Sullins Dee Freeman Governor Director Secretary December 3, 2009 DWQ Project # 09-0566 Johnston County Mr. Joe Poole Caterpillar 954 NC 42 East Clayton, NC 27520 Subject Property: Caterpillar Access Road UT to Neuse River [030402, 27-(39.7), WSIV, NSW] STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Poole: On May 21, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to permanently impact 192 linear feet of perennial stream, 9,770 square feet of Zone 2 Neuse River i basin protected riparian buffer, and 15,004 square feet of Zone 1 Neuse River basin protected riparian buffer to facilitate development of the Caterpillar Core PDC site. In order to meet Conditions 6 and 7 of the 401 Certification for this project, a stormwater management plan prepared „ by your consulting engineer McKim & Creed, dated August 12, 2009, was received by the DWQ on August 13, 2009. A revised stormwater management plan, dated September 28, 2009, was received by the DWQ on October 1, 2009, with modifications dated and received on November 5, 2009. This revised stormwater management plan has been reviewed and satisfies the stormwater management conditions of the 401 Water Quality Certification. The stormwater treatment system, which includes the drainage patterns depicted on the plan sheets, two wet detention ponds, two level spreaders and the ongoing sediment and erosion control plan for the equipment testing area must be maintained in perpetuity. You also must maintain in perpetuity the signed and notarized Operation and Maintenance Agreements dated September 25, 2009 (wet detention ponds) and October 28, 2009 (level spreaders). No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. All stormwater management conveyances, detention and treatment structures shall have maintenance access and at least 10-foot drainage easement on each side to allow for the ability to maintain the structures, to perform corrective actions and shall provide protection of the structures from potential alterations by future property owners. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
