Murray, PWS 600 East Fourth Street Charlotte, NC 28203 Dear Ms. Murray: RE: 4100 Pineville-Matthews Road Project You have our approval, in accordance with the attached conditions and those listed below, to impact 222 . feet of waters of Stream A and unnamed tributary to McAlpine Creek for enhancement and stabilization in the Cedarwood Country Club, as you described in your application dated March 18, 2002. After reviewing your application we have decided, this fill is covered by General Water Quality Certification Numbers 3353 and 3376. These certifications allow you to use Nationwide Permit Numbers 3 and 13 when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Charlotte Storm Water Services (CSWS) has retained Carolina Wetland Services, Inc. (CWS) to perform environmental permitting services for this project. The site is located within the Cedarwood Country Club in south Charlotte, approximately 2/3 of a mile west of the intersection of Providence Road (SR 16) and Pineville-Matthews Road (SR 51) (Attachment B - Figures 1 and 2). The results of the on-site field investigation conducted by CWS indicate that there is one on-site ' jurisdictional stream channel that will be affected by the proposed improvements: Stream A (Attachment B - Figure 3). Stream A was determined to be an unimportant intermittent channel. ' It is our understanding that the activities associated with this project do not require formal "notification" under Nationwide Permit Nos. 3 and 13 (effective March 18, 2002). CSWS is requesting written verification of the jurisdictional determination of Stream A and this project's compliance with Section 404 of the Clean Water Act. A Request for a Jurisdictional Determination ' Form has been included with this submittal as Attachment A. 4100 Pineville-Matthews Road Project March 15, 2002 Jurisdictional Determination Report and Request for Verification Project No. 2002-0188 I I I I Introduction The 4100 Pineville-Matthews Road Project site is located in the Cedarwood Country Club in south Charlotte, approximately 2/3 of a mile west of the intersection of Providence Road and Pineville- Matthews Road (Attachment B - Figures I and 2). This project has two components: the replacement of existing pipe (754 linear feet of pipe and 68 linear feet of rip rap) and the enhancement and stabilization of 222 linear feet of Stream A. Charlotte Storm Water Services (CSWS) has retained Carolina Wetland Services, Inc. (CWS) to perform environmental permitting services for this project. Methods On February 21, 2002, CWS's Gregory C. Antemann and Isaac J. Hinson approximated on-site jurisdictional waters of the U.S. ' within the project area (Attachment B - Figure 3). Potential jurisdictional wetlands were investigated on-site using the U.S. Army Corps of Engineers (USACE) - Routine On-Site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual .Z No adjacent wetland areas were identified during the field investigation. Jurisdictional areas within the project limits consist of the bed and bank of Stream A. A Routine On-Site Data Form, representative of a non jurisdictional upland area adjacent to the on-site channel, has been included as Attachment E. Jurisdictional waters of the U.S. were classified according to recent NCDWQ3 and USACE guidance. The NCDWQ Stream Classification Form includes a qualitative review of channel characteristics and sampling with a D-shaped dip net at various segments of on-site jurisdictional stream channels. The NCDWQ stream classification provides insight into the quantity and type of mitigation that will be required for impacts. The USACE Intermittent Channel Evaluation Form classifies a stream channel as either perennial, important intermittent (providing a function to aquatic resources), or unimportant intermittent (not providing a function to aquatic resources). "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 2 Environmental Laboratory. 1987. Version 2.0. 1999. 2 ' 4100 Pineville-Matthews Road Project March 15, 2002 Jurisdictional Determination Report and Request for Verification Project No. 2002-0188 Results ' The results of the field investigation indicate that there is one jurisdictional stream channel (Stream A) within the project area. On-site jurisdictional waters of the U.S. are unnamed ' tributaries to McAlpine Creek. McAlpine Creek is part of the Catawba River basin and is rated "Class C Waters" by the NCDWQ. Stream A appears to be an unimportant intermittent channel and generally flows north across the ' project area. Approximately 270 linear feet of Stream A occurs within the limits of the project. This stream exhibits a variety of substrate, ranging in size from coarse sand to gravel. Stream A ' has a well-defined bankfull bench and a continuous bed and bank (Attachments C and D - SCP# 1). Neither aquatic life nor habitat was observed within the ' channel during the on-site field investigation. Stream A rated a 26.0 out of a possible 71 points on the NCDWQ Stream Classification Form. Photographs of this stream channel have been t included as Attachment F - Photographs A and B. ' A "Request for Jurisdictional Determination" has been included with this submittal (Attachment A). The pipe replacements and associated stabilization will occur under NWP No. 3. The stream bank stabilization will occur under NWP No. 13. CSWS is ' not requesting mitigation credits for the enhancement of Stream A t Proposed Impacts Under NWP No. 3, CSWS proposes to replace a total of 575 linear feet of failing 36" Corrugated Metal Pipe (CMP) with 30" Reinforced Concrete Pipe (RCP) (Attachment G - Sheet Nos. 2 and 3). ' This pipe replacement is necessary to replace a failing corroded metal pipe that is located upstream of Stream A. A 24-foot rip rap apron will be constructed at the outlet of this pipe for structure ' protection. This pipe is being extended three feet to protect a 36-inch diameter American elm tree (Ulmus americana) within the project's construction limits based on requests from the Cedarwood ' Golf Course and neighborhood residents. Downstream of Stream A, CSWS proposes to replace approximately 179 linear feet of 24" CMP with 180 linear feet of RCP (Attachment G - Sheet No. ' 1) This pipe replacement is necessary to replace the undersized 24" pipe. A 20-foot and 24-foot rip rap apron will be constructed at the inlet and outlet of this pipe for structure protection. ' Under NWP No. 13, CSWS proposes to enhance and stabilize approximately 222 linear feet of Stream A (Attachment G - Sheet Nos. 1 and 2). The stream banks along Stream A will be re- graded to improve its ability to convey storm water run-off and to control erosion. Erosion control matting will be used on all exposed banks. This matting will be supplemented with rip rap along the outside of the meander bends of the channel. The natural meanders of the channel will be maintained to preserve the channel's natural pattern. 4 4100 Pineville-Matthews Road Project March 15, 2002 Jurisdictional Determination Report and Request for Verification Project No. 2002-0188 Avoidance and Minimization The placement of rip rap within the active channel bed will be minimized to the maximum extent practicable. Shear stress calculated for Stream A's natural bends is greater than the permissible shear stress allowed for the specified erosion control matting. The specified erosion control matting has a maximum permissible shear stress of 2.25 lbs/ft2. The shear stress on the channel bends was calculated to be above 2.7 lbs/ft2. Therefore, approximately 55 linear feet of rip rap will be placed along the toe of slope of the right bank and 25 linear feet will be placed along the toe of slope of the left bank. These activities are illustrated in Attachment G - Sheet Nos. 1 and 2. No mitigation for impacts associated with this project is being proposed at this time. The enhancement of Stream A will likely improve the water quality of downstream waters through a reduction in sediment loading. Request for Verification CSWS is requesting written verification of the jurisdictional determination of Stream A and this project's compliance with Section 404 of the Clean Water Act.
