After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant Chester Smith III proposes to construct a bulkhead along 52.5' of shoreline, and an average of 15' waterward of normal water level, in a man-made canal off Colington Creek, on Colington Island, in Dare County. The property is more specifically located at 1329 Colington Road. Chester Smith III Field Report Page 2 PROJECT SITE The applicant's property is approximately 4,350 square feet in area, and is located on Colington Island approximately 500' west of the Colington Creek bridge, in Dare County. Located on the property is a garage that is currently being used as an outlet for locally produced art. Located waterward of the building is a large concrete slab approximately 16'x 32' and six feet from normal water level at its closest point. Mr. Smith's property is more specifically referred to as Lot 9 of R. D. Owens Subdivision, which is adjacent to a man-made canal, off Colington Creek and the Roanoke Sound. Vegetation on the property includes domestic grasses, loblolly pine (Pinus taeda), and dandelions (Taraxacum officinale). According to the application the average elevation of the lot is approximately three feet above normal water level. According to the Flood Insurance Rate Map the property is in a designated AE (EL9) Flood Zone. There are no Coastal or Section 404 Wetlands are located on the applicant's property. The property is bounded on the north by SR1217 (Colington Road), and to the south by an unnamed man-made canal (Estuarine and Public Trust Waters). Situated to the west is Billy's Seafood and to the east is a single-family dwelling. The shoreline along the applicant's property has a distinct erosion escarpment with evidence of erosion. The bank along the property has a shear drop of approximately 1.5 feet. A section of remnant wooden bulkhead is below normal water level that once tied into the bulkheads on the adjacent lots. Water depths along the applicant's property range from only a few inches at the shoreline to approximately three feet along the alignment of the adjacent bulkheads. The water bottom adjacent to the bulkhead is a sandy muck that gently slopes away from the shoreline. There is no evidence of submerged aquatic vegetation along the applicant's property. An existing 30' wide dock parallels the applicant's property, and is between 8' and 10' waterward of normal water level. The dock is in alignment with a previously existing bulkhead on the applicant's property. Colington Creek is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Colington Cut is SC (fish propagation). Additional review indicates that there are no known geological formations associated with the applicant's property. There are several identified archeological sites on Colington Island, not in the immediate vicinity of the applicant's property. PROJECT DESCRIPTION The applicant proposes to construct 52.5 linear feet of bulkhead an average of 15' waterward of normal water level on the south side of his property. The bulkhead, as proposed, would encroach onto the adjacent riparian properties, if granted. Adjacent property owners, Billy Beasley and Willie Mae Poarch, have submitted encroachment agreements that would allow the applicant to tie his bulkhead into theirs, and undertake the necessary land disturbance on their property to complete the project. Chester Smith III Field Report Page 3 According to the application submitted 796 square feet of Estuarine and Public Trust Waters would be filled in conjunction with the placement of the proposed bulkhead, and according to the application approximately 260 cubic yards of fill would be placed waterward of normal water level. However, it appears that the applicant's consultant inadvertently use nine as the divisor instead of 27 to convert 2,340 cubic feet to cubic yards, and the actual amount of fill would be closer to 87 cubic yards. In addition to filling open water, the application states that 700 square feet of high ground disturbance would occur in association with the construction of the proposed bulkhead. However, an inspection of the project site revealed the presence of concrete slab that falls within the area noted as being high ground disturbance. While the slab was not shown on the plans submitted, staff revised the plans to show the slab. Staff also contacted applicant's consultant to discuss the discrepancy. According to the consultant the slab will remain in place, which will result in a reduction of approximately 114 square feet of land disturbance. Based on this information staff estimates that actual high ground disturbance will be approximately 585 square feet, not 700 square feet as originally indicated. All proposed high ground disturbance would be in association with the installation of the tieback rods and anchors. It should also be noted that work within the 30' buffer would not include increasing impervious surfaces or surface runoff on the site. An existing 30' dock that parallels the applicant's property would be removed to facilitate the installation of the bulkhead, should the permit be granted. The dock appears to be accessed from the Poarch property, but placement of the bulkhead within the area where the dock currently exists has been acknowledged in the encroachment agreement. ANTICIPATED IMPACT • If permitted, between 585 and 700 square feet of high ground will be disturbed in association with the proposed bulkhead. • It is estimated that 796 square feet of Estuarine and Public Trust Waters will be filled if the bulkhead alignment is approved. • An existing 30' wide dock will be removed from the property. • Temporary localized turbidity will occur during construction of the bulkhead. • Stabilization of the property will reduce the amount of sediment runoff into the adjacent man-made canal. • A reduction, in the amount of impervious surface, within the 30' buffer, will occur with the installation of the proposed bulkhead.
