Ty BRANCH By memo dated May 26, 2009 (attached), Cyndi Karoly - NCDENR-DWQ - 401 Oversight and Express Permitting Unit, requested that the Ecosystem Enhancement Program (EEP) determine the amount(s) of Riparian Buffer Mitigation and/or Nutrient Offset Credit that would be available from the subject site. 1. If any of the buffered areas are to be used for Riparian Buffer Mitigation, a stream determination must be made by DWQ. Response: EEP agrees that all buffered areas are adjacent agricultural drainage ditches. This site will be used to generate Nutrient Offset Credit only. 2. Although not specifically mentioned in the memo, there is a small area (0.30 acres) on the southern portion of the 10.04 acre easement that had an existing mature tree canopy (see attached map). Response: As shown on the attached map, this area has been excluded and will not be used to generate Nutrient Offset credit. After exclusion of this area, the buffer area covers 9.74 acres. Based on the above information, the Debit Ledger will list 9.74 Nutrient Offset Credits for this site. If you have any questions or wish to discuss this matter further, please contact me at any time. Sullins Dee Freeman Governor Director Secretary May 21, 2009 'COPY TO: Suzanne Klimek - NCEEP Jeff Jurek - NCEEP FROM: Cyndi Karoly - 401 Oversight and Express Permits Unit c'6 K RE: Buffer Mitigation Site Evaluations Manning Farm Site - Edgecombe County (Tar-Pamlico 03) DWQ #09-0165 Site Visit: 4/23/09 EWK/TLH Contact Person: Eric Kulz The Manning Farm Site (EEP Full-Delivery) consists of 10 acres of buffer restoration along Knight Canal and a tributary ditch. The buffer widths were all 200 feet throughout the site. The site is grandfathered for riparian buffer credit out to 200 feet. The Year 3 monitoring report states that the overall vegetation density is 714 stems per acre. Trees were large and robust throughout the site . The conservation easement was not marked at the time of the site visit. This site has progressed well and DWQ has no issues with this project. ITEMS TO ADDRESS: If riparian buffer credit (as opposed to nutrient offset credit) is desired, DWQ personnel from the Washington Regional Office must be contacted to conduct a stream determination on the tributary ditch to Knight Canal to determine applicability of the Tar-Pamlico Buffer Rules. This feature does appear on the USDA Soil Survey.
