APPROVAL of 401 Water Quality Certification
Dear Ms. Lunden:
You have our approval, in accordance with the attached conditions, to shade 0.01 acre of non-vegetated wetlands in order to
construct a commercial pier to moor the Island Queen at Colington Creek in Dare County, as described in your application received by the
Division of Water Quality on March 1, 2002. After reviewing your application, we have determined that this fill is covered by General
Water Quality Certification Number 3371, whieh can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This
Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the Geneial Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certificatiorrand approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 1506 of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you askfor a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

8. PROJECT SUMMARY: The applicant Jay Mankedick proposes to remove a single wide mobile home and a
storage building and place a 25 space unimproved parking lot on high a ground site to accommodate a tour
boat business that will include constructing a 6'x 56' commercial pier to moor a large paddlewheeltour boat
called the Island Queen. The property is located at 1239 Colington Road adjacent to the west end of the
bridge at Colington Creek on Little Colington Island, in Dare County.

PROJECT SITE
The applicant's project site is located 1239 Colington Road, little Colington Island, adjacent t the
Colington Creek Bridge, in Dare County. The site is situated at the end of a small paved road, o the
west side of the bridge just off Colington Road (SR 1217), that was abandoned by North Carol a's
Department of Transportation (NCDOT) on December 27, 2001, and assigned to the owner o the
property in question (Mae Blankenburg Lunden). According to the Flood Insurance Rate Map prod ced
by the Federal Emergency Management Agency, the property is located in an AE (EL9) Flood one,
while the physical elevation of the property is an average of three feet above normal water level WL)
along Colington Creek and the adjacent man-made canal. Vegetation on the site is restricted to do estic
grasses and ornamentals.
Structures on the property include a single-family dwelling, a singlewide mobile home with a large
wooden deck, two storage sheds, crab shedders, two docks and a bulkhead. The site is approxi ately
33,350 square feet in area with a flat profile. The total amount of impervious surface on the pro erty,
within the 75' Estuarine Shoreline Area of Environmental Concern (AEC), is approximately 4,121 s uare
feet (18.3%). Water depths at the bulkhead, along Colington Creek, average one foot below N , and
three feet below NWL at a distance of fifty-six feet from the bulkhead. The water bottom adjacent o the
bulkhead is sandy silt scattered with riprap debris. There are no Coastal or Section 404 Wetlands n the
project site property and no Submerged Aquatic Vegetation is located within the project area.
Colington Creek is classified as joint waters by agreement between the Marine Fis eries
Commission and Wildlife Resource Commission. The Division of Environmental Management's water
quality classification for Colington Cut is SC (fish propagation). Additional review indicates tha there
are no known geological formations associated with the applicant's property. There are several ide tified
archeological sites on Colington Island, but none are in the immediate vicinity of the applicant's pr perty.
Colington Road (SR1217) and the Colington Creek Bridge are located along the north side of the
applicant's site, and Estuarine and Public Trust Waters are located to the south and east. Properti s west
of the project site have a mix of residential and commercial uses.
PROJECT DESCRIPTION
The applicant proposes to construct 6'x 56' pier on the east side of the property in Co ington
Creek, adjacent to the Colington Creek Bridge. The pier will shade 336 square feet of shallow bo om, as
well as, Estuarine and Public Trust Waters. According to the plans the pier will be used to accom odate
a large paddle wheel tour boat called the Island Queen that will be used to give tours along C lington
Creek, Buzzards Bay and the Roanoke Sound. All ticket sales will be conducted on the boat.
Bathroom facilities in conjunction with the business will be on board the vessel and will require
regular pumping. The existing septic system from the singlewide mobile home will not be remo ed, and
will not be utilized for the business. Structures will be removed from the property to accom odate a
proposed parking lot to satisfy requirements established by Dare County's Planning Departure t. The
singlewide mobile home and associated decks, one storage shed, and four crab shedders will be r moved
from the property, as shown on the plan submitted. All structures being removed are above gro nd and
will require no excavation. Minimal disturbance will be associated with the removal of the existing
buildings. While the current amount of impervious cover in the AEC is 4,121 square feet (18.3%), that
amount will be reduced to 3,425 square feet (15.2%) with the current proposal.

Twenty-five unimproved parking spaces will be delineated with wooden or concrete wheel stops
that will cover approximately 62 square feet of high ground. It is estimated that a total of 3,487 square
feet, or 15.5 %, of lot cover will occur within the Estuarine Shoreline AEC. While Dare County does
is not requiring that the parking area be improved with gravel, the applicant has expressed a willingness
toad gravel is needed. The addition of gravel parking would exceed the Division's impervious lot cover
requirement and would necessitate an innovative drainage design. It is important to note that out of the
5,850 square feet of proposed parking, 3,748 square feet would be in the AEC. While an unimproved
parking lot is not be treated by the Division of Coastal management as an impervious surface, some
compaction of the soil will occur, and the area will become less pervious over time from.
ANTICIPATED IMPACT
• If permitted the pier will shade 336 square feet of shallow water bottom and Estuarine
and Public Trust Waters.
• Temporary localized turbidity will occur during construction of the pier.
• A reduction, in the amount of impervious surface, within the 75' AEC, will occur with
the removal of the structures on the project site.
• The conversion of the property from residential to a residential commercial mix may
result in an increase in non-point source pollution from the site due to the commercial
activity and water access.
• While the parking will be unimproved the use of the grassed areas and the increased
traffic on the site, both vehicular and pedestrian, may decrease permeability of the soil
and increase surface runoff over time, due to compaction.

The 56' pier proposed would be built to commercial specifications and be used
to dock a small tour boat for scenic rides down Colington Creek and into the sound.
The pier will be built by Paul VonSuskil, a local and experienced dock and bulk-
head builder. The pier will be attached to an existing bulkhead and will be well clear of
any locally used channels. All materials and methods used to build the pier will be to
commercial standards.
The trailer-home will be removed. One small outbuilding, as seen on site plan,
will remain as a tool shed. A parking lot will have 25 parking blocks placed once area is
level,
