Box 595 Selma, NC, 27576 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Conditions Dear Mr. Millard You have our approval, in accordance with the attached conditions, to place fill in 0.39 acre of wetlands in order to construct a road crossing at the Cardinal Pointe Subdivision in Johnston County, as described in your application received by the Division of Water Quality on March 26, 2002, and in additional correspondence received May 29, 2002. No impacts to streams or Neuse Buffers were requested in your application. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3375, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 14 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification as well as the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at htto://h2o.enr.state.nc.us/ncwetlands ; 2. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the wetlands at the road crossing location; 3. The enclosed "Certification of Completion Form" is to be used to notify DWQ when all work included in the 401 Certification has been completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I regret to inform you that the contractor cleared the wetlands in accordance with the 401 Water Quality Certification application and the Corps of Engineers wetlands permit on Tuesday morning May 28. Your letter is dated May 21; however, it is post marked May 28, 2002 and received in Mr. Millard's office on May 29, 2002. Apparently, an illegible fax was sent to Mr. Millard's office on Friday, May 24; however, Mr. Millard left for vacation on Thursday, May 23 and did not receive the fax until returning to his office in the afternoon of May 28. I personally contacted your office on May 21, May 23, and May 24 concerning the status of this permit. Each time I was transferred to Mike Horan or Rob Ridings for information from the database. On May 21, I was told, "The application was sent to the regional office and we are awaiting comments." On May 23, I was told, " The permit has not been issued yet." On May 24,1 was told, " 1 e-mailed everyone yesterday concerning this permit and no one has gotten back to me yet. I will talk to everyone concerning this permit and call you back today." I informed your staff that I knew the permit became statutory on May 25, and that a contractor was on site and would be clearing the wetlands on Tuesday morning May 28 upon the permit becoming statutory. I left my name and phone number for a return call. I never received a call back. I believe that Mr. Millard and myself have done everything possible to comply with the general statue requirements concerning this permit. I was never told during any of my three phone calls that an administrative hold had been placed on the permit or that any action had been taken by your office to delay the issuance of the permit. Lots 4, 5, 7, and 10 are sold, houses are built, and people live in these houses. Lots 7A, 10A, and 12A are off site septic system fields for lots 7, 10, and 12 respectively and were sold with the lot. These off site lots cannot be shifted or changed in any way due to the requirements of the septic fields. Likewise, the majority of the road front lots are sold. Access to the rear of this property with the least amount of wetlands impact is the requested alignment. Every possible effort was made during the design of this project to minimize the wetland impacts. Four different roadway alignments and curvatures were evaluated to determine the minimum impact to the wetlands, and the submitted alignment is the best overall. Any alignment shift would only increase the amount of wetlands impacts. I am sorry that the construction of this road has turned out the way that it did; however, I know that I did everything possible to comply with the statutory requirements for this road crossing and to inform your office of our intensions. I respectfully request that you issue the permit as submitted or send a letter stating that the permit has become statutory so this matter can be closed. Box 595 Selma, NC, 27576 SUBJECT: REQUEST FOR ADDITIONAL INFORMATION Cardinal Pointe Residential Subdivision DWQ Project # 02 0463 Johnston County Dear Mr. Millard: The Division of Water Quality has reviewed your Application for a 401 Water Quality Certification for the discharge of fill material into 0.39 acre of wetlands to construct the Cardinal Pointe Subdivision in Johnston County. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by Mr. Steve Mitchell and Ms. Debbie Edwards of the DWO Raleigh Regional Office. Based on this review, we have determined that significant uses would be removed or degraded by this project. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your project on administrative hold. (1) It appears that wetland impacts may be reduced by shifting the alignment of the road to the north, such as by moving the location of the entrance at SR 2364 to Lot 5, adjacent to the utility easement. Please investigate an alternative design that would avoid the wetland fill, perhaps by shifting the location of parcels 10A, 12A and 7A to the north and providing a separate driveway to Lots 15, 16 and 38. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)). Thank you for your attention. For Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401 General Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE) Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's (DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401 Water Quality Certification. To review the requirements for the use of Nationwide, Regional or General permits, and to determine which permit applies to your project, please go to the USACE website at hft://www.saw.usace.ar-my.mil/wetlWds/rejztour.htm, or contact one of the field offices listed at the end of this application. The website also lists the responsible project manager for each county in North Carolina and provides additional information regarding the identification and regulation of wetlands and waters of the U.S. The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant which 401 Certification will apply until the 404 Permit type has been determined by the USACE. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at htty://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for some General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet should contact DWQ's Central Office in Raleigh at (919) 733-1786. Trout Waters Coardination_ - Special r=rdination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application). Page 1 of I CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on the last page of this application) the applicant should also contact the North Carolina Division of Coastal Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate the 404/401 Permits. USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms, photos, etc, to the applicable USACE Regulatory Field Office (addresses are listed at the end of this application). Upon receipt of an application, the USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant to address information needs for all USACE Nationwide, Regional or General permits, as well as information required for State authorizations, certifications, and coordination. Fully providing the information requested on this form will result in a complete application for any of the USACE Nationwide, Regional or General permits. Please contact the appropriate regulatory field office for specific answers to permit processing periods. 401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center, Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401 Certification, then a non-refundable application fee is required. In brief, if project impacts include less than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is required.
