The items outlined in the previous letter(attached) still must be addressed. I have discussed these
items with Mr. Riley Burgess and I have also faxed him a copy of the July 5 letter.
Please provide the requested information within 30 days (approximately November 18), so
that the Authorization to Construct permit may be issued. If you have any questions regarding this

your permit application and supporting materials on May 25, 1995. This application has been assigned the number
shown above. Please refer to this number when making inquiries on this project.
Be aware that the Division's regional office,copied below,must provide recommendations from the Regional
Supervisor for this project prior to final action by the Division. I am, by copy of this letter, requesting that our
Regional Office Supervisor prepare a staff report and recommendations regarding this discharge.
The following items should be resolved before an Authorization to Construct permit may be issued:
• Please provide details/documentation/notes on plans regarding the removal of the existing aeration unit in the
chlorine contact basin.
• Please provide more detailed plans regarding the placement of the post aeration unit.
• To expedite the authorization to construct process, Rayco may wish to outline derailed plans of the existing
system and the proposed modified system.
• The detailed plans should include the contact tank dimensions and working volume.

Dear Mr. Stogner:
In accordance with your Petition for Contested Case Hearing filed on August 22, 1994, and
subsequent settlement December_14,_1-994, we are forwarding herewith the subject permit. The
permit has been modified-as61 ows:
Plans and specifications, along with appropriate fee, for an adequate disinfection system
excluding aeration (designed by a professional engineer) must be submitted to the Division
within 90 days of the effective date of the permit. Modification of the system must be
completed within 90 days of receipt oofihe authorization to construct. This condition is outlined
in Part III, Special Condition F of the permit.
All other terms and conditions contained in the original permit remain unchanged and in full
effect. These modifications are issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency dated December 6, 1983.
It is the Division's understanding that this modification will resolve all items contained in the
Petition for Contested Case Hearing. If this is not the case, then Rayco Utilities should notify the
Division immediately, but no later than ten (10) days following receipt of this letter. Unless such a
demand is made, this decision shall be final and binding.

Management Commission, and the Federal Water Pollution Control Act, as amended,

Pine Valley Subdivision Wastewater Treatment Plant

west of Salisbury
Rowan County
to receiving waters designated as Setman Branch in the Yadkin-Pee Dee River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, 11, and III hereof.
This permit shall become effective February 1, 1995

Rayco Utilities, Inc.
is hereby authorized to:
I . Continue to operate an existing 0.025 MGD wastewater treatment facility consisting of an aeration
basin, clarifier, chlorine contact chamber disinfection, and sludge holding tank located at Pine
Valley Subdivision Wastewater Treatment Plant, NCSR 1802, west of Salisbury, Ro%+an County
(See Part III of this Permit), and
2 After receiving an Authorization to Construct from the Division of Environmental Management.
make any necessary modifications to meet the limitations of this permit, and
3 Discharge from said treatment works at the location specified on the attached map into Setman
Branch which is classified Class C waters in the Yadkin-Pee Dee River Basin.

During the period beginning on the effective date of the permit and lasting until expiration, the Permittee_is authorized to discharge from

Instream samples shall be grab samples and shall be conducted weekly.
*' The daily avcrngc dissolved oxygen effluent concentration shall not be less than 6.0 mg/I.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly at the effluent by grab
sample.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

E. Zero Flow Condition
The facility discharges into a stream with 7QI0/30Q2=0 cfs. Removal of discharge is
recommended if a more environmentally sound alternative is available at an economically
reasonable cost. An engineering report evaluating alternatives to discharge is duc 180 days prior to
expiration along with the renewal application. As part of the report, the cost of constructing a
treatment plant that will meet limits of 5 mg/1 BOD, 2 mg/l NH3, 6 mg/I (min.) DO, and 17 µg/1
chlorine should be included, if there are no feasible alternatives to surface discharge. Upon review
of the engineering report, the Division retains the right to reopen and modify this NPDES permit to
require removal of the discharge or to revise the permit limitations within a specified time schedule.
