APPROVAL of 401 Water Quality Certification
Dear Mr. Hylton:
You have our approval, in accordance with the attached conditions, to shade 0.01 acre of non-vegetated wetlands in order to
construct two T-head extensions and five finger piers on an existing community pier on Campbell's Creek at the Windsong III Subdivision
in Beaufort County, as described in your application received by the Division of Water Quality on February 27, 2002. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded
from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by
the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also
this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Project Setting
The project area is located off NC 33 on Campbell's Creek 7 miles east of the Town of
Aurora in Beaufort County, North Carolina. The Weyerhaeuser Real Estate Company is
developing an approximately 202.5 acre tract of land bordering Campbell's Creek and Carrie
Creek into a 36 lot residential housing development named Windsong III Subdivision. The project
site is an ±3.188 acre lot adjacent Campbell's creek that has been set out as a common area.
CAMA Major permit #15-00 was issued on 10 February 2000 for the construction of a 6' wide
by 100' long pier with an 8' by 80' T-head, an access drive and parking lot. All work authorized
by CAMA Major permit No. 15-00 has been completed and a gazebo was also constructed on the
upland portion of the common area out of any Area of Environmental Concern. The common lot
has had trees thinned and has been grubbed in the past. Existing vegetation is dominated by pines
as well as upland grasses and vines. An approximately 25' wide fringe of wetlands exist adjacent
the creek vegetated with Coastal Wetlands including Juncus roemerianus, Snartina cynosuroides,
and Cladium jamaicense. which transitions to 404 wetlands species as you move inland.
Campbell's Creek is approximately 1000' wide at the project site and contains submerged aquatic
vegetation in the near shore areas. The water depth at the end of the existing pier is ±6'.
The project site is bordered on the south and north sides by undeveloped lots vegetated
similarly to the common lot. Both of the adjoining lots have been thinned and grubbed in the past
as well. The project site is ±3' to 4' above mean sea level (MSL).
Campbell's Creek has been classified as SA-NSW by the Environmental Management
Commission. Campbell's Creek is inland waters and is not open to shell fishing.
Project description
The applicant proposes to modify CAMA Major permit No. 15-00 by adding an 8' by 20'
extension to both ends of the existing T-head for a total T-head of 8' by 120'. A total of 10 slips
(20' wide by 36' long) are proposed by adding 5 - 2' wide by 16' long finger piers and 17 tie
pilings (6 slips waterward of the existing T-head and 4 slips on the landward side of the T-head).
The waterward projection of the 10 slip facility will be t 144' which is less than the 250' allowed
under the '/a the width of the waterbody rule. As a result of the proposed additions, the total
platform size will be t 1,120 ft2 out of a possible f 1,948 ft2. The depth of water for the
proposed slips begins at the -4' contour and extends out to -7'.
Anticipated impacts
The addition of the T-head extensions and finger piers for the creation of 10 slips will
result in the shading of f 480 ft2 of creek bottom. The project as proposed will result in localized
turbidity as a result of the construction activities.

Dear David:
On the behalf of Weyerhaeuser Real Estate Development Company, I am submitting a request for
a major modification of their CAMA Major permit # 00-15 which was issued for amenity
development within the Windsong III subdivision. This permit authorized the construction of a
fixed pier and "day-tripper" dock which provided temporary dockage for Windsong III residents.
The applicant is currently proposing to add structure to the existing dock which would create ten,
individual boat slips. All ten slips would be 20'-wide and 36-long, and existing depths within the
proposed slips range from -4' NLW to -7' NLW. The additional structure includes: (1) two 20'-
long sections of dock (2) five 2' x 16' finger piers (3) nine structural pilings and (4) seventeen
mooring pilings.
The adjacent riparian landowners have been notified and the green card receipts will be forwarded
to you as soon as they are received. If you have any questions regarding this request, please
