Davidsoni RECEIVED JUN 03 2019 Notice of Violation and Notice of Intent to Assess Civil Penalty Tracking #: NOV-2019-DV-0230 Marion Collection System Permit No. WQCS00075 McDowell County I am writing in response to, your letter dated May 22, 2019and received by the City of Marion on May 24, 2019, requesting, within 15 business days of the receipt of the letter, an explanation of a violation that occurred within the City of Marion's wastewater collection system. The violation (incident number 201900850) was a sanitary sewer overflow (SSO) of approximately 3,400 gallons to surface water that occurred on April 29, 2019. In response to the Notice of Violation, the SSO was caused by the failure (horizontal crack) of a PVC force main pipe located at 214 Virginia Drive, along the bank of an unnamed tributary to Lake James. The Public Works Department was notified of the SSO on April 29, 2019 at 8:37 A.M. and responded immediately. City personnel turned off the pumps at the Clinchfreld Lift Station at 9:14 A.M., thereby stopping the SSO. The force main was repaired by replacing a 46 inch section of PVC pipe with DIP. As shown above, City personnel took remedial action very quickly with regard to the referenced SSO. They repaired the broken pipe in a short amount of time, with minimal wastewater discharge to the tributary water body. In addition, a visual inspection of the referenced force main alignment and creek bank is performed every day because of the close proximity of the line to the creek. The visual inspection is;performed simultaneously with the daily check:o# Clinchfield.Lift Station,and is just, one example, of how the. City is proactive with regard to preventing SSO's and works hard to ensure that repeat SSO's do not occur. Therefore, the City respectfully requests that a civil penalty not be issued for the violation, in order to allow the City to continue investing funds in proactive collection system maintenance and SSO prevention.
