APPROVAL of 401 Water Quality Certification
Dear Mr. Cheek:
You have our approval, in accordance with the attached conditions, to shade 0.05 acre of wetlands and Estuarine Waters in
order to construct a walkway in the Currituck Sound in Dare County, as described in your application received by the Division of Water
Quality on February 22, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality
Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows
you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge
and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 1508 of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

The North Carolina Division of Coastal Management has reviewed your application, dated 12/21/01, for a
U.S. Army Corps of Engineers Nationwide Permit, pursuant to Section 307 of the Coastal Zone
Management Act of 1972, as amended. Based upon our review, we have determined that the proposed
activity is consistent with the North Carolina Coastal Management Program subject to the following
conditions:
The activity described in your application is for the issuance of a U.S. Army Corps of Engineers
Nationwide Permit, Number 18, under 33 CFR Part 330. Any modification of your proposed
activity, or change in the Nationwide Permit Number that you are seeking, will require an
additional review for consistency by this office.
2. Since the activity that you propose involves impacts to waters and/or wetlands, a 401 Water

walkway with a 22 foot by 22 foot (484 square foot) observation platform waterward of the normal water
level of the Currituck Sound.

PROJECT SETTING
The Corolla Community Association currently holds title to an approximate 27-acre site
adjacent to the Currituck Sound and the Subdivision of Corolla Light. This proposal site is
located off Hampton Street, west of NC 12, in the Village of Corolla in Currituck County.
The parcel is partially developed with a pool complex, a stormwater retention pond and
open space. The site currently includes an existing 200 ft long pier with a gazebo platform,
located approximately 1,000 ft north of the proposal site. The site is bordered by property
to the south owned by Food Lion, L.L.C. and by property to the north owned by
Currituck County. USGS topographic field maps on file indicate that historical and/or
archaeological sites are located several thousand feet to the north of this site in the vicinity
of the Currituck Beach Lighthouse and Whalehead Club facilities.
The site is directly adjacent to the Currituck Sound and ranges in elevation from + 5 ft to
NWL. The site includes approximately 2,000 if of natural shoreline. The upland portion of
the site is vegetated in upland lawn and indigenous grasses, as well as upland woody,
hardwood and pine species. The upland portion of the site is bordered to the west by a
freshwater wetland fringe that gives way to a wide coastal wetland fringe that extends to
the waters of the Currituck Sound. The wetland fringe, at the vicinity of the proposed
project, is approximately 300 ft wide, however, this fringe extends approximately 1,000 to
the west along other portions of the applicant's shoreline. This fringe consists
predominately of coastal wetland plant species including Cladium jamaicense, Typha spp.
and Juncus roemerianus. The higher elevation-more landward portions of this wetland
fringe include Phragmites spp., Myrica cerifera, Taxodium distichum and Magnolia
virginiana, as well as many other freshwater facultative-obligate herbaceous, woody stem
grasses, shrubs and vines. The coastal wetland fringe is approximately 260 ft wide in the
vicinity of this proposal.
The Atlantic-Albemarle Intra-coastal Waterway does not extend through this portion of the
Currituck Sound but travels further to the west through the Coinjock Canal. The waters of
the Currituck Sound are classified as Joint Waters by the North Carolina Marine Fisheries
and Wildlife Resources Commissions. The North Carolina Environmental Management
Commission has designated these waters as `SC' (suitable for fish propagation). These
waters are closed to the commercial harvest of shellfish. During the site investigation
visits to this site, no shellfish were observed in the vicinity of this project. Some small
finfish were observed along the shoreline and some SAV's were observed offshore. The
waters of the Currituck Sound are somewhat more `fresh' than the near-by portions of the
Albemarle and Croatan Sounds. The Currituck Sound is also shallower in depth

than these adjacent sounds. The average water depth, generally, does not exceed 4 or 5 ft
in depth and water depths, even several hundred ft offshore, are only 1 to 3 ft in depth.
The water depth in the vicinity of this platform proposal is less than one ft.
The Coastal Resources Commission (CRC) has also designated these waters as Public Trust
Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the
designation of the CRC, the Coastal Shoreline AEC extends in a contour of 75 ft landward
of the NWL. The CRC has also designated coastal wetland vegetated areas, like the one
described above, as a Coastal Wetland AEC.
PROJECT DESCRIPTION
The permittee proposes to construct a 6 ft wide elevated, wooden walkway across the
above described wetland area. The structure will be pile supported, elevated at least 3 ft
above the wetland/marsh substrate and extend from high ground to a distance of 5 ft
waterward of the NWL of the Currituck Sound. A 22 ft by 22 ft platform will be
positioned at the end of the walkway and will be used for the private use of the Association
members to observe wildlife and natural coastal resources. The overall structure will be
332 ft in length.
No docking spaces or moorings are proposed with this project. There are no proposed
related upland uses associated with this proposal
ANTICIPATED IMPACTS
The proposed elevated walkway and platform will result in shading of 484 sf. of Public
Trust Area, Estuarine Waters and shallow water habitat. The proposed walkway will be
elevated 3 ft above the wetland and marsh substrate and will not exceed a 6 ft width. This
walkway will shade 1,860 sf of vegetated wetlands. The proposed platform area will
result in the shading of 484 sf of Public Trust Area, Estuarine Waters and shallow water
habitat. The proposed platform will be waterward of any coastal wetlands and this project
does not propose any upland site disturbance such as parking or other facilities.
Due to the shallow water depths of the immediate vicinity of this project and the Currituck
Sound, the platform structure will not present any navigation interference to the impacted
Estuarine Waters and Public Trust Area, nor will the project infringe upon any adjacent
riparian access. The proposed walkway portion of this project that will extend across
`freshwater U.S. Army Corps of Engineers' (USACE) jurisdictional wetlands was
previously authorized by USACE Guidance letter REGAL 90-8, dated 12-14-1990.
This project is consistent with those projects described in our rules as `water dependent'
and does not include any moorings or slips. Due to the existing shallow water depths, it is

very doubtful that this structure will be ever utilized for any watercraft other than canoes
or kayaks. The construction of the proposed structure will result in temporary disturbance
to the footprint and adjacent walkway alignment. The construction of the proposed
platform structure will also result in temporary turbidity impacts to the immediate vicinity
waters, but these impacts should not be significant and should still allow the existing
shallow water habitat to afford its recognized uses shortly after the completion of the
proposed construction.
The proposed platform square footage is consistent with the rules concerning the allotted
square footage allowed per linear foot of an applicant's proposal site shoreline. This
structure will allow the property owners and their guests (and public) to directly observe
coastal and wildlife resources of the Currituck Sound and adjacent wetland areas.

PROJECT NARRATIVE
COROLLA LIGHT COMMUNITY ASSOC. - CAMA Major Permit
This project proposes to construct a six-foot wide elevated wooden walkway and an 22'x 22' observation
platform within the Currituck Sound to accommodate the homeowners of the Corolla Light Community.
This elevated walkway will allow Corolla Light homeowners access to the Currituck Sound for nature
viewing.
Corolla Light Community Association currently has an exemption to construct a walkway from highground
adjacent to the tennis complex over US Army Corps jurisdictional wetlands. The exempted elevated
walkway terminates at the coastal wetland alignment. The proposed walkway will be an extension of the
exempted walkway extending an additional 260' terminating at the edge of the coastal wetlands (shoreline).
The elevated walkway will be constructed 36" above the marsh substrate. The 22'x 22' observation
platform will begin at the shoreline where coastal wetlands are not present. Water depth at the end of the
proposed platform is approximately 0.5 foot.
A Hydraulic pump and hand tools will be used to construct the walkway and platform. All material
delivery will be accomplished by hand beyond the wetland alignment.

Dear Mr. Turnage:
The North Carolina Division of Coastal Management has reviewed your application for Colington
United Methodist Church, dated 10/12/01, for a U.S. Army Corps of Engineers Nationwide Permit,
pursuant to Section 307 of the Coastal Zone Management Act of 1972, as amended. Based upon our
review, we have determined that the proposed activity is consistent with the North Carolina Coastal
Management Program subject to the following conditions:
The activity described in your application is for the issuance of a U.S. Army Corps of
Engineers Nationwide Permit, Number 18, under 33 CFR Part 330. Any modification of your
proposed activity, or change in the Nationwide Permit Number that you are seeking, will
require an additional review for consistency by this office.
2. Since the activity that you propose involves impacts to waters and/or wetlands, a 401 Water
Quality Certification must be obtained from the North Carolina Division of Water Quality,
which our records indicate you have already received.
Please understand that this letter does not relieve you of the responsibility to ensure that all other
applicable State authorizations and/or permit requirements are met prior to implementation of the project.
