Hedrick 1424 Jerusalem Road Lexington, NC, 27292 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Hedrick: You have our approval, in accordance with the attached conditions, to excavate 0.1 acre of waters in order to improve access to your property on High Rock Lake in Davidson County, as you described in your application received by the Division of Water Quality on January 15, 2002. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280, which can be viewed on our web site at h_ttp://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1: Excavated material shall not be disposed in wetlands. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive-this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Over time, eroded soil has built up in the area of my approved pier and floating dock. The scope of the project is to remove the eroded soil, and to place the spoil material in an upland location on property that I own that adjoins High Rock Lake. The area of the proposed excavation is 10,000 square feet (40 feet by 250 feet). I propose to remove soil at a one foot depth at the southern end of the excavation area to achieve a finished elevation of Contour 647. Since the full pond elevation of High Rock Lake is Contour 655, this will provide the eight feet depth at full pond that Yadkin, Inc. requires. I will maintain a level of Contour 647 for the entire excavated area. At the northern end of the excavation area, I expect that up to three feet (in depth) of eroded material will be removed. Given the present elevations of lake bottom, I anticipate that the average depth of excavation over the entire area will be one and one-half feet. I will taper excavated area back to current lake bottom elevation outside of excavated area. I expect to remove approximately 15,000 cubic yards of eroded material. The spoil area is located in uplands on property that I own adjacent to the property to be excavated. All spoil material will be placed in upland above Contour 655, which is the full pond elevation. It is anticipated that the spoil area will be located at an elevation in excess of Contour 660. The spoil will be spread over an area approximately the same size as the excavated area at a depth of one and one-half feet. Temporary silt fencing will be installed during excavation, and it will be maintained until a permanent ground vegetation is established on the spoil area.
