Subject: REQUEST FOR ADDITIONAL INFORMATION
Ferguson Creek Village Subdivsion
Dear Mr. Patel:
On February 25, 2020, the Division of Water Resources — Water Quality Programs (Division) received
your application requesting a 401 Water Quality Certification from the Division for your project. The
Division has determined that your application is incomplete and cannot be processed. The application is
on -hold until all of the following information is received:
A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers
has verified all stream and wetland locations for Phase 2 of the proposed subdivision. Please
note that a delineation of the entirety of the proposed Phase 2 of the subdivision will be
necessary for the Division to determine that all avoidance and minimization measures have
been taken within the development. [15A NCAC 02H .0502(a)(7)].
2. The PCN for this project incorrectly states that this project is not subject to riparian buffer
regulations. S. Prong Stinking Quarter Creek is within the Jordan Lake Watershed and therefore
all streams shown on either the USGS map and/or the published soil survey are subject to the
Jordan Lake Riparian Buffer Protection Rules (15A NCAC 02B .0267). Please provide a Jordan
Lake Buffer Authorization or Variance from the local delegated municipality to document that
any proposed or after -the -fact impacts to the protected riparian buffer are in accordance with
the approved local ordinances.
Please provide a site plan with the proposed lot layout for the subdivision as an overlay
including jurisdictional stream and wetland features as well as all riparian buffers. You should
also include building envelopes for all lots with wetlands, streams or buffers on the site plans to
demonstrate these lots are able to be developed without additional jurisdictional impacts. [15A

4. For the proposed stream impact #2:
a. Please clarify whether the Guilford County Erosion Control program will require riprap
within any stream channels or wetlands as part of the Erosion & Sedimentation Control
Plan approval. If riprap is required, please enumerate and clearly label the temporary
and permanent impacts on the site plan and submit a channel restoration detail. Riprap
must be located below the stream bed elevation. [15A NCAC 02H .0506(f) and (g)]
Please provide a detailed engineering plan, profile view, and cross-section of all
proposed culverts. These drawings must include details regarding stream alignment in
relation to pipe alignment, pipe slope, pipe burial, and dissipater pad. [15A NCAC 02H
.0502(b)]
Per Condition 9 of GC 4139, all work must be done "in the dry". Therefore, dewatering
methods will be necessary to temporarily dewater the stream channel during pipe
installation. Please provide a construction sequence that details the method of
dewatering to be utilized at the site and the sequence of construction events to be
followed to ensure compliance with this condition. In addition, please ensure that the
location of the temporary impacts are shown on the construction drawings and clearly
indicated in the revised impact table. [15A NCAC 02H .0502(b)(3)]
5. Please provide information from Guilford County Stormwater Administrator whether Phase 2 of
this subdivision will be subject to stormwater requirements (density requirements and/or
diffuse flow requirements) as set forth in Guilford County's Development Ordinance. [15A NCAC
02H .0506(b)(5) and (c)(5)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information
to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by
submitting all of the above requested information through this
link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on
the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be denied as incomplete. The denial of this
project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
Please be aware that you have no authorization under the Water Quality Certification Rules for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
