Norfolk Southern Railroad Company (NSRC) is requesting termination of coverage of the
National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water
Discharges Associated with Vehicle Maintenance Areas (General Permit No. NCG080000) for the
Kannapolis DTL Fuel Site, located at 306 North Main Street, Kannapolis, North Carolina 28081.
Summary
TRC has reviewed the definition of"Storm Water discharge associated with Industrial Activity,"
specifically as defined for the transportation sector, "Transportation facilities classified as
Standard Industrial Classifications 40, 41, 42 (except 4221-25), 43, 44, 45, and 5171 which have
vehicle maintenance shops, equipment cleaning operations, or airport deicing operations" found
in 40 CFR 122.26(b)(14)(vii), and incorporated into North Carolina regulations by reference (15A
NCAC 02H.0126). The definition specifically mentions, "fueling" as an applicable "vehicle
maintenance" activity that could subject the facility to regulation by the General Permit. TRC
understands that Direct to Locomotive (DTL) fueling is being performed onsite.
NSRC has done extensive legal research into the obligation to permit DTL fueling activities.
TRC's understanding of NSRC's legal determination is that maintenance (including fueling)
outside designated maintenance areas is not regulated as vehicle maintenance. For
maintenance (including fueling) to be included in the transportation category, it must take place
at a non-transient location. NSRC's interpretation of this determination is that if DTL fueling is
taking place on the mainline track or a siding track, at a location which otherwise does not
concentrate trains, have vehicle maintenance shops or equipment cleaning operations then the
site is transient and therefore not considered a facility as defined by the transportation sector
permit. As such these sites do not require an NPDES Stormwater permit.
TRC has performed a site visit. The Kannapolis DTL Fuel Site is a siding track that does not
concentrate trains, otherwise have a maintenance shop or car equipment cleaning operations.
Based on NSRC's legal determination, TRC is submitting a Rescission Request Form for the
NPDES) General Permit for Storm Water Discharges Associated with Vehicle Maintenance
Areas (General Permit No. NCG080000) for the Kannapolis Site.

On behalf of Norfolk Southern Company(NS),TRC Environmental Corporation is submitting the attached
Rescission Request forms for the Gastonia DTL Fuel Site and the Kannapolis DTL Fuel Site. The activities at these
sites do not meet the definition of a non-transient facility with a vehicle maintenance shop or equipment
cleaning operations and therefore are not included in the transportation maintenance category per 40 CFR
122.26(b)(14)(viii). As a result, neither of these sites require a NPDES Stormwater Permit.
