This approval allows you to: 1). Perform maintenance dredging in four man-made canals off Jinks Creek for approximately 4.7 acres of impacts; 2). Pump the dredged material to a spoil island in the Intracoastal Waterway on a CAMA approved site. This approval is only valid for the purpose and design that you described in your CAMA application dated January 30, 2002 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3274 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying 404 or CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated January 30, 2002. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below. 1). Turbidity controls must be maintained during the dredging of the material so that turbidity does not exceed 25 NTUs outside the project area (i.e. turbidity curtains). PROJECT SUMMARY: The Town of Sunset Beach is applying for authorization to perform maintenance dredging within a man-made canal system and an entrance channel off of Jinks Creek. TOWN OF SUNSET BEACH Page 2 9. PROJECT DESCRIPTION The Town of Sunset Beach is applying for a Major CAMA Permit to perform maintenance dredging on four man-made canals and an entrance channel off of Jinks Creek on the island of Sunset Beach. Sunset Beach is located on a barrier island in Brunswick County near the North Carolina/South Carolina state line. The island can be reached by Highway 179, also known as Sunset Boulevard. Once across the bridge and on the island, the canals are on the east side of the bridge, sound side of the island. Major CAMA Permit #211-85 was issued on 12/11/85 for maintenance dredging of the same areas now under review in this application. The 1985 application states that the original permit was issued in 1972. I presume that the 1972 permit covered digging the canals originally and was issued by the U.S. Army Corps of Engineers. Currently during low tide there is little to no water in the canals and very little in the entrance channel, leaving no navigation potential except during high tide. The canals are shoaled by sediments with a high sand content. However, due to the sand being mixed with other types of sediments in an uneven distribution pattern, beach placement of the dredge material was not economically feasible. The man-made canals border narrow residential lots heavily developed with single-family residences. The shorelines along the finger canals are almost all stabilized with bulkhead structures. The canals are lined with piers and docks. Some lots have marsh fringes between the bulkhead and the open water. No disturbance of the marsh fringes is proposed. The main channel is mostly natural shoreline with a marsh fringe. Equipment utilized to perform the dredging will be a hydraulic dredge, with the spoil material pumped to an existing spoil disposal island on the Atlantic Intracoastal Waterway. Because of the long distance between the canals and spoil disposal area, much piping and possibly a booster pump will have to be utilized. At least two navigable creeks between the canal system and the spoil disposal island will be crossed with the pipes. See sheet #1 of the plans for a depiction of the route. The spoil disposal area that the Town proposes to use is an existing Corps of Engineers' spoil island, CDF 308, located on the Atlantic Intracoastal Waterway across from Pelican Point Marina. The spoil island has recently been maintained and is in good condition. The island is roughly 4700' long by 450' wide. The project engineer estimates that the island has an existing storage capacity of 391,779 cubic yards. The amount of material to be dredged under this proposal is 38,164 cubic yards. The Town has obtained permission from the owner of the spoil island and from the Corps of Engineers to use the spoil island for this project. A plan view of the spoil island and typical dike cross sections are shown on Sheet 32 of 32 of the plans. The applicant is proposing to dredge a channel approximately 30' wide by 4' to 5' deep down the center of the canals and out to the deeper water of Jinks Creek. The narrowest channel area is Cross Section "C" coming out of Canal A into the main channel. This area has a Snartina alterniflora marsh border that extends into the canal 'from both sides. The dredging in this area will be approximately 20' wide in order to maintain a separation between the dredging and the marsh. The widest portion of the proposed work will occur at the confluence of main channel and Jinks Creek. Approximately 70 linear feet of Jinks Creek is proposed for dredging at the confluence of the channel and the Creek. CAMA rules prohibits dredging deeper than the connecting waters. Therefore, the existing water depths in Jinks Creek set the standard for the proposed dredge depth. Typical cross-sections of the proposed work are shown on pages 9 through 19 of the plans. TOWN OF SUNSET BEACH Page 3 The waters within the canals have been classified as SA by the Division of Water Quality. The canal system is not a primary nursery area and is closed to the taking of shellfish. The waters of the Atlantic Intracoastal Waterway adjacent to the proposed spoil disposal area are classified as SA by Water Quality and are not a primary nursery area but are conditionally open to the harvesting of shellfish. 10. ANTICIPATED IMPACTS The proposed maintenance dredging would result in the disturbance of approximately 206,550 square feet of shallow bottom (4.7 acres). Some amount of temporary turbidity may result. Fauna within the bottom substraight will be adversely affected by the proposed work. If the proposed work is completed in the winter season during a period of lower biological activity, no other long-term adverse impacts are expected. No coastal or federal wetlands are to be excavated or filled as a result of this project. Navigation potential will drastically improve as a result of the dredging. Approximately 38 acres of high ground within an existing disposal island will be filled for the spoil disposal. A temporary shellfish closure within the Atlantic Intracoastal Waterway at the spoil disposal island may result because of the effluent water from the dredging being ultimately released into the Waterway. Janet M. Russell / January 28, 2001 / Wilmington ? w SUNSET BEACH CANAL MAINTENANCE DREDGING PROJECT NARRATIVE Sunset Beach is located on the southeastern coast of North Carolina. The island contains a system of canals that were originally excavated under a permit issued in 1972. The canal system consists of a main canal off of Jinks Creek that runs east to west behind the island through the marsh. Four dead end canals run north to south into the island at the western end of the main canal (see attached drawings). A permit to perform maintenance dredging on the canals was issued in December of 1985. 401 Water Quality Certification was issued in February of 1988, and the work was performed in the spring of that year. Over the past decade, the canals have experienced a significant amount of siltation and are difficult to navigate at low tide. Consistent with the previous permit, we are proposing to perform maintenance dredging of 38,164 cubic yards in the canals to restore them to a safe and usable depth. We are proposing to dispose of the material in CDF308, a Corps of Engineers permanent disposal basin located on the Intracoastal Waterway immediately north of the Sunset Beach Bridge. In a November 1999 meeting with Wilmington District Corps personnel stated that this basin was available for use, provided that authorization was granted by the owner and a chemical and grain size analysis was conducted. In August of 2001, a chemical and grain size analysis was conducted. In October of 2001, The Wilmington District Corps of Engineers granted Sunset Beach the use of CDF308 for disposal. When this work is complete, the basin will have a capacity of approximately 353,615 cubic yards. An extensive sediment analysis was performed on the canals to determine if any of the accreted material was suitable for beach renourishment. Dredged material with a sand content of greater than 90% is generally allowed to be deposited on the beach. The results of the analysis indicated that, while a significant amount of the material in the canals has a high sand content, the distribution of that material throughout the canals is very uneven. In order to place any of the suitable sandy material on the beach, numerous mobilizations and demobilizations would be required of the dredging contractor. Because this is highly cost prohibitive, we propose to deposit all of the dredged material in the previously mentioned disposal basin. Having reviewed the sediment distributions, both Corps and DCM personnel have agreed that this disposal scenario is the most logical. Included with the permit application, we have attached written permission from the Corps and the land owner to use the basin (CDF308), agent authorization, an area map, as well as dredging volume calculations. The most concentrated area of marsh is located at Station 9+00 in the Main Channel. This width of the wetted area is 45 feet and it is the narrowest part of the entire man-made canal system with respect to overgrown wetlands. At this location, we arc dredging a total width of 20 feet, leaving approximately 12-'/z feet side to the edge of the marsh. All other areas where marsh is located have greater distances between them and are an acceptable distance away from the dredge line.
