After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: This project involves bulkhead shoreline construction for stabilization and the placement of a dock along the shoreline of an undeveloped lot in Brigands Bay Subdivision in Dare County. Donald Sisler, Dare County FIELD INVESTIGATION REPORT Page 2 Project Setting The application site is located at lot 164, Blackbeard's Court, Brigands Bay Subdivision in Frisco, Dare County. This site is a vacant 8,400 sf lot, with a total of 71 if of shoreline along a man-made canal. This canal is one of several finger canals that connect to the waterway known as Brooks Creek that flows directly into the Pamlico Sound. This lot appears to have a level grade landward of the immediate shoreline, and there appears to be little difference in elevation of the land surface of the entire lot. There is some evidence of the immediate shoreline vegetation being undercut and sloughing off along the canal. The application reports that this property has experienced one ft of erosion within the last year. The soils on this lot are sandy with more organic-hydric type soils located within 6 to 8 ft of the shoreline. Organic soils are present in the first several inches of the entire lot surface. A preliminary review of archaeological site data for this portion of Hatteras Island indicates that there are several cultural resources in the immediate vicinity of the Brigands Bay Subdivision, but none are identified on this portion of the existing canal system in Brigands Bay Subdivision. This lot is vegetated in predominately woody stem shrubs and trees including, Myrica cerifera, Persea borbonia, Juniper virginiana, Pinus taeda and Ilex vomitoria, as well as numerous vines and grasses including Smilax spp., Spartina patens and Juncus roemerianus. The lot elevation is approximately one to two feet above the water surface at NWL. The area directly adjacent to the shoreline is vegetated in a heavy Juncus roemerianus fringe approximately 6 to 8 ft in width that gradually changes to a ground cover of Spartina patens and a woody-stem vegetation canopy that extends almost throughout the entire lot. Myrica cerifera appear about 4 ft landward of the NWL, Juniper virginiana are present about 12 ft landward of the NWL and Ilex vomitoria are present approximately 21 ft from the shoreline. Judging from the amount of rack-line material present near the shoreline at the time of the application site visit, it is probable that 1 to 2 feet of the referenced Juncus fringe receives at least occasional inundation from the adjacent waters. Due to little elevation change on the lot, from the immediate shoreline, there is also a probability that a freshwater wetland fringe extends beyond the coastal wetland fringe an additional 6 to 8 feet landward of the shoreline. The canal width is approximately 120 ft. Water depths at this site, at a distance of 3 ft off-shore, are less than one ft at NWL. This canal is approximately 1,500 feet in length and is one of three finger canals that connect to the Brooks Creek canal. The canal bottom consists of predominately sand with little or no organic material. No significant areas of submerged aquatic vegetation or areas of coastal wetland emergents (i.e. Spartina alterniflora) were observed during the site visit. Some small vertebrates were observed along the shoreline in the shallow water areas near the NWL. The waters of this canal carry the same water classifications as the Pamlico Sound, and are not open to commercial shellfish harvest in this vicinity. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. The Coastal Resources Commission (CRC) has designated these waters as Areas of Environmental Concern and these include Public Trust Area and Estuarine Waters. The CRC has also designated this shoreline vicinity as a Coastal Shoreline which includes a 30 ft wide Coastal Shoreline Buffer. Donald Sisler, Dare County FIELD INVESTIGATION REPORT Page 3 A wooden bulkhead currently exists along the shoreline of the lot to the immediate west. A raised wood boat ramp and typical bulkhead are present along the neighboring shoreline to the east. The bulkhead on the lot to the east starts about 15 ft east of the property line. As have most of the lots located in this subdivision, both properties adjacent to this site have been developed with residential structures and bulkheads. Small docks are located on both adjacent lots. The water depth at the waterward end of these dock structures is approximately 2 ft at NWL. Project Description The applicant proposes to stabilize the entire shoreline of lot 164 with a wooden bulkhead and tie this structure into the existing bulkhead on lot 163. Bulkhead construction will also include a 12 ft long return wall at the property line with lot 165. The applicant proposes to align this new bulkhead with the existing bulkhead structure on the adjacent lot 163, and extend this alignment an average and maximum distance of 2 ft waterward of the NWL. The proposed bulkhead will be constructed of treated wood and the tieback area will be backfilled with sand from an off-site source. This bulkhead alignment will result in the placement of approximately 2.5 cy of fill material below the NWL. The overall land disturbance associated with the proposed shoreline stabilization, including upland area tieback and backfill work, will be approximately 1,065 sf. The applicant also proposes to construct an 18 ft (wide) by 15 ft dock waterward of the new bulkhead alignment for private use. This structure will provide one slip and this application indicates that this construction will not include any mooring piles waterward of the proposed dock. The proposed dock will be located about 25 ft from both adjacent properties along the shoreline and in the center of the lot. Anticipated Impacts The proposed bulkhead alignment will result in the filling of approximately 142 sf of Public Trust Area, as well as the filling and associated loss of some 142 sf of Juncus coastal wetland fringe. In addition, it is estimated that this proposal will result in the filling of approximately 600 sf of adjacent U. S. Army Corps of Engineers (USACE) jurisdictional wetlands (and certainly less than 0.10 of an acre). The bulkhead structure and associated backfill and grading activity associated with the bulkhead installation will result in approximately 1,065 sf of land disturbance within the Coastal Shoreline buffer. The proposed shoreline stabilization and filling activity will result in an increase in turbidity levels, at least temporarily, along this portion of this waterway. The placement of a bulkhead structure will probably result in alteration of the shallow water habitat bottom adjacent to the existing shoreline. The proposed structure will reduce the subsidence/slough-off erosion that has occurred along this shoreline and in turn, may reduce long- term turbidity associated with un-stabilized shorelines. Donald Sisler, Dare County FIELD INVESTIGATION REPORT Page 4 The proposed dock structure will extend less than one fourth of the total distance of the width of the existing canal and will not exceed the shading area allowable concerning platforms over Public Trust Area (i.e. 4 sf per one linear ft of shoreline). The proposed dock will not extend into the channel portion of the canal or interfere with any riparian access or navigation concerns associated with the use of this waterway.
