DWQ# 02-044 Pamlico County Mr. Michael Sanders Coastal Marketing and Development Company 309 Middle Street New Bern, NC, 28560 APPROVAL of 401 Water Quality Certification Dear Mr. Sanders: You have our approval, in accordance with the attached conditions, to shade and/or usurp 0.16 acre of vegetated and non- vegetated wetlands in order to construct a pier with a gazebo and five finger piers at the Shine Landing subdivision project in Pamlico County, as described in your application received by the Division of Water Quality on March 26, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at.http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Applicant proposes to develop a residential neighborhood and to construct a gravel parking lot, a 6' by 270' gravel walkway, a 6' by 317' pier with a 14.5' by 14.5' gazebo, and five 10' by 3' finger piers. The proposed structure would provide slips for 10 vessels. 486 Coastal Marketing and Development Corporation Shine Landing Pamlico County Project Setting The applicant owns an eighty acre tract of land adjacent to Dawson Creek in the community of Janerio, near Oriental in Pamlico County, North Carolina. The property is on the west bank of Dawson Creek, and has an elevation of approximately twelve feet above the normal water level. There are extensive uplands on the property, bordered by coastal wetlands along the water. There are several fingers of wetlands extending from the creek into the property. The vegetation in these fingers transitions from coastal wetland species to more freshwater wetlands. The project area is bordered on the north by a farm field and undeveloped tract of land vegetated with pine trees, wax myrtle, catbriers, and small hardwood trees. Dawson Creek forms the eastern border of the property. Water depths in the area of the proposed pier range from -4' NWL at the waterward end of the structure to -3.2' in the landward slip. A farm field with a vegetated buffer along a small gut of water is immediately to the south of the property. The southern property line cuts parallel to Dawson Creek, creating an area of waterfront property on a common lot. The uplands on the property were farmed by the previous property owners, and are now vegetated with a mix of upland grasses and herbaceous species. A wooded buffer remains between the farmland and the creek. This area is vegetated with a mix of pines and small hardwood trees. Most of the underbrush and vines have been removed to allow access to the property for sales purposes. The wetland areas are vegetated with coastal wetland species including Spartina alterniflora, Juncus roemerianus, Distichlis s icata, and scattered wax myrtles, cattails, red maples, and oaks toward the upland edge. Dawson Creek is classified SA HQW NSW by the Environmental Management Commission and is not open to shell fishing at this location. Dawson Creek is classified as a secondary nursery area by the NC Division of Marine Fisheries. The property is located in the Neuse River Basin, and is subject to the Environmental Management Commission's (EMC) Neuse River Basin Nutrient Sensitive Waters Management Strategy. Project Description The applicant proposes to develop a 79 lot subdivision adjacent to Dawson Creek. Proposed development includes the construction of a 317' by 6' pier with a 14.5' by 14.5' gazebo and five 10' by 3' finger piers. The proposed pier would provide slips for 10 vessels. The pier would be located on the southernmost lot in the proposed development. A 12' wide access road would lead to a 45' by 42' gravel parking lot, and a 6' by 270' gravel walkway is proposed leading from the parking lot to the pier. The parking lot is located outside of the 75' Coastal Shoreline AEC. The proposed walkway is the only development proposed within the EMC's 50'Neuse River Basin Buffer. A Anticipated Impacts The project as proposed would impact 356,886 ft2. Approximately 350,100 ft2 of highground will be filled and graded for construction of roads, ditches, and gravel walkway. Construction of the pier access across coastal wetlands would result in the shading of approximately 468 ft2. The pier and associated slips would usurp 6,300 ft2 of public trust area, of which, approximately 2,262 ftz of creek bottom would be shaded by the platform and finger piers. Because the proposed parking lot and future residential development would take place outside of the 75' Coastal Shoreline Area of Environmental Concern, impacts to coastal resources should be negligible.
