8. PROJECT SUMMARY: The applicant is requesting to build a commercial center and parking
on a high ground lot in conjunction with a pier and ten boat slips at the mouth of a man-made
canal just off of the Atlantic Intracoastal Waterway.

9. PROJECT DESCRIPTION
The proposed Ocean Isle Fishing Center is located on Causeway Drive beside the Ocean Isle Beach bridge
within the Town of Ocean Isle Beach in Brunswick County. Ocean Isle is on a barrier island bounded by
the Atlantic Ocean on one side and the Atlantic Intracoastal Waterway on the mainland side. Ocean Isle
Beach can be reached via Highway 904 off of Highway 17. The subject property borders a man-made
canal near the canal's intersection with the Intracoastal Waterway. The property is approximately 19,000
square feet (.4 acre). The elevation of the lot is purported to be 10' above sea level. Some broken
concrete pieces and old concrete pilings have been placed on the slope and in the marsh at some time in
the past. The lot is bordered on the canal side by a 20' wide fringe of federal and coastal wetlands
located on the slope and between the toe of the slope and the open water. The only proposed impacts
to wetlands will be shading of the plants by the. proposed 6' wide access pier, elevated on pilings.
The applicant is proposing to construct an entrance drive, 7231 square foot gravel parking lot, one 5,468
square foot commercial building with parking underneath, and a pier with ten boat slips. The proposed
building will contain a bait and tackle shop and a restaurant. The proposed building and parking will be
on high ground and the footprint is shown on the site plan. The property is currently a vacant lot covered
in grasses. All of the building and a portion of the parking are located within the 75' estuarine shoreline
area of environmental concern. The proposed building is located landward of the 30' buffer area from
mean high water. However, an uncovered walkway and 200 square foot deck are located within the
buffer zone. The proposed impervious surface exceeds the allowable 30 % of 75' area of environmental
concern (57 %), therefore, the applicant must install a stormwater management system.. See the Grading
Plan. for the location of the system. Waste disposal will be by the Town of Ocean Isle Beach municipal
system. Source of drinking water is a public water supply. There will be 2 underground fuel storage
tanks, diesel and gas. This property has been designated as "Conservation" under the Town of Ocean Isle
Land Use Plan. The adjacent properties are Department of Transportation right-of-way and Sharky's
Restaurant.
A ten-slip commercial pier and docking facility is being proposed within the.man-made canal near the
mouth of the canal where it connects to the Intracoastal Waterway. Electrical outlets and hose bibs are
planned for each boat slip. Also, the applicant plans to offer fuel as an amenity for the boaters. The
proposed slips are 14'-16' wide adjacent to a 16' long floating finger. Five floating fingers extend from
a 8' by 140' floating dock spine. Low tide water depths in the area of the proposed boat slips ranged
from -3 to -5 at the time the application was submitted. However, during the last couple of weeks, the
Town of Ocean Isle has been involved in a maintenance dredging, initiative which included this area. See
sheet 5 of 6, drawing entitled profile View Of Pier and Dock. The cumulative square footage of the
dockage is 1618 square feet which would result in the 4 square feet per linear foot of shoreline allowance
in the rules being exceeded. A total of 700 square feet is allowed based upon 175' of shoreline. The
proposed structure as designed also exceeds the one-fourth width of the waterbody limitation. The
structure, as designed, extends 40' into open waters past the coastal marsh edge. Total open water width
is 130'. One fourth of that width would be 32.5'. The proposed structure is not located between two
longer structures. The pier/dock structure meets the required 15' setback off of the adjacent riparian
corridor lines on each side.
The nearby waters of the Atlantic Intracoastal Waters have been classified as SA by the Division of Water
Quality (includes all sloughs, sounds, inlets and connecting channels). The area is not a designated
Primary Nursery Area as determined by the Division.of Marine Fisheries. The AIWW in this area is
conditionally open to shell fishing. The waters of the man-made canal are closed to shellfishing.

10. ANTICIPATED DvIPACTS
If approved, this project would result in the land disturbance of 19,000 square feet of high ground:
Construction will, result in an impervious surface coverage of 12,699 square feet or 95 % of the lot.
Approximately 1658 square feet of open water will be shaded as a result of the pier and floating docks.
This figure does not include the open area within the boat slips. Another 120 square feet of federal and
coastal wetlands will be shaded as a result of pier construction elevated over it. Temporary impacts to
the coastal marsh and the shallow bottom will result from the driving or jetting in of pilings. There should
be no navigational impacts as a result of this project so long as the structure meets the length limitation
as outlined in the rules..

Project Narrative
McMullan Partners, LLC proposes to develop a 0.44-acre tract located on Causeway Drive (SR
1272) in Ocean Isle Beach, NC. The proposed development includes one (1) commercial building
located on pilings, a marl parking lot located adjacent to and under the proposed building, and a
pier and dock with 10 boat slips. The commercial building will include a retail store that sells bait
and tackle, and a small restaurant.
The subject site is located within the zoning jurisdiction of the Town of Ocean Isle Beach, and is
zoned C-2 (Commercial Business District). The Town of Ocean Isle Beach Water Supply System
and Sewer Collection System serve the site.
The existing grade. at the site is primarily flat, with a general elevation of 10' MSL. The finished
floor elevation of the proposed building on pilings is approximately 20' MSL. The proposed pier
and dock extend from the existing ground level into the adjacent canal. The proposed dock
extends to the pier head line as established by the adjacent property, which is approximately forty
feet (40') from the coastal marsh line. Although this distance is slightly greater than '/4 of the 130'
wide canal, the existing pier head line is justified due to the limited depth of the canal. The Town
of Ocean Isle Beach has a current contract with a dredging company to deepen this canal, however,
the law prohibits dredging within ten feet (10') of the coastal marsh line.
Land Management Group, Inc. of Wilmington, NC flagged the Mean High Water (MHW), Joint
Upper Coastal Marsh and 404 Wetland Line as one line located in the vicinity of the 2.9' MSL
contour (see attached design plans). No other wetlands were indicated on the 0.44-acre tract.
Access to the Area of Environmental Concern on the site is accessible from Causeway Drive,
without crossing any Section 404 wetlands.
The area of the tract within 75 feet of the established MHW line is 13,033 square feet (SF). The
built-upon area within 75 of the MHW is 7,422 SF or 57% impervious. An additional 5,277 SF of
built-upon area is proposed on the site. The stormwater runoff from all of the proposed built-
upon areas will be directed to an on-site underground infiltration trench system. This system has
been submitted to the North Carolina Department of Environment and Natural Resources,
Division of Water Quality for approval.
