This approval allows you to: SUBJECT: Approval of 401 Water Quality and Additional Conditions NC Aquarium at Pine Knoll Shores Shore Stabilization Project DWQ Project # 020016 Carteret County with the attached conditions (WQC # 3274) to conduct the property along an eroding shoreline at Atlantic Beach in 1). Construct a stone (granite) sill approximately 400 feet in length with a 10 foot average bottom width; 2). Backfill two areas of approximately 6' X 40' and 15' X 90' in size to the same height as the adjacent marsh and then plant with the appropriate vegetation; This approval is only valid for the purpose and design that you described in your CAMA application dated December 21, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3274 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated December 21, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1). When placing the sand in the two areas to bring up their elevation, do the work during the low tide cycle to limit the amount of turbidity for this project. Turbidity controls must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside the project area (i.e. Turbidity curtains). Please contact this Office at the number listed below if there are any problems with turbidity; 2). The attached Certificate of Completion (COC) must be submitted to the Division upon final construction of the site. BARRETT IN SUBJECT: MODIFICATION TO STATE PERMIT #42-00, ISSUED TO THE NC COASTAL FEDERATION AND NC SEA GRANT DATE: December 21, 2001 Please find attached a modification to the afore mentioned CAMA Major Permit. As you may recall, this permit was issued on March 22, 2000, as a blanket authorization to allow for the installation of "experimental" shoreline stabilization projects. The intent is to document the effectiveness of these methods over the traditional vertical bulkhead. A brief description of the current proposal and site characteristics follows: North Carolina Aquarium Pine Knoll Shores Carteret County Rover # L1 21216A SITE CHARACTERISTICS: Water Quality - SA-ORW Shellfish - Visible Oyster Resource PNA - No Land Use Plan Classification - Conservation This is the site of the North Carolina Aquarium at Pine Knoll Shores. The aquarium has entered into an agreement with the NC Coastal Federation to install an alternative shoreline stabilization project along the eroding marsh line at the western end of the property. The project will begin approximately 130' west of the existing pier, and will extend eastward into the embayment east of the pier. The rock will extend to approximately. 5' above the normal high water level, and will have 3 drop-down areas with 5' bottom widths approximately 1' above substrate level. The existing marsh escarpment is approximately 6". The rock will extend along the outer edge of the escarpment in some areas, and further where needed. The design has been proposed to mimic the previous marsh edge. Toward the west end there is a section of approximately 40' that will extend to 6' from the marsh, and be backfilled and planted with Spartina alterniflora and S artina patens within this ±120 sf area. Backfill material will be clean sand, and will raise the substrate elevation to the same as that in the adjacent marsh. At the location of the pier, the rock is positioned further from the existing marsh edge than is authorized under the original permit. However, the determination was made that the adjacent marsh edges should be extrapolated to establish a "marsh edge" in this area. The marsh has been obviously stressed by the impacts from pier construction and use, and consequently has been lost. The alignment of the rock in this area is conservative in extrapolating the marsh line, and extends from an average of 12' to a maximum of 28' from the high marsh escarpment. This area will also be filled with clean sand to the elevation of the adjacent marsh, and planted with low and high marsh species. The dimensions of this fill area are approximately 90' x 15'. The normal high water line in the project area is approximately 20' to 40' landward of the outer marsh edge. The substrate in this area presently is indicative of a high-energy system, with exposed roots and dead wax myrtles, ridged contours, and few oysters. The bottom composition is primarily silty sand. The SAV's in the area are waterward of the project location. The adjacent shoreline is vegetated with high marsh species, cedars, and wax myrtles. There is an existing road to the project site that will be maintained within its existing footprint to allow for the passage of heavy equipment. There is a small development associated with this proposal that lies outside the scope of the originally issued permit. An elevated, slatted canoe rack is proposed along the southwest side of the pier, with dimensions of 23'x 4'. The existing steps on the pier will be relocated. POTENTIAL IMPACTS: Direct impacts will be from the loss of bottom area in the amount of approximately 4000 square feet of rock, with another 1470 square feet of sandy fill. Potentially, there could be turbidity during the construction phase, as well as during the period between planting and such time as the vegetation has a stabilizing effect on the sediment. The SAV's in the area should not be impacted, as they are 80' and greater from the proposed sill. The canoe rack will incorporate 92 square feet of public trust area. ******* Please see the field report dated December 23, 1999, associated with permit #42-00, for additional information. During the construction and restoration phases of the project, all work will be contained by a turbidity cumin. 'l'imber mats will be used as temporary access ramps for the purpose of transporting stone to the final sill locations. The project will also include transplanting existing live oysters along a length of the marsh restoration / sill area and spreading oyster culch to enhance the oyster habitat. Each individual project component must also receive concurrence from the Division of Water Quality prior to initiation of that phase of the project. 5) In cases where the DMF determines that relocation of shellfish is appropriate within a project area, the applicant or his agent shall, in coordination with the DMF, relocate any such shellfish resources. 6) The use of tie-back connections to existing bulkheads or high ground areas will not be allowed if such structures will restrict movement of aquatic species. NOTED Project components will only receive authorization when the Department of Administration's State Property Office determines that the project will either not require an easement or that such an easement has been obtained. 7) In the event that significant archaeological resources are present within the boundaries of the proposed permit area, the permittee shall develop, in consultation with the Division of Archives and History, a cultural resources management plan for the long term management of such resources. 8) On shorelines without existing marsh grasses the centerline of breakwaters or sills be shall be positioned no more than 10 feet waterw'ard of the waterward depth contour of locally growing marsh grasses or 25 feet waterward of the mean high water or normal water level, whichever is greater. On shorelines with existing marshes the centerline of the structures shall be positioned no more than 10 feet water-ward of the waterward depth contour of locally growing marsh grasses or 10 feet waterward of the existing marsh at any point along the alignment of the structure, whichever is greater. For water bodies more narrow than 150 feet, the structures shall not be nositioned ofchore more than one sixth (1/6) the width of the waterbody. 9) If existing marsh grasses are not present on shoreline, additional grasses will be planted. The generic permit will only apply to projects that combine marshes with tow profile structures. 10) Construction authorized by this permit will be limited to a maximum length of 500 feet. N.C. The aquarium has entered into an agreement with the NC Coastal Federation to install an alternative shoreline stabilization project along the eroding marsh line at the western end of the property. The project will begin approximately 130' west of the existing pier, and will extend eastward into the embayment east of the pier. The rock will extend to approximately. 5' above the normal high water level, and will have 3 drop-down areas with 5' bottom widths approximately 1' above substrate level. The existing marsh escarpment is approximately 6". The rock will extend along the outer edge of the escarpment in some areas, and further where needed. The design has been proposed to mimic the previous marsh edge. Toward the west end there is a section of approximately 40' that will extend to 6' from the marsh, and be backfilled and planted with Spartina alterniflora and S artina patens within this ±120 sf area. Backfill material will be clean sand, and will raise the substrate elevation to the same as that in the adjacent marsh. At the location of the pier, the rock is positioned further from the existing marsh edge than is authorized under the original permit. However, the determination was made that the adjacent marsh edges should be extrapolated to establish a "marsh edge" in this area. The marsh has been obviously stressed by the impacts from pier construction and use, and consequently has been lost. The alignment of the rock in this area is conservative in extrapolating the marsh line, and extends from an average of 12' to a maximum of 28' from the high marsh escarpment. This area will also be filled with clean sand to the elevation of the adjacent marsh, and planted with low and high marsh species. The dimensions of this fill area are approximately 90' x 15'. The normal high water line in the project area is approximately 20' to 40' landward of the outer marsh edge. The substrate in this area presently is indicative of a high-energy system, with exposed roots and dead wax myrtles, ridged contours, qnd few oysters. The bottom composition is primarily silty sand. The SAV's in the area are waterward of the project location. The adjacent shoreline is vegetated with high marsh species, cedars, and wax myrtles. There is an existing road to the project site that will be maintained within its existing footprint to allow for the passage of heavy equipment. There is a small development associated with this proposal that lies outside the scope of the originally issued permit. An elevated, slatted canoe rack is proposed along the southwest side of the pier, with dimensions of 23'x 4'. The existing steps on the pier will be relocated. POTENTIAL IMPACTS: Direct impacts will be from the loss of bottom area in the amount of approximately 4000 square feet of rock, with another 1470 square feet of sandy fill. Potentially, there could be turbidity during the construction phase, as well as during the period between planting and such time as the vegetation has a stabilizing effect on the sediment. The SAV's in the area should not be impacted, as they are 80' and greater from the proposed sill.
