Sullins Dee Freeman Governor Director Secretary November 24, 2009 CERTIFIED MAIL: Cert. #7009 2250 0000 9252 5549 Duck Land Company, LLC Attn: Mr. Douglas Twiddy 1181 Duck Road Kitty Hawk, NC 27949 DWQ Project # 09-1165 Currituck County Subject Property: Lot #21 Section 2 Swan Beach Subdivision, Corolla Village Currituck Sound, Pasquotank River Basin REQUEST FOR ADDITIONAL INFORMATION Dear Mr. Twiddy: On October 30, 2009, the Division of Water Quality (DWQ) received your application dated October 28, 2009, to impact 0.02 acres of wetlands to construct the proposed single-family residential. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and SL 2008-152 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) The PCN application received in this Office states that Duck Landing Company, LLC is owner of lot #21. Please revise the plans to avoid the impacts. It is therefore necessary to demonstrate Avoidance and Minimization of wetland impacts from the proposed single-family residence. 2. Mitigation To comply with Session Law 2008-152, a statement of compliance must be submitted to this Office to document that a no known private mitigation bank with the requested credit type located in the hydrologic unit where the impact will take place exists. Please respond in writing to the DWQ within four weeks of the date of this letter to with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
