APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules with Additional Conditions
Dear Mr. Wilson:
You have our approval, in accordance with the attached conditions, to place fill in 0.04 acre of waters in order to stabilize the
shoreline on your property on Lake Wylie in Mecklenburg County, as you described in your application received by the Division of Water
Quality on February 4, 2002, and in additional correspondence provided to the Mooresville Regional Office on March 22, 2002. After ,
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3373, which can be
viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number
198200030 when the Corps of Engineers issues it. This approval is also valid for the Catawba River Mainstem and Lake Buffer
Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner
must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed
below:
1. This project is for the installation of a rip-rap bulkhead to prevent further erosion of the property due to wave action. The use of
mechanical equipment on the beach must be minimized;
2. Equipment and materials may be offloaded to the beach at the bulkhead site, but steps must be taken to keep all equipment out of
the reservoir;
3. With respect to the buffer impacts which already occurred on this site, Zone 1 of the riparian buffer shall be restored as soon as
possible after the bulkhead wall is complete. The restoration area shall be planted and maintained with at least two species of native
trees and shrubs at a rate of 320 trees per acre and are to be replanted within the next growing season following construction of the
project. Upon completion of this restoration work, the attached Certificate of Completion form must be provided to the DWQ Central
Office in Raleigh and to Mr. Mike Parker in the DWQ Mooresville Regional Office (919 North Main St., Mooresville, NC, 28115);
4. No additional trees greater than 6 inches diameter at the stump may be removed except for those directly within the construction
corridor. Trees may not be removed simply to fill washed-out areas. If trees are removed within the construction corridor, forested
vegetation shall be re-established within the construction access or other temporary impact area occurring in the protected buffer
zone within the next growing season following construction of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

The two projects that you have listed for the MRO (McCall and Wilson in Meck. Co
have been put on hold. NOVs were sent out on both projects (John Dorney was
copied) due to Catawba Buffer violations that were found. We have met with Mr.
McCall and he is supposed to be providing a restoration plan for the shoreline
impacts he did. As soon as we received acceptable mitigaiton plans for both
projects, we will proceed with processing the 401s.

Dear Mr. Dorney,
Enclosed is an application for 401 Water Quality Certification for Hubert Ray Wilson, Jr. Mr.
Wilson proposes to place rip rap along approximately 340' of shoreline to aid in erosion
control. The property presently has no existing structures (neither homesite nor dock).
There are a few pine trees along the shoreline that will have to be removed and Mr. Wilson
intends to replace those trees according to the Mecklenburg County restoration plan. Trees
are all from 2" to 8" in diameter and will be cleared only as far back as is necessary to place
rip rap (approximately 3' back from shoreline). Rip rap will be approximately 6' high, with 5'
below full pond level and 1' above. Total square footage of proposed rip rap will be 2040.

The applicant is requesting 401 Water Quality Certification from the North Carolina
Division of Water Quality. The NCWRC has reviewed information provided by the applicant,
and field biologists on our staff are familiar with habitat values of the project area. These
comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C.
466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d).
The permit application indicates that the projects will provide stabilization activities
along the shoreline of Lake Wylie for lots 146 and 147. Based on our review of the project, we
will not object the projects. However, this office prefers the use of a more "natural" approach to
shoreline stabilization. A combination of riprap used to two feet above normal pool elevation
with banks sloped back and vegetated with grass, willows or other acceptable vegetation create a
more "natural" bank. A filter fabric must be used in order to prevent soil from eroding from
behind the riprap during high water and/or wave action. Riprap should be imbedded 18 inches
into the lake bottom to prevent undercutting. We also recommend minimum 50-foot naturalized
buffers along shorelines for water quality and habitat benefits.
