PROJECT SUMMARY: The applicant proposes to dredge an existing boat basin, construct a boat ramp, construct a day dock and courtesy pier, construct shoreline riprap and replenish existing riprap and to remove old buildings and sheds. Project Setting The site of the proposed development is an 87+ acre tract located in the northeastern area of Bells Island, Currituck County and on the Currituck Sound. The property is accessible by a paved roadway off the north side of SR 1245, Bell Island Road. It is the first driveway on the left entering Bells Island and is marked with an "Old Oaks" subdivision sign. Approximately 72 acres of the property is a salt marsh vegetated with Juncus roemerianus, Spartina patens, Spartina cynosuroides and Typha, with common reed, wax myrtle and sea myrtle along fringe areas. The remaining 15 acres are uplands and are located at the south end of the property. This area is vegetated with pine, live oak, willow, wax myrtle and indigenous grasses. The upland area has an elevation that varies from 3-6 feet above normal water level (NWL). The property was once a homestead and man-made features on the property include an abandoned house, garages, sheds, barns, a 6'x250' pier with an enclosed boathouse, approximately 600 feet of "riprap along the shoreline south of the old house, a 4'x50' pier in this area, two ponds, a basin, 350' long, 40' to 60' wide and 1-3 feet deep (below NWL) that is connected to the Currituck Sound and several unconsolidated and failing shoreline stabilization structures (i.e. jetties, pilings with tires, riprap, relic bulkhead) along the shoreline north of the old house. New development on the property consists of an asphalt access road and asingle-family dwelling located adjacent to the south of the basin. The property has approximately 1,500 linear feet of shoreline along the upland area and approximately 5,000 linear feet of shoreline along the salt marsh wetland area. The adjacent riparian property to the northwest is a salt marsh and the adjacent riparian property to the southeast is a subdivision for single-family residences. The waters of Currituck Sound in this area are classified as SC and are closed to shellfish taking. Submerged aquatic vegetation consisting of milfoil and widgeon grass was observed in the basin area. The bottom material in the basin is soft sand/silt and there are two sand bars opposite each other midway of the basin. The near shore water depths at the mouth of the basin range from 2' to 2-3/4' below NWL. The property has been subdivided into 13 lots for single-family dwellings. r Chapman Lumber Company "Old Oaks at Belle Isle" Page 3 NC Division of Water Quality (DWQ) Stormwater permit no. SW 7051129 dated January 6, 2006 has been issued for development at this site. NC Division of Land Quality (DLQ) Erosion and Sedimentation Control Plan No.: Curri-2006-013 dated December 20, 2005 has been issued for development at this site. North Carolina archeological site Currituck #30 is located on this property. Development Proposal In order to prevent erosion and stabilize the shoreline, the applicant proposes to place new riprap along areas of the shoreline that are void of riprap. One area is located 40 feet north of the existing pier and boathouse and is 113.5 feet in length. The second area is located 220 feet north of the pier and is 41 feet in length. In both areas, the proposed riprap will be placed 5 feet waterward of NWL. The applicant proposes to create a mound of riprap to cover the existing erosion escarpment resulting in a total width of approximately 14 feet along the shoreline. The third area is located along the canal, southeastern shoreline. The applicant proposes to place 107.61inear feet of riprap along the shoreline near the mouth of the canal. The applicant proposes a 3-foot wide footprint of riprap below NWL and a 3-foot wide footprint on the shoreline. The applicant proposes to backfill two eroded areas along the canal shoreline as part of the stabilization project. The total area of proposed fill is 55 square feet of canal bottom. The applicant proposes to redress 208 linear feet of existing riprap and extend the existing footprint from approximately 3 feet forward of NWL to 5 feet forward of NWL. A 4-foot wide base will be established landward along the shoreline. In order to provide boating access for the subdivision, the applicant proposes to construct a concrete boat ramp 12 feet wide and 40 feet long at the head end of the basin. The applicant proposes to construct a 4,501-square foot gravel backing and turning access for the proposed boat ramp. The boat ramp will have a 6'-wide and 44'-long courtesy dock along the ramps' west side and the applicant proposes to construct a 4'-wide and 127.7' long day dock or holding dock adjacent to the canal shoreline and next to the east side of the proposed boat ramp. The applicant proposes to dredge the existing boat basin and the channel area at the mouth of the basin to a depth of 2.7 feet below NWL. The proposed area of disturbance is approximately 30 feet wide and 450 feet long. This includes the area of the two sand bars in the basin, approximately 345 square feet. The applicant proposes to contain the estimated 374.7 cubic yards of spoil material in a 120-foot by 60-foot temporary spoil disposable area on the property. The outfall pipe for the spoil disposal area will be directed to the boat basin. The applicant proposes to remove several existing structures that were the old homestead. This activity will result in land disturbance of approximately 44,314 square feet. The applicant also proposes a general cleanup of the shoreline to remove existing tires. Chapman Lumber Company "Old Oaks at Belle Isle" Page 4 Anticipated Impacts The placement of new riprap will result in the filling of 1,150 square feet of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AECs) as well as the fill of 1,713 square feet of Estuarine Shoreline (ES) AEC. Approximately 19 cubic yards of riprap material will be placed below NWL. The placement of new riprap over old will result in the filling of 416 square feet of PTA, EW AECs and 1,456 square feet of ES AEC. Approximately 13 cubic yards of riprap material will be placed below NWL. The construction of the boat ramp will result in the filling of 240 square feet of PTA, EW AECs and 240 square feet of ES AEC. The gravel vehicle access to the boat ramp will result in the filling of 3,636 square feet of ES AEC and 865 square feet outside the ES AEC. The construction of the courtesy pier and day dock will result in the shading of 775 square feet of PTA, EW AECs basin bottom. The proposed dredging will result in bottom disturbance of approximately 13,500 square feet of PTA, EW AECs basin bottom and entrance area in the Currituck Sound. Approximately 375 cubic yards of soft bottom material will be removed and deposited in the 120' by 60'-spoil disposal area located outside of any AEC. The removal of the existing abandoned structures will result in land disturbance of 2,455 square feet of ES AEC and 41,859 square feet outside of any AEC. Removal of the existing tires will result in slight disturbance of the near shore area. Temporary water turbidity will occur during construction and dredging. The existing shallow water depths and the proposed final water depth of 2.7 feet below NWL will require intense monitoring while the work is underway to prevent over dredging. Submitted by: Frank A. The approximately 87.72-acre subject site is off SR 1245, Bells Island Road. Access to SR 1245 is from Hwy 168 in Currituck County, NC. Please see vicinity map attached. The Applicant holds title to Lots 2 through 13 of the existing subdivision. Lot 1 is currently owned by Kenneth G., and Sharon M. Rhodes. The Rhodes' are considered to be co-applicants for the actions proposed herein (Letter of Authority and copy of deed enclosed). The subject property is subdivided into thirteen lots and shoreline areas are consistently subjected to boat-wake and wind-driven wave action with subsequent erosion. The purpose of the proposed action is to increase the effectiveness of the existing shoreline protection measures and to create one continuous line of protection on the Currituck Sound shoreline of the subject site In order to: • promote and provide community recreational opportunities. • provide small boat access to adjacent waters • improve and enhance existing shoreline protection measures The proposed site amenities associated with these actions will provide erosion protection for the applicants' property while successfully avoiding coastal wetland impacts. These improvements will allow site owners and residents to better utilize the waterfront and area waters.
