The purpose of this letter is to notify you that the North Carolina Wetlands
Restoration Program (NCWRP) will accept payment for riparian buffer impacts
associated with the subject project. Please note that the decision by the NCWRP
to accept the riparian buffer mitigation requirements of this project does not assure
that this payment will be approved by the N.C. Division of Water Quality
Wetlands/401 Unit. It is the responsibility of the applicant to contact this agency to
determine if payment to the NCWRP for impacts associated with this project is
appropriate. In some cases, on-site mitigation may be required so that payment to
the NCWRP is not an option.
This acceptance is valid for six months from the date of this letter. If we
have not received a copy of the issued Authorization Certificate within this time
frame, this acceptance will expire.
Based on the information supplied by you, the riparian buffer restoration
that is necessary to satisfy the compensatory mitigation requirements for this
project is 2,751 square feet. This riparian buffer mitigation will be performed in
accordance with 15A NCAC 0213.0242, 02B.0244 and 2B.0260.

APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Neuse River Buffer
Protection Rules (15A NCAC 2B.0233) with ADDITIONAL CONDITIONS
Dear Ms. Wedding:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.32 acres of
wetlands and 1,723 square feet of riparian buffers to construct the proposed road as described within your application
dated February 1, 2002. After reviewing your application, we have determined that this fill is covered by the Division of
Water Quality (DWQ) General Water Quality Certification Number 3375. This Certification allows you to use
Nationwide Permit No. 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your
approved Authorization Certificate for impacts to the protected Neuse riparian buffers as required under 15A NCAC 2B
.0233(8). In addition, you should get or otherwise comply with any other federal, state or local requirements before you
go ahead with your project including (but not limited to) Erosion and Sediment Control Permit. Also, this approval will
expire when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible
for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland,
compensatory wetland mitigation may be required as described in 15A NCAC 2H.0506 (h). Impacts approved for this
project will be added to any impacts approved for its associated residential development proposed to be located on
the adjacent Carol Peed Dupree Property when determining notification and mitigation thresholds. For this
approval to be valid, you must follow the conditions listed in the DWQ General Certification No. 3375 and any additional
conditions listed below.
Conditions:
1. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will
not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). No direct
discharge of stormwater through the buffer is allowed.
2. You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to
compensate for impacts to the protected riparian buffers is 2,751 square feet as required under this Authorization
Certificate and 15A NCAC 2B .0233 and .0242. We understand that you wish to make a payment into the Riparian
Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation

Pre-Construction Notification (PCN) Application Form

For Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401
General Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules
This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE)
Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or
Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's
(DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any
project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water
Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401
Water Quality Certification. The USACE Individual Permit application form is available online at
htty://www. saw. usace. army.mil/wetlands/Penn app htm.
The USACE is the lead regulatory agency. To review the requirements for the use of Nationwide,
Regional or General permits, and to determine which permit applies to your project, please go to the
USACE website at hLtp://www.saw.usace.army.mil/wetlands/re-gtour.htm or contact one of the field
offices listed at the end of this application. The website also lists the responsible project manager for
each county in North Carolina and provides additional information regarding the identification and
regulation of wetlands and waters of the U.S.
The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant
which 401 Certification will apply until the 404 Permit type has been determined by the USACE.
Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at
http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality
Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The
applicant is also advised to read the full text of the General Certification (GC) matching the specific 404
Permit requested. In some cases, written approval for some General Certifications is not required,
provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet
should contact DWQ's Central Office in Raleigh at (919) 733-1786.
Trout Watm Conrch a-tion_ - Special .coordination with the North Carolina Wildlife Resources
Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-Five
counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC
)regional coordinator (listed by county on the last page of this application).

CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on
the last page of this application) the applicant should also contact the North Carolina Division of Coastal
Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a
designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency.
In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate
the 404/401 Permits.
USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms,
photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this
application). Upon receipt of an application, the USACE will determine if the application is complete as
soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant
to address information needs for all USACE Nationwide, Regional or General permits, as well as
information required for State authorizations, certifications, and coordination. Fully providing the
information requested on this form will result in a complete application for any of the USACE
Nationwide, Regional or General permits. To review the minimum amount of information that must be
provided for a complete PCN for each USACE Nationwide permit, see Condition 13, 65 Fed.Reg. 12893
(March 9, 2000), available at httv://www.saw.usace.army.mil/wetlands/nnfinalFedRegpdf.
Processing times vary by permit and begin once the application has been determined to be complete.
Please contact the appropriate regulatory field office for specific answers to permit processing periods.
401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated
as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE
Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center,
Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401
Certification, then a non-refundable application fee is required. In brief, if project impacts include less
than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to
streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is
required. A check made out to the North Carolina Division of Water Quality, with the specific name of

VIIL Mitigation

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

Impact Justification
Wedding Tract Subdivision Entrance
Background Information
Ms. Carol P. Dupree Walls owns a 129 acre tract of land off of Mt Pleasant Road (SR 1533) in
Pleasant Grove Township, Johnston County, North Carolina. The Walls property is landlocked
with no road frontage. The property is currently accessed by an easement across an adjacent
property. Ms. Walls is preparing to sell her land for development of a residential subdivision.
However, a residential subdivision cannot be constructed without a permanent access.
Ms. Elizabeth Wedding owns property between the Walls property and the State Road. Ms.
Wedding has agreed to sell Ms. Walls a'/2 acre tract of land along the western most property line
of her land, to provide access to the Walls property. Both parties have executed a contract for
purchase/sell of the %z acre tract. The contract is contingent upon obtaining approval for an
access road. A copy of the boundary survey of the 1/2 acre tract is attached. The boundary is also
shown on the site plan.
Alternatives
There are no other feasible alternatives to the proposed location. The 1/2 acre tract along the
western property line is the only land that Ms. Wedding is willing to sell. The existing access
easement across the Wedding property is not allowable as a subdivision entrance. The other
property owners between the Walls property and the state road have been approached, and are
either not willing to sell their property, or their cost is prohibitive.
The proposed access location is logistically the best location because it lines up with an existing
subdivision entrance on the south side of SR 1533, and provides the best site distance at the
intersection.
Minimization
The impacts to the wetlands have been minimized to the extent possible by keeping the fill
height and width as low as possible. The fill height has been reduced by using two small
culverts instead of one large culvert, and by using only enough fill over the culverts to prevent
damage from truck traffic. Reducing the height of the fill reduces the width of the fill needed.
The width of fill has been further reduced by using 2:1 fill slopes instead of 3:1 slopes. No
roadside ditch will be constructed on the downstream side of the fill to minimize the disturbed
wetland area. Runoff will be allowed to sheet flow away from the fill area.

APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules
Dear Ms. Wedding:
You have our approval, in accordance with the attached conditions, to place fill in 0.32 acre of wetlands and 1,823 square feet of
Neuse Buffers in order to construct the Wedding Tract subdivision in Johnston County, as you described in your application received by
the Division of Water Quality on February 4, 2002, and in additional correspondence received February 25 and March 19, 2002. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3375, which can be
viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 14 when
the Corps of Engineers issues it. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner
must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed
below:
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within
50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of
the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at
http://h2o.enr.state.nc.us/ncwetlands ;
2. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected stream
buffers.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

This letter is in response to your comments dated February 13, 2002, regarding a request for a
401 Water Quality Certification for the subject project. The tollowing responses correspond to
your comments:
-The wetland area is indicated on the project plat. We have back shaded the wetland area
to clearly show the proposed impact area. A copy of the revised plan is attached.
-There is one stream located near the proposed project. It begins as a seep just to the
west of the proposed street, and then flows in a northwesterly direction away from the
project. The proposed street will not directly impact the stream, however, a portion of the
riparian butter for this stream will be impacted. The location of the stream origin was
field verified by Mr. Steve Mitchell of DWQ on.lanuar_v 24, 2002, and is shown on the

-The subdivision has not yet been designed. Our intention is to obtain tile necessary
permits for the entrance prior to proceeding with the full design of the subdivision. Once
we begin design of the subdivision, we will delineate all wetland areas and riparian
streams that exist on the development, and either avoid these areas, or obtain state and
federal permits necessary for construction.
-A portion ofUSGS Quad "Edmondson" is attached with the proposed project site
indicated.
-Prior to construction of the subdivision, we are required b_v the County of.lohnston to
prepare a stormwater management plan and obtain their approval for a stormwater
permit. The overall impervious area for the entrance portion of the subdivision will be
included in the nitrogen loading calculations for the entire subdivision. "file rip-rap outlet
protection at the west end of the proposed culvert is designed to diffuse the stormwater
before entering the butter area. There is no defined channel at the culvert outlet, and the
outlet protection is designed to spread the flow over a wide area.

-As previously stated, the impervious area for the entrance will be included in the
nitrogen loading calculations for the entire development when the stormwater
management plan is prepared and submitted to Johnston County. Any required nitrogen
offset payment will be paid to the Wetland Restoration Fund at that time. The
stormwater management plan will be prepared once we begin design of the subdivision.
We plan to begin design of the subdivision after we obtain the permit(s) to cross the
wetland area for the entrance. If necessary, you can make the 401 Water Quality
Certification conditional upon obtaining a stormwater permit from the County.
i hope these responses are satisfactory. We received a copy of the Corps of Engineers (general
Permit Regional and Nationwide Verification for this project the same day that we received your
comments. Should you have any question, or require additional information, please do not

Dear Mr. Dorney,
This letter is in response to your letter dated march 8, 2002, regarding a proposed wetland crossing on
the property of Ms. Elizabeth Wedding, in Johnston County. In an attempt to obtain agency approval on the
first submittal, we minimized the impacts to the wetlands and buffer during initial design to the extent possible.
The design includes 2:1 side slopes instead of 3:1 slopes to make the fill area as narrow as possible and remain
mowable, and the height of the till has been minimized by using two small storm drainage pipes instead of one
large pipe. Due to the narrow width of the property, we are unable to shift the proposed construction away from
the buffer. We therefore submit that there is no practical alternative to the design shown.
No mitigation plan was originally submitted because the proposed improvements are indicated as
"Allowable" according to the Table of Uses under 15A NCAC 0213.0233. The proposed road crossing impacts
less than 150 linear feet, and less than one-third acre of riparian buffer. It is not clear why mitigation is required
for this project when road crossings that disturb significantly more length and area are allowable with no
mitigation, especially considering that the impacted buffer length is 100 feet and the impacted buffer area on
this project is 0.037 acres. The rules allow up to 8 times more impacted area without mitigation than this
project causes.
In view of the small area impacted by this project, it is difficult to understand why your staff has
determined that significant uses would be removed or degraded by this project. All of the impacted areas will
be revegetated with grass, except approximately 300 square feet. The pipe outlet protection will be used as a
BMP to diffuse the flow over a wide area as it enters the buffer.
We respectfully request that you reconsider the buffer mitigation requirement and approve the project as
submitted with no mitigation requirement. If you determine that mitigation is still required, please let us know
as soon as possible so that we may proceed to the next step.

Steve and Debbie - This project was mailed to you on 2/28/02 as Issued
from triage. That is a mistake - we meant to forward it to you as a
"RRO review" project. It needs review for avoidance of buffer and
wetland impacts. They claim they have to cross only at this location,
but Bob and I have looked at it, and it looks like with some slight
shifts of the road, the buffer impacts could be reduced. Their current
design would need mitigation for the Zone 2 impacts. Bob said if they
shift the road to have just the cleared area in zone 2, mitigation
wouldn't be necessary.
We think you've already done a site visit based on the applicant's cover
letter, so hopefully this will just be a paper review in the office at
this point.

On February 4, 2002, the NC Division of Water Quality (DWQ) received your application for a 401 Water
Quality Certification to construct a road crossing at the proposed Wedding Tract subdivision in Johnston County.
Insufficient information has been provided in order for us to complete our review. Specifically, please provide the
following materials so that we can complete our review of your application:
• Please provide a plat clearly illustrating the proposed wetland impact area;
• You have indicated that streams are present on this property but they are not shown on your plans.
Please illustrate all intermittent and perennial streams on your site plan;
• Please provide a site plan for the entire subdivision, not just the entrance road, with all streams,
wetlands and Neuse Buffers clearly illustrated;
• You may find it hblpful to illustrate the impacts to Waters of the State on a USGS Topo Map or Johnston
County Soil Survey. We strongly suggest that you use these resources to discuss any proposed impact
s to Neuse Buffers;
• Please discuss how you intend to treat stormwater on this site. Have you planned to direct strormwater
through the protected Neuse Buffers using diffuse flow?
• Please quantify the total proposed impervious are for this project. You should note that this will have a
direct bearing on your stormwater plan.
Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of
Engineers place this project on hold. Also, this project will be placed on hold for our processing due to
incomplete information (15A NCAC 2H .0507(h)).
