Summary TRC has reviewed the definition of"Storm Water discharge associated with Industrial Activity," specifically as defined for the transportation sector, "Transportation facilities classified as Standard Industrial Classifications 40, 41, 42 (except 4221-25), 43, 44, 45, and 5171 which have vehicle maintenance shops, equipment cleaning operations, or airport deicing operations" found in 40 CFR 122.26(b)(14)(vii), and incorporated into North Carolina regulations by reference (15A NCAC 02H.0126). The definition specifically mentions, "fueling" as an applicable "vehicle maintenance" activity that could subject the facility to regulation by the General Permit. TRC understands that Direct to Locomotive (DTL) fueling is being performed onsite. NSRC has done extensive legal research into the obligation to permit DTL fueling activities. TRC's understanding of NSRC's legal determination is that maintenance (including fueling) outside designated maintenance areas is not regulated as vehicle maintenance. For maintenance (including fueling) to be included in the transportation category, it must take place at a non-transient location. NSRC's interpretation of this determination is that if DTL fueling is taking place on the mainline track or a siding track, at a location which otherwise does not concentrate trains, have vehicle maintenance shops or equipment cleaning operations then the site is transient and therefore not considered a facility as defined by the transportation sector permit. As such these sites do not require an NPDES Stormwater permit. TRC has performed a site visit. The Kannapolis DTL Fuel Site is a siding track that does not concentrate trains, otherwise have a maintenance shop or car equipment cleaning operations.
