The purpose of the project is to provide a multi-slip boat dock and a boat ramp for the subdivision. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed activities will occur on Yadkin flydropower .Project Number 2197. You propose to build a boat ramp and a floating boat slip for four boats. Lawrence Dorsey, District 6 Fish Biologist and I conducted a site visit on January 7, 2002. You and representatives of Yadkin-Alcoa Power Generating Incorporated (APGI) were present. Based on our review, we will not object to the project provided the following conditions are implemented as discussed with you during our visit: 1. Large rock will be installed three feet on each side of the boat ramp. Large rock will also extend 20 feet beyond the end of the concrete ramp. 2. Buttonbushes or other similar native hydrophytic plants will be planted between the ramp and stationary pier on 10-12 foot centers. 3. Fish friendly pier structures will be installed under the stationary portion of the pier where water is usually present during summer months. 4. Buttonbushes will be planted on 10-12 foot centers from the stationary pier to form a vegetated triangle with the area of the nearby eastern shoreline. 5. Box 806 Granite Quarry, NC, 28072 APPROVAL of 401 Water Quality Certification Dear Mr. Horton: You have our approval, in accordance with the attached conditions, to excavate and place fill in 0.30 acre of waters in order to construct a boat ramp and floating boat slip on High Rock Lake in Rowan County, as described in your application received by the Division of Water Quality on March 22, 2002 and in additional correspondence received May 30, 2002. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3373, which can be viewed on our web site at httD://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to you on May 30, 2002. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsibie for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A. NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. YOU must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.U. Box 27447, Raleigh, N.C. 27611-7447. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to fi-eshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. (APGI), through its Yadkin Division (Yadkin), has initiated its review of the Agency Consultation Process (ACP) and supplemental documents for the proposed multi-use facilities, which include construction of a boat ramp and 4-watercraft accommodation boat dock on Lot 1 of the Lake Pointe subdivision located on High Rock Reservoir. Yadkin has reviewed the ACP from the perspective of examining potential impacts resulting from the proposed multi-use facilities on the Reservoir and, to the extent applicable, the Yadkin-Managed Buffer that lies between the Reservoir and the subdivision. Yadkin would remind you that High Rock Reservoir is operated as part of the Federal Energy Regulatory Commission (FERC) licensed Yadkin Project. High Rock functions as a storage reservoir and serves as the principal storage/regulation facility for the entire Yadkin/Pee Dee system including Yadkin's Tuckertown, Narrows, and Falls hydroelectric power plants as well as Carolina Power & Light's Tillery and Blewett Falls hydroelectric power plants. The operation of the generation facilities at High Rock, and consequently the releases of water through the turbines, depends principally on the supply of water (inflow to High Rock), current water surface elevation, and time of year. Because High Rock Reservoir is a storage reservoir, there are seasonal fluctuations in reservoir water levels. Also, because of downstream flow requirements, extensive drawdowns can occur during drought conditions. Yadkin manages the FERC licensed Yadkin Project in an environmentally responsible manner, generally consistent with the recommendations of state and federal resource agencies. Accordingly, Yadkin has reviewed the ACP along with agency comments from the NC Wildlife Resources Commission (NCWRC). Yadkin needs additional information from you before Yadkin will consider the ACP complete. Yadkin will not issue any permits for the proposed multi-use facilities before total completion of the ACP. The following is a summary of Yadkin's specific comments. Real Estate Yadkin notes that in the deed whereby the property comprising the Lake Pointe subdivision was originally conveyed to C. C. Poole and wife Mary Poole, inter alia, the grantees specifically agreed that the water levels would rise and fall from time to time, and the grantees released Yadkin from any liability regarding the operation of the Project. Also in those deeds, Yadkin retained the following general rights in the area which extends landward for five vertical feet from the maximum normal water surface elevation of High Rock Reservoir (655-foot elevation contour line - Yadkin datum): The right to flood all that portion of the above described tracts or parcels of land up to contour at elevation 660 feet, Carolina Aluminum Company datum (now, Yadkin datum], which is five feet vertical distance above the normal maximum water surface elevation of High Rock Lake; together with the right and privilege to cut, pile, and burn all drift floatage and vegetable growth along the shore of said lake, and for a reasonable distance above, for the purpose of maintaining the premises in clean and sanitary condition. Please inform, in writing, existing lot owners of the rights that Yadkin retained in the area, which extends landward for five vertical feet from the maximum normal water surface elevation of High Rock Reservoir (655-foot elevation contour line - Yadkin datum). Please provide Yadkin with evidence of this written notification. Subdivision Access Approval, Multi-Use Facility Permitting, and Industrial Approval Procedures (Procedures) Yadkin's Procedures (copy previously provided), which became effective July 1, 1999 as part of its Shoreline Management Plan (SMP), require that an applicant seeking a multi-use facility construction permit for new or modified multi-use facilities must fulfill certain application requirements. In order for the ACP for the proposed facilities to be considered complete, Yadkin requests that you submit the following items. 1. You have submitted construction plans/detailed drawings of the proposed facilities. It does not appear, however, that the proposed facilities have been certified by a registered Professional Engineer attesting that the proposed facilities are safe and structurally sound. Consequently, please provide such a certification by a registered Professional Engineer. 2. Please provide copies of all necessary county, State and federal permits required for the proposed facilities, including, if applicable, a Section 404 Permit from the Army Corps of Engineers (ACOE) and a Section 401 Water Quality Certification from the North Carolina Division of Water Quality (DWQ). 3. You have provided Yadkin with a copy of the comments of NCWRC dated January 18, 2002. Please also provide Yadkin with copies of comments received from the U.S. Fish and Wildlife Service, ACOE, North Carolina State Clearinghouse, North Carolina Department of Cultural Resources and DWQ. If you have not received comments from any of these agencies, please provide Yadkin with written confirmation that you provided these agencies copies of your proposal and an opportunity to comment upon the proposal for at least 30 days. 4. All multi-use facilities must carry comprehensive general liability insurance. Yadkin's specific insurance requirements are contained in the attached Notice of Insurance. In order for Yadkin to issue you a construction permit, you must submit to Yadkin proof of the required insurance. Fish and Wildlife Resources As noted above, NCWRC provided its comments on the proposed facilities by letter dated January 18, 2002. NCWRC states that it "will not object to the project provided that the following conditions are implemented as discussed with you during our site visit." These conditions are: 1. Large rock will be installed three feet on each side of the boat ramp. Large rock will also extend 20 feet beyond the end of the concrete ramp. 2. Buttonbushes or other similar native hydrophytic plants will be planted between the ramp and stationary pier on 10-12 foot centers. 3. Fish friendly pier structures will be installed under the stationary portion of the pier where water is usually present during summer months. 4. Buttonbushes will be planted on 10-12 foot centers from the stationary pier to form a vegetated triangle with the area of the nearby eastern shoreline. 5. Buttonbush planting areas may also include other wetland and riparian species such as arrowhead, silky dogwood, silky willow, tag alder, black willow, river birch and sycamore etc. as determined by a professional horticulturist or nursery professional. Please provide Yadkin with your response to NCWRC's recommended conditions, including whether and how you intend to implement these recommendations. Please be aware that Yadkin may include these recommendations as conditions in any construction and operating permit it may issue for the proposed multi-use facilities. Certain Conditions Regarding the Four Watercraft Accommodation Boat Dock To Be Included In Operating Permit Yadkin would also like to provide you with advance notice of certain important conditions that will be included in the Operating Permit (OP) for the proposed multi-use facilities. Certain conditions of the OP will relate to the assignment of slips on the boat dock. Please notify in writing the Lake Pointe Homeowners Association (HOA) and the affected lot owners of the conditions that will be contained in the OP regarding the assignment of slips on the boat dock. Such conditions will be similar to the following. Lot Nos. 1-4 will be assigned the right to use the four slips on the boat dock. Based on the assignment of the right to use a specified slip, present and future owners of a residential lot receiving such assignment will not be eligible to apply to Yadkin for permission to construct a private individual or shared pier pursuant to Yadkin's Specifications for Private Recreation Facilities ("Specifications"), even if they otherwise would meet the eligibility requirements of the Specifications, unless the boat dock is removed or the multi-use facilities' operating permit from Yadkin is terminated and the lot owner was not responsible for that termination. 2. With the prior written consent of the owner of the lot receiving the slip assignment, however, the Lake Pointe HOA may allow other lot owners in the Lake Pointe subdivision, their guests and invitees, to use that slip, but such assignment does not relieve the assigned slip lot owner of responsibility for complying with the conditions of the slip assignment. Consent by the assigned slip lot owner to the slip's use by others does not make that lot owner eligible to apply to Yadkin for permission to construct a private pier even if that lot owner would otherwise be eligible under the Specifications. 3. Each assigned slip lot owner must comply with Yadkin's Shoreline Stewardship Policy ("Policy") and other policies, procedures and requirements that are applicable to homeowners who have a permit to maintain a private pier. These lot owners must also comply with any other applicable provisions contained in the OP for the boat dock. 4. The Lake Pointe HOA will be responsible for the enforcement of the foregoing conditions of assignment of slips to owners of Lot Nos. 1-4 set forth in paragraphs 1 and 3 above (the "Slip Assignment Conditions"). If the Lake Pointe HOA fails to enforce the Slip Assignment Conditions, Yadkin retains the right to revoke the assignment of the slips to the individual lot owners upon providing due notice to the Lake Pointe HOA and the affected lot owner of its intent to do so. In the event of a failure to enforce the Slip Assignment Conditions, the Lake Pointe HOA will be obligated to reimburse Yadkin for all of its costs and expenses, including without limitation attorneys' fees, incurred in taking action against lot owners who fail to comply with the Slip Assignment Conditions. 5. The Lake Pointe HOA will undertake reasonable steps to ensure that the lot owners being assigned a slip on the boat dock, and subsequent purchasers of these lots, are advised in writing of the Slip Assignment Conditions and the enforcement provisions set forth in paragraph 4, above. Such reasonable steps may include, but not be limited to, creation of a slip assignment document signed by the lot owner and that document may be recorded in the chain of title with the deed for each lot so affected. At Yadkin's request, the Lake Pointe HOA will provide to Yadkin copies of any written notification. 6. The boat launch ramp will be designated for general use by Lake Pointe property owners. Summary To summarize, before Yadkin can continue its review of the ACP and consider the ACP complete, it will need the following items from you. 1. Written evidence that you have notified existing lot owners of the rights that Yadkin retained in the area, which extends landward for five vertical feet from the maximum normal water surface elevation of High Rock Reservoir (655-foot elevation contour line - Yadkin datum). 2. Certification by a registered Professional Engineer attesting that the proposed facilities are safe and structurally sound. 3. Copies of all necessary county, State and federal permits required for the proposed facilities, including, if applicable, a Section 404 Permit from the Army Corps of Engineers (ACOE) and a Section 401 Water Quality Certification from the North Carolina Division of Water Quality (DWQ). 4. Copies of comments received from the U.S. Fish and Wildlife Service, ACOE, North Carolina State Clearinghouse, North Carolina Department of Cultural Resources and DWQ. If you have not received comments from any of these agencies, please provide Yadkin with written confirmation that you provided these agencies copies of your proposal and an opportunity to comment upon the proposal for at least 30 days. 5. Proof of insurance as outlined in the attached Notice of Insurance. 6. Your response to the recommended conditions contained in NCWRC's letter dated January 18, 2002. 7. Written evidence that you have notified the Lake Pointe HOA and the affected lot owners of the conditions that will be contained in the OP regarding the assignment of slips on the watercraft accommodation boat dock. Once you have provided Yadkin with the above requested information to Yadkin's satisfaction, Yadkin will consider the ACP for the proposed multi-use facilities complete and Yadkin can complete its environmental review of the proposed facilities. Completion of the ACP clears the way for you to obtain from Yadkin a construction permit authorizing the construction of the proposed multi-use facilities. This letter in no way constitutes pre-approval or conditional approval of any private individual or shared pier, or multi-use facilities, or activities to occur on the Yadkin-Managed Buffer, along the shoreline, or in the reservoirs (including installation of private individual or shared piers, or multi-use facilities, shoreline stabilization measures, pathways, or vegetation clearing). Permission to install pathways, construct piers, clear vegetation or install shoreline stabilization facilities will be considered on a case-by-case basis with individual property owners and will be granted in accordance with Yadkin's policies and practices existing at that time.
