The application was received as complete by our Division on November 26, 2001. The application was circulated to state and federal review agencies (DWQ Project # 020014). Comments received during this review favorably supported the proposed long-term berm maintenance of the main rice field located adjacent to the Cape Fear River. The proposed creation of the two wildlife impoundments located at the relic rice fields received negative reviews due to the impacts to coastal/404 jurisdictional wetlands and loss of tidal marsh habitat. Based on the comments received, the Division of Coastal Management issued a denial for the application on April 23, 2002, The applicant has requested to delete the proposed wildlife impoundments from the application, Please provide me with your approval and/or additional comments for the long-term berm maintenance of the main rice field. This-approval allows you to: 1) To repair and maintain a 6080' berm that varies from 8' to 20'wide in areas located along the Cape Fear River ; 2) Use dredge material from the interior canal as fill for the berm repair. This approval is only valid for the purpose and design that you described in your CAMA application dated November 26, 2001 and the additional information dated May 9, 2002 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3371 covers this activity. This Certification can also be found on line at: hLtp://h2o.enr.state.nc.us/ncwetlands/certs.html. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying 404 or CAMA Permit expires unless otherwise specified in the General Certification Please understand that if you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certifications and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). When maintaining/repairing the berm, turbidity, controls (turbidity curtain)must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside the project area. The request to re-establish the "bankings" for the two relic rice fields will change the classification of the waters from'brackish waters to fresh waters which will not continue to support the existing uses as stated in 15A NCAC 2H.506(g). 2). The aerial photos dated April 23, 1999 also indicate that the "ditches" dug into the interior of the marsh of the relic rice fields # 1 and 2 have naturalized and have developed the sinuosity associated with natural streams. The Division of Water Quality supports the continued maintenance of the rice field berms/bankings adjacent to the Cape Fear River. If the project is modified to address only the maintenance of the berms/banking on the Cape Fear River, DWQ will have no objection to the project. Please respond within three weeks of the date of this letter by sending a copy of the information to myself and to Cyndi Karoly, Raleigh Wetlands Unit (919) 733-9721. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. NARRATIVE DESCRIPTION: The entrance to Orton Plantation is located off SR 1529 which connects to NC 133 approximately 11.5 miles south of US 17 - US 74/76 west of Wilmington . It can be accessed by traveling west from Wilmington and then taking the NC 133 exit at Leland, NC. Follow the information signs that are located along NC 133. Since the Plantation is closed to visitation during the winter entry must be arranged by telephoning the applicant (L G Sprunt) using either of the following numbers. [910 371-6851 or 910 762-1055]. Orton Plantation is a pre-revolutionary rice plantation that was established circa 1725. It was the principal plantation for rice production in North Carolina. The primary area for rice growing is still evident in the large area of bermed (banked) rice fields located adjacent to the Cape Fear River along the eastern shoreline of the property. These rice fields berms require a constant vigilance to ensure that the forces of erosion from the river and flooding from storms do not compromise the integrity of these features. Beginning in the 1940's the North Carolina Wildlife Resources Commission, with the investment of public funds, became involved in the restoration of the berms (bankings) surrounding the rice fields for the purpose of wildlife habitat enhancement. This program continued for a period of approximately 30 years and an inviolate wildlife sanctuary was established through their efforts. More recently the U. S. Fish and Wildlife Service, along with some non-profit organizations, contributed financially to the restoration work. As a result of these efforts the restored habitat have provided refuge for up to 18,000 waterfowl per year as well as providing a'haven for egrets, herons, ibises and many other shore birds, in large numbers. The WRC has discontinued their program and the expense and responsibility of this restorative activity has, in large measure, reverted back to the property owners. The owners indicate that they have invested a significant effort into this project in order to maintain and restore this historic feature along with the associated wildlife refuge. The project areas are comprised of two distinct locations. The larger of the two are the rice fields located adjacent to the Cape Fear River. The fields are surrounded by a series of berms (bankings) that maintain the separation of the interior portions of the fields from the adjacent open water bodies. The forces of erosion are a constant problem along that portion of the berm that parallels the river. A significant breach occurred in this berm that appears to be associated with a storm event sometime after October 2000. Past storms have also compromised this feature and have required permits from this Division in order to repair the damage. The berm along the. river is approximately 6080' long and varies approximately 8'to 20' in width. There is an interior canal that separates this berm from the main portion of the rice field. This canal varies in width for most of its' length approximately 15' to 30'. It appears to be as narrow as 10' and as wide as 40'. During past maintenance episodes materials have been removed from the canal area and have been used as fill on top of the failed or failing berm (banking). Up until the present time the weakened or breached have ranged in length from 50' up to approximately 250'. The applicant is requesting authorization to allow for long-term maintenance along the main rice field berm (banking). This would be for a period of at least 10 years in order to allow for both routine and acute erosion episodic repairs. The areas identified on Sheet 1 of 2 of the Project View as Insert #1 and Insert #2 have been identified by the applicants as relic rice fields FXELD INVESTIGATION REPORT: Orton Plantation (LG & KM Sprunt) PAGE #3 that were separated from the waters of Allen's (Lilliput) Creek by berms (bankings) that they now wish to re-establish in order to enhance the wildlife habitat associated with both areas. Insert #1 is the smaller of these two features and is located approximately 3000' upstream of the confluence of Allen's Creek and the Cape Fear River. It is separated from the main run of the creek for a distance of approximately 840'. There is a man-made ditch that has been dug adjacent to this relic field and connects to the creek at a point further upstream than would a direct connection from the opening of the field. The vegetation in this area is comprised of Typha iatifoiia and Spartina cynosuroides The presence of this vegetation indicates a tendency to brackish or fresh water influence. The field measures approximately 180' across the lower (creek) end and it extends approximately 350' landward of the creek end. There is what appears to be, in fact, a relic berm at the lower end of this feature. It measures approximately 15' wide and is elevated above the adjacent area approximately 8" to 12". There is also what appears to be a drainage feature transecting the berm (banking) that allows the interior area to be connected-to the ditch that ultimately connects to the creek. The applicants are proposing to bring in mechanical excevation equipment and by removing borrow material from the upside area of the relic berm (banking) placing it on top of the relic berm (banking) raising it to a width of approximately 15' and a height of approximately 2'-3'. A 12" culvert(s) will be installed through the berm (banking) and a water control structure will be used on the interior side in order to regulate the water elevation inside the re-impounded area. Insert #2 is by far the larger of these two areas. Measuring to a point approximately in the middle of the lower end of this feature it is approximately 1400' upstream from the confluence of Allen's Creek and the Cape Fear River. The distance across the mouth measures approximately 300'. The distance to the upper end of this feature is approximately 1100'. The predominant species is Spartina aiterniflora. The growth form of the stems in this area could be characterized as moderate in height (2'- 3D. The relic berm in this area is nearly non-existent. The writer investigated the lower end of this site from the west side and found the remains of an elevated feature no more than 3"-5" above the.adjacent substrate. This feature blended into the neighboring area approximately 75' east of the high ground connection from which it was extending. There is a significant drainage way flowing down the entire east side of this site. This appears to be a least part of what is or was a natural connection of this area to the main run of Allen's Creek. An examination of available aerial photography indicates that at approximately one-third the distance toward the upper end of this site the vegetation transitions into the Typha and Spartina cy found at Insert #1. The same construction method is proposed for the re-establishment of a berm (banking) at this site. The width would range from approximately 10'-15'with a height of approximately 2'to 3'. Culvert(s) with water control element(s) will also be employed at this location. 10. ANTICIPATED IMPACTS: This project can be separated into two distinct proposed activities. The first is a request to allow for an orderly approach to provide for the long-term upkeep program for the main rice field berms (bankings) that are adjacent to and interior from the Cape Fear River. Although erosion can certainly be expected to occur along the river, sometimes with dramatic results (i.e. a breach of the structure), time and the elements have also affected the more interior berms (bankings) that occasionally require repairs. The other activity being proposed is the re-establishment of the berms (bankings) that originally created rice fields on the historic plantation and later on created wildlife habitat until the NC WRC halted that program. The proposed development will result in the consumption of approximately 10,500 s f of low marsh and approximately 6,300 s f of brackish marsh if authorized. The two areas that would be isolated by this action would be manipulated to control the water level in order to be available for enhanced avian wildlife habitat. This type of project has received mixed reviews from the-various agencies that have a responsibility for resource protection. In the last several weeks published reports indicate that the US Fish and Wildlife Service in South Carolina FIELD INVESTIGATION REPORT: Orton Plantation (LG & KM Sprunt) PAGE #4 is proposing a project that is very similar to that being proposed for Insert #1 & #2. They argue the position that the resulting habitat enhancement overrides the loss of resource. If the re-established berm(banking) for Insert #2 were moved up above the location of the marsh transition the consumption of approximately 10,500 s f of low marsh would be eliminated. E(DEWE D ORTON PLANTATION NOY 2 6 2001 9149 ORTON ROAD, S. E. DIVISION OF -VINNABOT, NORTH CAROLINA 28479 COASTAL MANAGEMENT Orton Plantation was established in 1725 and was the principal rice growing plantation in North Carolina. Rice was grown for nearly two hundred years. In the 1940's the N.C. Wildlife Resources Commission, through the investment of public funds, became involved in the restoration of the berms(bankings) surrounding the rice fields for the purpose of wildlife habitat enhancement. This program lasted for a period of approximately 30 years and an inviolate wildlife sanctuary was established through their efforts. As many, as 18,000 waterfowl per year found refuge in these managed rice fields. More recently, the U.S. Fish and Wildlife Service, along with some non-profit organizations, contributed financially to the current restoration work. Today the area is a haven for egrets, herons, ibises and many other shore birds, in large numbers. For whatever reason the WRC discontinued their program and the expense and responsibility of this activity has in large measure reverted back to the property owners. The owners have made large sacrifices in order to maintain and restore this historic treasure and intend to keep it as a wildlife refuge. The proposed maintenance work will consist of repairing/replacing the existing Orton Plantation main rice field outer berm(banking). This berm has been impacted by ongoing erosion events originating from the adjacent Cape Fear River and especially those in the last few years resulting from several hurricanes as well as the increased displacement wave action from the ever increasing size of the vessels using the river. The work on the existing outer berm will involve the excavation of materials from the "inside" area of the existing impoundment and the resulting material will be used to repair or replace the damaged outer berm. It may be necessary in some locations to armor the face of the re-stabilized berm using rock rip-rap. This material will be of sufficient size so as not to be re-located by wave action. The areas identified as Insert #1 and Insert #2 adjacent to Allen Creek were originally active rice fields that, of course, were much smaller than the main fields adjacent to the Cape Fear River. Over time, due to the ongoing forces of chronic erosion, the man-made berms(bankings) associated with these two features were gradually reduced to basically a non- functioning structure. The original function of these berms(bankings) has been diminished to the point that in order for the two areas to continue to provide maximum habitat value the owners are requesting that they be allowed to restore the berms(bankings) to their original dimensions. Materials will be excavated from the interior side of the remnant berms and will be deposited on top of the remaining features. Tbis action will serve to isolate the relic rice fields from the tidal influence of Allen Creek. The owners will install a culvert or culverts with flap gates or risers in order to allow for the continued passage of freshwater from the interior to the waters and wetlands of Allen Creek during times of heavy rainfall events. The goal of the owners is to restore the enhanced wildlife habitat at these two locations. At this point in time there is only marginal habitat available. The previous activities by the NC WRC and USFWS have demonstrated that successful wildlife utuiyation will occur when these areas are managed properly. This approval allows you to: 1) To repair and maintain a 6080' berm that varies from 8' to 20'wide in areas located along the Cape Fear River ; 2) Use dredge material from the interior canal as fill for the berm repair. This approval is only valid for the purpose and design that you described in your CAMA application dated November 26, 2001 and the additional information dated May 9, 2002 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3371 covers this activity. This Certification can also be found on line at: httn://h2o.enr.state.ne.us/ncwetlands/certs.html. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying 404 or CAMA Permit expires unless otherwise specified in the General Certification Please understand that if you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certifications and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certifications and the additional conditions listed below: 1). When maintaining/repairing the berm, turbidity controls (turbidity curtain)must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside the project area. Please contact this Office at the number listed below if there are any problems with turbidity; 2). The attached Certificate of Completion (COC) must be submitted to the Division upon final construction of the site.
