Corbett, Lot 71, Section 2, Woodland Bay, Gaston County The applicant is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The permit application indicates that the project will stabilize 125 linear feet of shoreline on Lake Wylie. Riprap will be used instead of a wall structure. After consultations with a Duke Power Company Lake Management official, we will not object to the project. Please be advised that this office prefers a more "natural" approach to shoreline stabilization. A combination of riprap used to two feet above normal pool elevation with banks sloped back and vegetated with grass, willows or other acceptable vegetation create a more "natural" bank. A filter fabric is recommended to prevent soil from eroding from behind the riprap during high water and/or wave action. Riprap should be imbedded 18 inches into the lake bottom to prevent undercutting. Any applicable buffer regulations should be followed. Here are my comments. 020179 - Deck shown in sketch must be water dependent in order to be constructed within the specified water supply watershed setback (buffer requirement). From the sketch it is difficult to determine whether the deck is within the minimum setback. The sketch indicates a deck at 100 sf. A deck is not a water dependent structure by definition, therefore we ask that the deck be placed outside of the minimum water supply watershed setback as defined in the local ordinance for the lake. If the deck serves as access to the walkway, we request that the deck be sized to no larger than needed to provide this accessibility, and the deck must remain uncovered. 020157 - No comment 020168 - No comment - Lake James is not a WS Watershed, however, the county has established ordinances to better protect the lake. The 8' foot pathway is larger than would be allowed in WS watersheds, and the applicant should check with the local government to determine if the pathway plans are consistent with local ordinances. 011492 - Please notify us when final plans come in. 020129 - Road crossings do not appear to have been avoided or minimized. These are public roads, I presume, therefore they should reduce all avoidable impacts to the buffer areas and stream features. In addition, the NC DOT allows for road widths to be reduced when the TND road guidelines are utilized. If the roads have not been designed using these standards, then the applicant should consider utilizing these guidelines to help reduce stream crossing impacts. Additionally, I am interested in whether bottomless culverts could be utilized on the stream crossing to minimized disturbance of channels. (See Designing Highway Culverts That Do Not Impede the Movements of Resident Fish Species http://www.usroads.com/journals/p/rej/9711/re971102.htm for more information.) 020221 - No comment - I guess now is the time to dredge, although he may need to dredge deeper, as it looks like it will be a dry summer. 020222 - The site doesn't appear to have a stabilzation need, therefore we question whether a stabilization of the stream (lake) bank is necessary. We recommend, as this shoreline illustrates a very gradual slope utilizing a lower impact stabilization technique, perhaps incorporating a sandy beach style shoreline, as opposed to the harder structure "seawall with backfill" as proposed. In addition, the pictures attached to the application indicate that gravel (rock) has been deposited within the water supply watershed protection buffer setback zone associated with Lake Norman. The rules state that no new impervious surfaces are allowed within this zone, and specifically mentions gravel being an impervious surface. The material illustrated in the pictures should be relocated outside of the minimum water supply setback zone so as to be consistent with the state rules regarding water supply watershed protection. 020240 and 020232 - DOT project (and DOT projects in general. The roads appear to be wider than is necessary. The DOT should explore the use of their own TND Road Guidelines to determine if the reduction in street width proposed in the TND guideline manual could be utilized in these locations. Reducing I of 2 2/25/02 1:02 PM 401sIor February r impervious surfaces is a goal of the wager supply watershed protection program and in all the DOT project submitted for review, there appear to be opportunities for reducing the water quality impacts associated with roads that are too wide and have more covered surfaces than is necessary. Corbett Gaston County 913 Kirkcaldy Yard Gastonia, NC, 28054 APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules with Additional Conditions Dear Mr. Corbett: You have our approval, in accordance with the attached conditions, to place fill in 0.015 acre of waters and to clear six trees within the Catawba Buffer in order to stabilize the shoreline and construct a deck with boat dock on your property on Lake Wylie in Iredell County, as you described in your application received by the Division of Water Quality on February 5, 2002. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. This approval Is also valid for the Catawba River Mainstem and Lake Buffer Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. This project is for the installation of a rip-rap bulkhead to prevent further erosion of the property due to wave action. The use of mechanical equipment on the beach must be minimized; 2. Equipment and materials may be offloaded to the beach at the bulkhead site, but steps must be taken to keep all equipment out of the reservoir. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
