Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is very flat and mostly comprised of woody and herbaceous vegetation. Approximately 1900 LF of ditches bisect the property (see attached Site Plan), of which 1500 exhibit an ordinary high water mark (OHWM). The ditches are approximately 3' wide, from toe of slope - to toe of slope, with 2:1 side slopes. Land use in the vicinity of the project is residential; however, a golf course is located north of the project area and the land across the street is zoned commercial (see attached Brunswick County Zoning Map). 4b. Explain the purpose of the proposed project:* The purpose of this project is to relocate 1540 LF of RPW/ditches, in order to facilitate the construction of a road that will provide access to a +/- 35,000 SF grocery store, with 14 - 20' x 70', connected shops and associated parking, on the main portion of the tract, as well as a 6,000 SF, two story building, with drive thru and parking, on OP #2, and a stormwater pond that will service the entire development and remaining 9 out -parcels. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The project will entail excavating approximately 2200 LF (6600 SF/0.15 AC) of RPW/ditches and filling 1540 LF (4620 SF/0.11 AC) of RPW/Ditches. The newly created RPW/ditches will reflect the same profile as the existing RPW/ditches (i.e. average 3' bottom width, with 2:1 side slopes). The ditches will be lined with excelsior matting once the work has been completed. Large machinery, such as front end loaders, excavators and dump trucks will be used to complete the work. David Scibetta worked with the USACE in 2017 to identify any nesting and foraging areas. The USFWS shows the project area completely outside of the BSL nesting and forage area partitions (see attached). The data is from 2017, but should be accurate, as SEGi does not believe there was an increase or a)pansion in the nesting areas in the vicinity. This summary also includes information regarding Section 404/401 permitting for future potential disturbances to jurisdictional Waters of the United States. Staff of LMG performed a wetland delineation of the property on August 17, 2016. The field delineation of potential jurisdictional areas was performed in accordance with the Corps' three - parameter approach (assessment of soils, hydrology, and vegetation) as outlined in the 1987Corps of Engineers Wetland Delineation Manual and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain Region (Version 2.0) (November 2010). Based upon our site evaluations, LMG determined that there were no wetlands on the property. While the site does contain hydric soils (i.e. soils developed under wet conditions), long- term site drainage via a large ditch that transects the middle of the property from the southeast to the northwest and a secondary (smaller) ditch on the northeast side of the property effectively removes shallow groundwater hydrology. As a result, there were no areas on the site that met the criterion for wetland hydrology. While no wetlands exist on the site, approximately_1,500 If �of ditches were considered to be relatively permanent waters_ (RPWs) and therefore subject to emulation under Section 404 of the Clean Water Act (CWA). �v LMG submitted our findings to the Corps on September 6, 2016. The Corps representative (Mr. John Policarpo) reviewed our findings on -site and provided concurrence of the LMG delineation. A final, approved JD was subsequently issued on September 27, 2016. Please see attached approved JD with supporting map documentation of these findings. The approved JD is valid until September 27, 2021.
