4h. Explain the purpose of the proposed project:*
The purpose of this project is to relocate 1540 LF of RPW/ditches, in order to facilitate the construction of a road that will provide access to a +/- 35,000 SF grocery store, with 14 - 20' x
70', connected shops and associated parking, on the main portion of the tract, as well as a 6,000 SF, two story building, with drive thru and parking, on OP #2, and a stormwater pond
that will service the entire development and remaining 9 out -parcels. Please see attached site plan for details.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project will entail excavating approximately 2200 LF (6600 SF/0.15 AC) of RPW/ditches and filling 1540 LF (4620 SF/0.11 AC) of RPW/Ditches. The newly created RPW/ditches will
reflect the same profile as the existing RPW/ditches (i.e. average 3' bottom width, with 2:1 side slopes). The ditches will be lined with excelsior matting once the work has been
completed. Large machinery, such as front end loaders, excavators and dump trucks will be used to complete the work. The machinery will be stored in uplands, within the project limits,
when not in use.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Due to the locations of the ditches, avoidance is not possible. Therefore, the Applicant proposes to relocate the features.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The Applicant will employ sediment and erosion control measures, prior to performing land disturbing activities. Additionally, to ensure turbid water and
sediment do not discharge into downstream receiving waters, work within the ditches will take place during dry periods.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State
2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State?
r Yes
r No
2b. If this project DOES NOT require Compensatory Mitigation, explain why:
U
Mitigation is not required for RPW/ditch impacts. However, the Applicant intends to reroute the impacted RPWs, which will result in creating 2200 LF (6600 SF/0.151 AC), an increase of
660 LF (1980 SF/0.04 AC) of RPW acreage. See site plan.
F. Stormwater Management and Diffuse Flow Plan (required by DWR) u
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules?

RE: Fifty Lakes Drive -Hwy 87 (19.96 acres)
Summary of Findings — Section 404/401 Wetland Delineation
Dear Nathan:
Per our recent phone conversation, Land Management Group (LMG) is providing the following
summary of findings pertaining to the Approved Jurisdictional Determination (JD) issued by the
Corps of Engineers (Corps) for the 19.96-acre parcel (Parcel No. 173ABOO6) located at the
intersection of Fifty Lakes Drive and George II Highway SE (aka Highway 87). This summary also
includes information regarding Section 404/401 permitting for future potential disturbances to
jurisdictional Waters of the United States.
Staff of LMG performed a wetland delineation of the property on August 17, 2016. The field
delineation of potential jurisdictional areas was performed in accordance with the Corps' three -
parameter approach (assessment of soils, hydrology, and vegetation) as outlined in the 1987Corps
of Engineers Wetland Delineation Manual and the Regional Supplement to the Corps of Engineers
Wetland Delineation Manual: Atlantic and Gulf Coastal Plain Region (Version 2.0) (November
2010). Based upon our site evaluations, LMG determined that there were no wetlands on the
property. While the site does contain hydric soils (i.e. soils developed under wet conditions), long-
term site drainage via a large ditch that transects the middle of the property from the southeast
to the northwest and a secondary (smaller) ditch on the northeast side of the property effectively
removes shallow groundwater hydrology. As a result, there were no areas on the site that met
the criterion for wetland hydrology. While no wetlands exist on the site, approximately_1,500 If
of ditches were considered to be relatively permanent waters_ (RPWs) and therefore subject to
emulation under Section 404 of the Clean Water Act (CWA). v
LMG submitted our findings to the Corps on September 6, 2016. The Corps representative (Mr.
John Policarpo) reviewed our findings on -site and provided concurrence of the LMG delineation.
A final, approved JD was subsequently issued on September 27, 2016. Please see attached
approved JD with supporting map documentation of these findings. The approved JD is valid until
September 27, 2021.
Please note that under current regulations, proposed disturbances (including, but not limited to,
piping, filling, relocating) of the jurisdictional ditched Waters of the U.S. would likely require prior

Under current policy, compensatory mitigation of impacts to jurisdictional ditched Waters of the
U.S. (i.e. non -wetlands) is typically not required. Generally, this type of NWP is relatively
straightforward to obtain rovided ade uate "ustifscativit is demonstratEd for the need of the
proposed activity._ As with any potential impacts to drainage ditches, caution would need to be
exercised to ensure the adequate site drainage is maintained for the property.
Should you have any questions or require additional information regarding the Corps' approved
JD or have any questions related to site permitting, please do not hesitate to contact me via phone
(910-452-0001) or by email (cpreziosi@lmEroup.net).
Respectfully,

1 Based upon preliminary maps and estimated lengths and widths of existing ditches/Waters of the U.S., the total
footprint of existing jurisdictional ditches is below 0.5 acres.
