Following our correspondence dated February 5, 2020, Mooresville Regional Office staff discovered errors on two (2) of
the cases listed in the original table (highlighted below in yellow). These errors have been corrected and new documents
prepared for your records. Our research also yielded two (2) unpaid prior civil penalty cases for collection system permit
WQCS00016 (DV-2018-0077 and DV-2019-0049). These two (2) cases have been added to the table ( ighlighted in gr]W.

The Division has received your payment in the amount of $1,422.63. Due to the changes noted in the table
above, the revised amount due is $1,679.33. Accordingly, a balance of $256.70 remains. As we discussed with
City of Albemarle staff on multiple occasions, my recommendation to the Division Director's office will be to hold
the entire Civil Penalty Amount ($54,875.00) in abeyance during the effective dates of the pending SOC with an up-
front SOC penalty of only the Enforcement Costs ($1,679.33). Upon successful completion of the pending SOC,
the entire Civil Penalty Amount ($54,875.00) will be remitted. Alternatively, should the City of Albemarle not
successfully complete the pending SOC, the entire Civil Penalty Amount ($54,875.00) will be due immediately
upon expiration.
