Stream Bank stabilization such as rock revetments and seawalls are allowed in
the buffer zone of water supply watersheds, however, the rules state no new
development is to be placed within the 30 foot water supply watershed riparian
buffer zone. This includes non-water dependent structures such as gazebos and
covered decks. The county ordinance could be more stringent in this case.

direct means, rather water is supposed to be conveyed through the use of

APPROVAL of 401 Water Quality Certification
Dear Ms. Satterfield:
You have our approval, in accordance with the attached conditions, to place fill and dredge in 1.055 acres of Public Trust Area
and Estuarine Waters in order to construct two rock groins to stabilize the channel entrance to an existing basin, and to perform
maintenance dredging of said basin and canal adjacent to the Pamlico Sound in Dare County, as described in your application received
by the Division of Water Quality on January 15, 2002. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3274, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands .
This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA
Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application fora new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification:
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North

8. PROJECT SUMMARY: This project involves the construction of two rock groins to stabilize the
channel entrance to an existing basin adjacent to the Pamlico Sound, as well as maintenance dredging of
that basin and access channel. This project also includes the shoreline stabilization of the existing man-
made basin.

PROJECT SETTING
The project site includes two adjacent parcels with a combined area of approximately 2.1 acres,
located along the west side of NC 12 along the Pamlico Sound on Hatteras Island, Dare County in
the village of Rodanthe. The site includes a small shopping mart, approximately 0.25-acres of a
concrete/asphalt parking area, a 0.22-acre man-made basin and access channel that connects to
Pamlico Sound. The basin includes a concrete boat ramp and 30 ft. by 6 ft. courtesy access dock
adjacent to the ramp. The site also includes a small bait and utility shed located behind the store, a
small camper structure to the south of the store building and a remnant fish house located along the
shoreline of the Sound and the entrance channel. A 16 ft. by 8 ft. floating dock and seven mooring
piles are located along the north/northwest shoreline of the man-made basin. The floating dock and
mooring piles were used during the last summer season by a tenant of the applicant to launch and
moor jet skis and small wind and/or man-powered watercraft. This commercial structure is served
water by the Dare County water system and wastewater is treated by an on-site septic tank/drain-
field. Preliminary review of archaeological site data for this portion of Hatteras Island indicates no
cultural resources located within the immediate vicinity. The Chicamacomico USCG Life Saving
Station is located approximately one-half mile north of the application site.
Cathy Ballance Satterfield owns the project site and existing facility. According to the CAMA
application and attachments, several CAMA and/or NC Dredge and Fill Permits have been issued
and/or renewed in the last thirty years for maintenance dredging and other development within the
man-made basin and access channel.
According to the application and available topographic mapping, the site is approximately 8 ft.
above the NWL. The eastern portion of the property is covered with impervious surfaces (i.e.,
roof tops, concrete, asphalt, gravel) while the upland vegetated area of the two-acre site is
vegetated in salt meadow hay, goldenrod, heather, Dusty Miller, sand spur, primrose, prickly pear
and other upland grasses.
The shoreline areas that are adjacent to the Pamlico Sound are vegetated with black-needle rush
(Juncus roemerianus), salt meadow hay (Spartina patens) and cordgrass (Spartina alterniflora).
Portions of the shoreline of the man-made basin are vegetated with spot areas of black-needle
rush (Juncus roemerianus), salt meadow hay (Spartina patens) and giant cane (Phragmites spp.)
Most of the shoreline of the basin, near the NWL, is not vegetated. Portions of the basin shoreline
are experiencing approximately one ft. of erosion per year and escarpments are visible in several
locations. However, a small area along the southwestern portion of the basin, near the access
channel, is experiencing accretion to the point that a sand bar extends northward and almost blocks
the basin entrance from the Sound.

The existing man-made basin is irregular shaped, somewhat like a boot, and is connected to the
Sound by a 300 ft. long by 80 ft. wide access channel. The basin averages approximately -2 ft. in
water depth (NWL). This -2 ft. water depth contour continues in a western direction into the man-
made access channel for a distance of approximately 150 ft. off shore, where water depths
eventually reach a depth of -4 ft., 300 ft. off shore. Two piling/tire jetties are located on either
side of the entrance channel and extend approximately 125 ft. into the Sound.
As previously referenced, a 10 ft. wide concrete boat ramp is located at the southeastern side of
the basin and extends approximately 20 ft. into the basin. Also a 30 ft. long by 6 ft. wide courtesy
access dock is located directly adjacent to the north side of the boat ramp. Approximately 90 if of
the eastern side of the basin is currently stabilized with concrete and granite rip rap. A remnant
wood bulkhead is also located landward of this rock material in the same vicinity.
The shorelines of properties to the immediate north and south are not stabilized with any hardened
structures. The applicant's lot to the immediate south is vacant except for a camper with an
attached shed or but with a wooden deck. The property to the immediate north is vacant except for
some small sheds and out buildings.
The waters of the Pamlico Sound and this basin and access channel are classified as Coastal Waters
by the North Carolina Marine Fisheries and Wildlife Resources Commissions. The North Carolina
Environmental Management Commission has designated these waters as `SA' (suited for shell
fishing); however, these waters are presently closed to the commercial harvest of shellfish.
During the site investigation visits to this site, no shellfish were observed in the vicinity of this
project. Some small finfish were observed within the basin and channel waters. No SAV's were
observed in these areas.
The Coastal Resources Commission (CRC) has also designated these waters as Public Trust Area
and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the designation
of the CRC, the Coastal Shoreline AEC extends in a contour of 75 ft. landward of the Sound and
the connecting access channel and basin.
PROJECT DESCRIPTION
The applicant proposes to maintenance dredge the existing man-made basin and access channel.
This project also includes the construction of two rock groins to stabilize the channel entrance to
the basin, as well as, rip-rap rock shoreline stabilization of the basin shoreline.
The applicant estimates that the basin is 150 ft. by 140 ft. and has a present average water depth of
2 ft. The proposed channel maintenance excavation includes an estimated dimension of 300 ft. long
by 80 ft. wide and this channel has an average water depth of -2 ft. (NWL). The applicant has
calculated that the proposed excavation will remove between 2 and 2.5 ft. of dredge spoil from the

basin and access channel and will result in the removal of a total of between 3,778 and 4,345 cy of
dredge spoil material. An estimated 2,222 cy will be removed from the access channel and 1,556
cy from the basin. The 4,345 cy volume estimate allows for a 15 % error.
The applicant plans to remove the existing camper structure on her adjacent lot and utilize this area
(and possibly, a small portion of the adjacent property, owned by Mike Keller) for the construction
of a spoil retention structure. The applicant has calculated that an 8,700 sf retention structure, with
a 13 ft. high berm, will provide approximately 3,200 cy of spoil capacity. This calculation
includes a 10 ft. structure height and a 3 ft. freeboard berm height during operation. A hydraulic
dredge barge will undertake the channel excavation and the spoils will be pumped into the
retention structure. It is planned that the open water channel excavation will be undertaken during
the first phase of work. The basin dredging will be completed with a mechanical excavator at a
later date during an allowed dredging period, which will provide time for the channel dredge spoil
material to de-water and be partially removed to allow room for the additional basin dredge
material. The applicant proposes to maintenance excavate both the access channel and basin to the
connecting water depth of -4 ft., NWL. Once the dredge spoil has de-watered, the retention
structure will be removed upon the completion of the channel ands basin excavation. The applicant
also wishes to obtain a long-term authorization to maintenance dredge these waters during times
when dredging is considered less harmful to the coastal resources of the Pamlico Sound. A new
spoil retention structure will be constructed each time that maintenance excavation of the channel
and basin are undertaken.
The third phase of this project involves the removal of the existing pile and tire jetties located at
each side of the basin entrance. The existing tires will be removed and hauled to an approved
disposal site. The existing wood pilings will either be pumped out or cut off along the water
bottom. These jetties will be replaced with two rock groins. These structures will be constructed
of granite and will have a 6 ft. wide foot print. These structures will extend approximately 125 ft.
into the Pamlico Sound and will not extend more than one ft. in height above the NWL. This
groin structure height will be approximately 4 ft. above the Sound bottom.
The final phase of work for this project involves the stabilization of the entire basin shoreline with
rip-rap stone. This stone will be placed predominately along the shoreline escarpment areas, most
of which landward of the NWL. The rock structure will be approximately 8 ft. wide. The
proposed rip-rap structure will extend an average of 1 to 2 ft. beyond the NWL into the basin
waters with a 6 ft. wide portion of the structure used to stabilize the upland bank/escarpment
areas. The total structure length will be approximately 560 If. Some of the proposed rip-rap
structure alignment will cover approximately 150 sq. ft. of wetlands that are present along the
shoreline, most of which, are U.S. Army Corps of Engineers jurisdictional wetlands.

ANTICIPATED IMPACTS
The proposed project will impact Estuarine and Public Trust Area Waters and the associated water
bottoms in these areas. This project will also impact a small area of vegetative wetlands along the
Coastal Shoreline of the man-made basin.
The dredging portion of this project will impact a 300 ft by 80 ft. (24,000 sf) area of the access
channel located within the Pamlico Sound, as well as another 140 ft. by 150 ft. (21,000 sf) area of
connecting waters within the man-made basin. It is estimated that the dredging portion of this
project will generate approximately 4,000 cy of dredge spoil material. The dredging portion of
this project will be divided into two phases of work to allow the channel's dredge spoil to de-water
and be removed to provide room for the remaining basin maintenance excavation. The proposed
dredge spoil retention structure will impact approximately 11,000 sf of upland area. A small
portion of this area will be located within the Coastal Shoreline AEC, adjacent to the existing
basin. Once all the proposed dredging activity is completed, the retention structure will be
removed, and the site graded and stabilized. Future dredging activity will include the re-
construction of a new spoil retention structure.
It is estimated that the placement of two rock groins will result in the filling of 900 sf of shallow
water habitat/water bottom, however, much of this area is already impacted by the existing tire
jetties. The proposed groins will provide more substantial protection to the existing basin/channel
entrance and may reduce the overall amount of maintenance dredging required in the future. The
rock groins will also provide some habitat benefits for local coastal resources.
The placement of rock stabilization along the shoreline of the existing man-made basin will result
in the filling of approximately 8 cy of material below the NWL and within the Estuarine and
Public Trust Area waters of the Pamlico Sound. This filling activity will also result in the loss or
disturbance of approximately 150 sf of vegetative wetlands, predominately giant cane and black
needle rush. Most of the area where the giant cane is located is already partially stabilized with
concrete rip rap and a remnant bulkhead. The proposed rip rap will reduce erosion along the
existing shoreline that will, in turn, reduce the associated long-term turbidity that may occur from
shoreline erosion. The. rip rap shoreline structurewill also provide some habitat benefits to local
coastal resources, including the possible re-establishment of vegetative wetland fringes in areas
along the existing shoreline.
All of the above proposed activities will result in temporary turbidity in the adjacent waters. This
project will impact a total of 0.252 acres (11,000 sf) of upland area and 1.31 acres (57,050 sf) of
coastal waters. A Stormwater Management Permit and an Erosion Control Plan may be required
for this project by the Divisions of Water Quality and Land Quality.

Attached please find our CAMA Major Permit application for our existing basin at
the Shoreline Beach Mart location in Rodanthe, Dare County.
The purpose of this project is to restore water depths to 4' and connect to existing
deep water channel in the Pamlico Sound.
This project will also include the replacement of the existing tire and piling jetty
structures located at the basin entrance with rock groins. Pilings will be cut to grade and
all tires will be removed and transported to an acceptable site. Rock groins will be 6' wide
at the base of these groin structures and about 4' high not to exceed 1' above NWL. These
structures will extend approximately 125' into the Pamlico Sound.
Cape Dredging will dredge basin and channel and construct temporary spoil site.
The spoil site has been located such that all of the structure, with the exception of
approximately 60' of the outer berm wall, will be 30' or more from the water. It may be
possible to slightly shift this portion of the spoil berm to the south on to Mr. Keller's
property to provide a 30' buffer at this location, as well. However, the actual
arrangements for this spoil site location revision have not been officially confirmed by Mr.
Keller. The camper and storage building will be removed to make room for the
construction of the spoil retention structure. Disposal area will be removed by Cape
Dredging after sand has de-watered and project is finished.
The floating ramp for jet skis will be removed from the basin prior to project being
started. I currently lease a small portion of my property to Mike Bigney, the adjacent
property owner, on an annual basis for jet ski rentals and I do not know at this time if we
will continue this arrangement.
This proposal also includes the stabilization of the entire basin with stabilization

dredging and other related work at our site. It is also our intent to obtain long term
authorization to be able to maintain our basin and channel as necessary.

detailed description.)
Please note, that original drawings are preferred and
only high quality copies will be accepted. Blue4ine
prints or other larger plats are acceptable only if an
adequate- number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use 'of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to

valid request for certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by April 1, 2002, the District Engineer will deem
that waiver has occurred.

On July 24, 2000, we renewed General Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from
the State of North Carolina.
A review of your application received January 15, 2002, for Department of the Army (DA)
authorization to maintenance dredge an existing basin and access channel, replace existing jetties
with rock groins, and place riprap material along the shoreline, on property located off NC
Highway 12, adjacent to the Pamlico Sound, in Rodanthe, Dare County, North Carolina,
indicates it to be a candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will be furnished
