC to reflect changes in the new NW permit. We have been
using GC4135 with NW14 since December 1, 2018.
All Nationwide permits expire every 5 years and the accompanying 401 permit expires with the Nationwide. With every
renewal comes changes, so new GCs are developed, public noticed, and issued. These expirations are not specific or
related to any job/road widening/development/sewer extension/etc. They are specific to the nationwide permit. The
NW14 expires again on December 31, 2022. If Derita Road is not complete by then, we will have to renew again.
You submitted information to me but it needs to be submitted to Raleigh with the appropriate fee. It was my
understanding that the City was going to do that. You can mail it in or submit electronically. Kristi Lynn Carpenter, our
group's administrative assistant, is a great resource in getting it processed. She can be reached at (919)707-3872. 1 have
