This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control. This approval is only valid for the purpose and design that you described in your Minor Variance Request dated 02/04/02 and attached plat initialed by DWQ staff on 04/10/01. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. No impacts (except for "exempt" uses as identified within 15A NCAC 2B .0233) shall occur to Zone 1 of the protected riparian buffers. 2. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified within 15A NCAC 2B .0233(5). Roof drainage from the new addition shall be directed to vegetated areas at non-erosive velocities prior to entering the protected riparian buffers. You are required to provide 787.5 square feet of buffer mitigation. The DWQ has determined that planting additional trees on the property as proposed within your request will satisfy this mitigation if the following conditions are met. You are required to plant at least six (6) trees within fifty (50) feet of the stream within one year of the date of this approval. You or any future owners of this property must ensure that these trees survive for a period of at least five (5) years. If any of the trees die within this period they must be replaced with new trees. If this is unacceptable to you, the DWQ will accept payment into the Riparian Buffer Restoration Fund to compensate for 787.5 square feet of required buffer mitigation in place of planting these trees. In accordance with the Board's i-ules of procedure your variance will expire if a building permit or certificate of occupancy for such use is not obtained within six (6) months of the date of decision. 'Under the rules, you cannot come back to the Board on the same request for a year. So, it is very important to get your building permit or certificate of occupancy within this time. This approval is contingent upon the payment of any applicable facility fees and the approval of a site plan or plot plan, if required. Therefore, if this project requires site plan approval, you should immediately file an application with the Planning Department 'located on the 4th floor of this building. Building permits are obtained in the Permit Office, on the 4th floor of this building. A-117-01-11/13/01 DECISION: Approved WHEREAS, Lambeth Drive Associates, LLC, property owner, (Matt & Teresa Walton, buyers), appeal for a variance of 11.6' in the front yard setback requirements per Code Section 10-2075 to construct a house in the Residential-4 zoning district at 0 Windsor Place. Zoning Inspector Strickland indicated this property is located at the end of Windsor Place noting Mr. and Mrs. Walton would like to purchase the lot and build their home. He explained although the lot is over 20,000-square feet there is a creek and sewer easement that runs through the site. The Residential-4 district has a 30-foot front setback requirement. The house is proposed to be 18.4 feet from the right-of-way of Windsor Place and it appears the house could 6e moved farther into the lot reducing the amount to the variance. Mr. Strickland indicated the lot contains a ripari an buffer that may affect the site. ApUlicant• Matt Walton (sworn), P. O. Box 19483, Raleigh, indicated they want to build a 2,000 square foot house on the lot and at first planning they felt they carne up with a plan pleasing to the neighborhood and the area. He explained they talked to the City of Raleigh in reviewing their plans and were told they need to talk to Mr. Mitchell with NCDENR regarding the 50-foot riparian buffer. Mr. Walton indicated Mr. Mitchell told him the City would be willing to work with the property owner in maintaining a 30-foot distance from the buffer. Mr. Walton referred to the submitted survey pointing out due to the location of the riparian buffer the house has been moved to the left as far as possible. He feels their plans would not be a detriment to anyone in the area. Mrs. Phelps questioned the applicant if they currently own the property with Mr. Walton indicating not as of yet. He noted they looked at the lot several years ago and at that time part of the lot was needed to install the sewer for the adjacent subdivision. Opposition: None. Findings of Fact: 1. Applicant seeks a variance from Raleigh City Code Section 10-2075 to erect a dwelling. 2. The Board has considered Applicant's verified application and the evidence and testimony adduced at the hearing. 3. In order to comply with Raleigh City Code Section 10-2075, Applicant would have to provide a 30-foot front yard setback. Applicant is unable to comply with Raleigh City Code Section 10-2075 because the existence of a riparian buffer prevents a house from being erected on this lot 30 feet from the front lot line. 5. The lot contains more than 20,000 square feet, but a creek and sewer easement run through the lot. 6. In order to comply with the riparian buffer, the 2,000 square foot home must be placed 18.4 feet from the front lot line. 7. Strict compliance with the provisions of the ordinance would deprive Applicant from the reasonable use of the property. f 8. Applicant's hardship is related to the unique circumstances of the property, namely the existence of the easements and buffer on the lot. 9. The Applicant's actions did not create the hardship or the practical difficulties. 10. The character of surrounding properties would not be adversely affected by the granting of the variance. 11. Denial of the variance would result in insignificant public benefit but would greatly harm Applicant. 12. Pursuant to Raleigh City Code Section 10-2141(b), the Board has considered the following relevant factors: a) The character and use of buildings and structures adjoining or in the vicinity of the property mentioned in the application. b) The number of persons residing, studying, working in or otherwise occupying buildings adjoining or in the vicinity of the property mentioned in the application. Conclusions of Law: 1. There are practical difficulties or unnecessary hardships in complying with the strict letter of the ordinance. 2. The variance is in accordance with the general purpose and intent of the ordinance and preserves its spirit. 3.
