shall not be construed as an approval of the dam design for Dam Safety purposes.

APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. and Mrs. Lennon:
You have our approval, in accordance with the attached conditions. to place fill in 35 linear feet of an unnamed tributary
to Reedy Branch in order to construct a road crossing to the Ball Parkk Telecommunication Facility in Bladen County, as
described in your application received by the Division of Water Quality on February 7, 2002, and in additional
correspondence received March 4, 2002. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3287, which can be viewed on our web site at
http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued
by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification, as.well as the additional condition listed below:
An additional condition is that a final, written stormwater management plan shall be approved in writing by this Office
before the impacts specified in this Certification occur. The stormwater management plan must include plans and
specifications for stormwater management facilities (preferably a wet detention pond) designed to remove 85% TSS
according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Also, before any
permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and
operational, and the stormwater management plan, as approved by this Office, shall be implemented. The structural
stormwater practices as well as drainage patterns must be maintained in perpetuity. No changes to the structural
stormwater practices shall be made without written authorization from the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes.to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Stormwater Management Narrative
Project Summary
The proposed project is on approximately 5 acres located in Bladen County. The
property lies north of Ball Park Road between NC 211 Business and NC 211 Bypass,
as shown on the vicinity map, Sheet T-1, Appendix A.
The proposed development will contain a 300-foot guyed telecommunications tower
and site improvements including a 1/3-mile long access drive and a fenced compound
around the base of the tower.
Site Summary
The site is 1,700 feet from Ball Park Road and approximately 300 feet south of
NC 211. The tower compound lies in an existing agricultural field. The soils are
primarily moderate to well-drained Goldsboro sandy loam and Norfolk loamy sand.
Infiltration rates for these soils typically range from 0.6 to 20 inches per hour; depth to
water table typically ranges from 2 to 6 feet.
The site is situated on a local high point and drains into the agricultural field. There are
no major drainage features near the tower. A drainage ditch is located approximately
500 feet north of Ball Park Road.
Stormwater Management Design
Site work will begin with construction of the access road. Because the site has been
cleared and is relatively flat, no major grading work will be required. Where the drive
crosses existing ditches, concrete pipes will be installed to preserve existing drainage
patterns. A Section 404 NW permit has been issued for this crossing. To provide for
stormwater storage, shallow infiltration swales will be graded on both sides of the
access drive and around the tower. The widths of the swales vary depending on
location. Along the access drive, false sumps will be placed every 300 feet to
encourage temporary ponding. All swales have been designed to retain runoff from the
site for the first one and one-half inches of rainfall. The access drive and tower site
have been designed so excess runoff will drain into the agricultural fields.

The intent of the grassed infiltration swales is to satisfy the state requirement of 85
percent TSS removal. The proposed location of the swales will allow access by
equipment suitable for maintenance and sediment removal. Design calculations for the
swales are contained in Appendix B.

Enclosed is the additional information your office requested in your letter of
February 13, 2002, to complete the Section 401 Water Quality Certification for a Contact:
proposed gravel driveway to a telecommunication facility in Bladen County, North Martha Register
Carolina (NCDWQ Project No. 02-0189). 1 have updated the mapping and plan
drawings for the site to better facilitate identifying the intermittent stream channel.
There are no other stream channels on the property. Additionally, biologists from
ARCADIS have surveyed the site and found no wetlands associated with the Extension:
intermittent stream channel in the vicinity of the proposed driveway crossing. 189
A new figure depicting a typical section of the proposed culvert is also enclosed. As
shown on this additional figure, the culvert is designed such that the invest will be
buried one foot below the existing strearnbed to allow for aquatic life movements.

Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity snap

VI. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Avoidance is not possible since the stream runs perpendicular to the bath of the drivewav.
Providing access to the lease area from the northern property boundary is not possible due to
NCDOT controlled access off of NC 211 Bypass. Minimization measures included crossing the
stream at a 90 degree angle.

VII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Pennits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in detennining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource finctions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
