PROJECT SUMMARY: The applicant proposes to reconfigure the existing marina dockage to allow for a one-slip expansion to accommodate all 16 homeowners within Seascape condominium complex. - 9. NARRATIVE DESCRIPTION: Project Setting Seascape Condominiums are located at 121 Old Causeway Road in Atlantic Beach, Carteret County. You can access Old Causeway Road by turning west off the Atlantic Beach Causeway at the Scotchman gas station and Seascape is located just to the west of the CP&L power substation. Seascape is a residential condominium complex located on approximately 0.6 acres consisting of two (2) buildings, each accommodating eight (8) units. The complex tract is 3-4 feet above NWL (Normal Water Level) and is directly adjacent to a manmade canal ultimately tributary to Bogue Sound. The majority of the tract has been developed with limited areas of lawn grass amongst a parking area and several elevated decks located on high ground. Seascape went through a similar major permit process in 1990 (# 67-90) when it reconfigured its parallel docking to its current configuration of fixed finger piers providing fifteen (15) wet slips perpendicular to the channel The property is bulkheaded 185' along the manmade canal with a four (4) foot boardwalk running the same distance partially over the canal. Specifically the existing docking structure consists of eight (8) fixed finger piers spaced somewhat evenly down the face of the bulkhead. The space between finger piers is divided by mooring pilings to allow for safe wet storage of the residents vessels. The mooring pilings, which define the waterward footprint of the current configuration, are located approximately twenty (20) feet from the face of the bulkhead. The manmade canal, which appears to be unnamed, runs south to north ultimately connecting to Bogue Sound. Although classified SA-HQW, therefore suitable for commercial shellfishing and other tidal saltwater uses, the canal is closed to shellfishing. The area does not serve as a primary or secondary nursery area. The water depths within the footprint of the facility range from one (1) foot at the face of the bulkhead to eleven (11) feet at the outer tie poles taken at normal low water. The bottom substrate appears to be sand with no signs of submerged aquatic vegetation present. Project Description The project involves the reconfiguration of the existing marina facility to accommodate one additional vessel so that each resident of the complex would have dockage. The project is being reviewed under the major permit process because it will require development outside the existing footprint and increase the number of slips by one (1). The fixed finger piers are proposed to be replaced with eight (8) new floating finger piers spaced in a manner to provide sixteen (16) slips within the existing property boundary. The proposed floaters will be attached to pivoting ramps from the high ground to allow for safe access. The floating finger piers would measure sixteen (16) by four (4) feet and would extend offshore a maximum distance of twenty-three (23) feet. FIELD INVESTIGATION REPORT: SEASCAPE CONDOS / CARTERET COUNTY PAGE #3 The distance across the canal has been measured to be one hundred eight (108) feet with the quarter distance across the canal being twenty-seven (27) feet. The water depths as noted earlier drop significantly from the bulkhead to the ends of the proposed floating finger piers. The average depth at the bulkhead is two and half (2.5) feet while the average depth at the ends of the proposed floaters averages nine and half (9.5) feet at normal low water. The proposal appears to be consistent with the adjacent pier lengths within the same area. The agent has secured the fifteen (15) foot setback waivers from the adjacent riparian property owners and made them a part of this package. There is no other high ground work proposed for this tract. Anticipated Impacts The proposal will usurp 4,255 ft2 of open waters, this amount being 540 ft2 additional impact over the existing configuration. Short-term turbidity would be expected through the installation of the new pilings to hold the floaters yet long-term turbidity would not be expected based on the adequate water depth offshore along with the sandy substrate. Improved boating dockage would occur'as a result of the proposal. Brad E. These AECs encompass oceanfront, soundfront and riverfront areas, as well as some special water supply and unique geologic areas. Any activity involving construction, excavation, filling or other land disturbance within an AEC is considered development and requires authorization under CAMA. A A project is considered major development if it requires another sate or federal authorization (permit license, etc.), involves alteration of more than 20 acres of land and/or water, or involves the construction of one or more structures covering a ground area greater than 60,000 square feet within an AEC. Projects usually are considered maior development if they involve: excavation, filling or construction in public trust waters or wetlands within an AEC; or activities disturbing more than one acre of land. Such projects must be authorized by a CAMA Major Development Permit Community "C21"! as ?ell..as_the ]WIldlif.e ?IAGF Resources Commission a epgu m t of Administration and the Department of Transportation. The federal review is coordinated by the Army Corps of Engineers and involves the Environmental Protection Agency, National Marine Fisheries Service, and the Fish and Wildlife Service. r Each project also is reviewed for compliance with local regulations and for consistency with the local government's land use plan. The CAMA land use plan sea forth the community's policies regarding development and identifies land classifications where certain activities may or may not be allowed. A conservation land classification for ==ple typically is very restrictive where developed or community classifications are not. The application review process begins the date DCM receives an application that is complete. That review takes approximately 75 days; however, DCM is allowed an additional 75 days, by law, if.-more time is need-. An application also may be put on hold, and the review delayed, if more information is needed to complete the permit file. MAJOR DEVELOPMENT PERIMU The Major Development Permit process covers application for authorization needed under certain _ state and federal laws. State authorizations needed include: Coastal Area Management Act, Dredge and Fill Act; Water Quality Certification; and Easement in Public Trust Areas. Federal authorization include: Rivers and Harbors A=, (Section 10, Navigable Waters) and Clean Water Act (Section 404, Jurisdictional Wedands). The state review is coordinated by DCM and involves the divisions of Environmental ?Management, Water Resources, Land Resources, Marine Fisheries, Environmental Health, Archives and History and A permit application will be denied if the project is inconsistent with any state, federal, local regulation, or the CAMA land use plan. If the application is denied, the applicant may file for an appeal within 20 days of the decision. If the project is approved, a major development permit will be issued. Typically, the permit will list specific conditions or restrictions on the development The project must be constructed according to the permit and any changes will require modification of the permit Major development permits are valid for a period of three years and typically expire 'on December 31 of the third year. If the project is not comply within that time, the permit may be renewed at the applicant's request. Any changes in ownership of the project will require a transfer of the permit at fhe discretion of the-' Director of the DCM. THE PERMIT APPLICATION An application package for a Major Development Permit should consist of : 1) a completed application form; 2) a narrative description of the project, including its proposed use and construction methods; 3) detailed work plat(s) that have been signed and dated and that show a plan view and cross-sectional drawings; 4) a site map that shows the location and/or gives directions to the project site; S) a copy of a deed or other proof of ownership for the project site and authorization from the property owner, if applicable; 6) a stormwater management plan, sedimentation and erosion control plan, sewage treatment plan or special use permit, if applicable;, and 7) a 5250 application fee by check or money order made payable to the Noah Carolina Department of Environment, Health and Natural Resources (DEHNR). 7-his application form consists of a basic information section and specific subsections for various types of development. The basic information section should be completed by all applicants. The appropriate subsection(s) (Excavation and Fill, Upland Development, Structures, Bridges and Culverts, and Marinas) should be completed to provide information about the proposed development. All of the information in these sections should accurately correspond with the submitted work plat(s). Excavation and Fill (DCM-MP 2) information should include all dredging and excavation work or filling in public trust waters or wetlands. All excavation depths should be expressed in number of fed below the elevations of mean low water (NEW) or normal water level (NWL). Any fill in water or wetlands should also be clearly shown on the plat(s). Upland Development (DCM-MP-3) includes all land disturbing activities, such as grading, filling and construction of buildings. Critical issues to be reviewed in this section are the amount of imnervinne ernrfnr-P< within thn 1=ctn-ir;nP runoff and erosion on the project site. For oceanfront development, you should show the appropriate setbacks, any impacts to public beach access, and indicate when the property was platted. Structures (DCM-MP4) information includes all structural development in public trust waters. This includes piers, docks, boathouses, bulkheads, groins, breakwaters and mooring structures. Bridges and Culverts (DCM-M:P-5) section should include all road crossings of public trust waters or wetlands within the project area. Impacts to traditional navigation or drainage patterns will be carefully considered in the review of this type of development proposal. Marina Development (DCM-MP-Q section applies to all facilities providing dockage or mooring for more than ten boats. The area o` public trust waters impacted, the number of slips provided, and the waste-handling facilities to be provided will be carefully considered.
