The developer and engineer have been limited to the design of this project due to Dare County Ordinances (subdivision regulations) and septic setbacks. This design must be constructed as planned due to the following regulations: 1) 50 foot setback from wetlands for septic systems (see attached design); 2) lot width of 75 foot; 3) lots size requirements 20,000 square feet of uplands (allowing for fill to meet this requirement); 4) "Flag lots" (ie. Lot 12) have to have a minimum of 20 feet at the location of the "pole" and a minimum of 200 feet in length; 5) economic factor is last but not least to make this project feasible. therefore, we do not have a practicable alternative to placing the fill in these wetlands. I would like to add that this design was carefully considered to prevent impacts that would impact contiguous wetlands. This project has received permits and approvals from the US Army Corps of Engineers (ID. 200210313) and the Division of Coastal Management (attached documents), therefore, your review for the 401 Certification is very important to our client to begin construction. Lot 12) have to have a minimum of 20 feet at the location of the "pole" and a minimum of 200 feet in length; 5) economic factor is last but not least to make this project feasible. therefore, we do not have a practicable alternative to placing the fill in these wetlands. I would like to add that this design was carefully considered to prevent impacts that would impact contiguous wetlands. WNE VAGENT'S SIGNA DATE (AGENT'S SIGNATURE VALID ONLY IF AUTHORIZATION LETTER FROM THE OWNER IS PROVIDED (18g.)) 4 MITIGATION (For Nationwide 3, 7, 12, 14, 27, 39, 40, 41, 42, 43 & 44) 1) Pursuant to Nationwide Permit General Condition 19, your project must be designed and constructed to avoid and minimize adverse effects to waters of the United States (including wetlands) to the maximum extent practicable* at the project site. a. Is it practicable to relocate or redesign your project on site so that impacts to waters and /or wetlands are avoided? (If not, please explain) • The number of lots platted (20 lots) is required for the subdivision design in order to make this project economically feasible b. Is it practicable to relocate or redesign your project on site, so as to reduce your proposed impacts to waters and/or wetlands? (If not, please explain) • Wetlands on site are located on four of the twenty lots and in order to have buildable lots, two wetland areas need to be filled. County requires minimum 20,000 s.f of highground for each lot. • Subdivision was carefully designed to avoid major areas of wetlands towards the back (southwest end) of the subdivision. 2) Compensatory mitigation will normally be required for wetland impacts requiring a preconstruction notification (PCN) and/or when necessary to ensure that the adverse effects to the aquatic environment are minimal. Compensatory mitigation proposed to compensate for greater than minimal adverse effects to water of the United Sates (including wetlands) must be at a minimum ratio of 1:1. Some examples of mitigation are wetland restoration, creation, enhancement, preservation, and stream buffers (25' to 50' wide on each side of stream, this can comprise no more than 1/3 of compensatory mitigation). Compensatory mitigation will not be required for impacts to waters of the United States (including wetlands) which are considered minimal. a. Please provide a compensatory mitigation proposal containing location, size and type of mitigation you are able to provide. A 1:1 ratio is provided for compensatory mitigation for this project (see attached plat). This area will be designated and recorded as a preservation area not to be filled or disturbed by mechanical means. b. If you believe that your project will result in minimal adverse impacts to the aquatic environment, and therefore does not require compensatory mitigation, please provide, in detail, your basis for this determination. 3) Pursuant to Nationwide Permit General Condition 26, when Nationwide permit 12 or 14 is used within the Federal Emergency Management Agency (FEMA) designated 100- year floodplain, the applicant must provide the Corps with documentation that any permanent above-grade fills in waters of the United States comply with FEMA of FEMA-approved local floodplain construction requirements.
