We have completed our punch-list inspection on the referenced project and are
preparing to gate portions of the sewer easement. The drought has taken its toll on our
initial seeding and we want to complete any additional work you might require before we
remove the Tree Protection, remaining silt fence and reseed any remaining bare areas.
Therefore, if you have any concerns, please notify us immediately so we can address
them prior to our reseeding

APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Neuse River Buffer
Protection Rules (15A NCAC 2B .0233)
Dear Mr. Powell,
You have our approval, in accordance with the attached conditions and those listed below, to impact 0.584 acres of
wetlands, 91.59 feet of stream and 18,532 square feet of riparian buffers to construct the proposed sanitary sewer outfall
as you described within your revised application dated February 12, 2002. After reviewing your application, we have
decided that this fill is covered by the NC Division of Water Quality (DWQ) General Water Quality Certification Number
3288. This Certification allows you to use Nationwide Permit Number 12 when issued by the US Army Corps of
Engineers (USAGE). This letter shall also act as your approved Authorization Certificate for impacts to the protected
riparian buffers as required under,.15A NCAC 2B .0233(8). This approval replaces your January 2, 2002 approval. In
addition, you should get or otherwise comply with any other required federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control Permit. Also, this approval will expire
when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your revised application and construction
plans dated February 12, 2002. If you change your project, you must notify us and you may be required to send us a new
application. If the property is sold, the new owner must be given a copy of this Certification and approval. letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre
of wetland, compensatory wetland mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval
to be valid you must folrow.the conditions listed in the DWQ General Certification No. 3288, Neuse Buffer Rules 15A
NCAC 2B .0233 and the additional conditions listed below.
Conditions:
1. The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved
under this authorization shall be clearly marked by orange fabric fencing for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A
NCAC 2B .0233 and GC 3288.
2. Construction of the utility line shall comply with all conditions listed within DWQ General Certification No. 3288.
Including (but not limited to) conditions number 4, 5, 9 and 16.

within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to

Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

Dear Mr. Dorney and Ms. Jones:
On behalf of the Town of Garner (project owner), we hereby request authorization
from the U.S. Army Corps of Engineers to revise our previous request to use Nationwide
Permit 12 for the subject project to cover temporary impact to wetlands and stream
crossings. We also request written concurrence from the N.C. Division of Water Quality
(NC-DWQ) that the revised project complies with the Neuse River Basin buffer rules. A
Pre-Construction Application (PCN) was previously submitted. An agent authorization
form from the Town of Garner was also previously submitted.
The proposed project is a sanitary sewer outfall paralleling the west side of
Mahlers Creek. It extends from an existing City of Raleigh pump station near the
intersection of Highway 50 and Buffalo Road northward approximately 12,000 linear feet
to the Town of Garner's Bainbridge subdivision. The outfall will collect sewage from the
Bainbridge, Forest Landing and South Creek subdivisions and eliminate two pump
stations. Please refer to the USGS topographic map except attached for the location of
the project. This project was originally proposed and designed in 1982 by the Town of
Garner. Although the Town obtained easements along the proposed route from property
owners they never obtained construction permits. In an effort to utilize the existing plans
and easements we requested vesting of the project in a letter dated March 8d`. We have
not received a response to our request for vesting. As time is of the essence with this
PT sec to annexation requirements for the Bainbridge subdivision and we have no
/guarantee o vesting, we decided to walk those portions of the originally proposed outfall
that were fe t to pose potential buffer and/or wetlands permitting problems with Bob
Zarzeki o your office. As a result of his comments, sections of the route were re-aligned

to avoid permitting complications and the cost of mitigation. These changes were
reflected in the construction plans previously submitted with the PCN.
Upon receiving the referenced certification from NC-DWQ the Town reviewed
the project's budget and directed us to revise the route's alignment, if possible, to
eliminate any zone 1 parallel impacts, thereby eliminating the required mitigation costs in
the certification.
As a result of revising the previous alignment, along with the City of Raleigh
allowing a constriction of their standard permanent easement where it would intrude into
the Zone 1 parallel buffer, the total cumulative impact to the buffers by the outfall's route
parallel to Mahlers Creek is now 0.0 s.f in Zone 1 and 8,579.24 s.f in Zone 2. Two
perpendicular stream crossings along the route, limited to 40' in width each, will
temporarily impact 5,248.54 s.f in Zone 1 and 4,704.08 s.f in Zone 2.
Cumulative temporary impacts to wetlands along the route will be .584 Acres and
stream impact at the perpendicular crossing points is a total of 91.59 l.f. Copies of the
relevant construction sheets (# 1-4 & 6-10) are attached.

Dear Mr. Powell,
You have our approval, in accordance with the attached conditions and those listed below, to impact 0.228 acres of
wetlands, 91.59 feet of stream and 28,910.13 square feet of riparian buffers to construct the proposed sanitary sewer
outfall as you described within your application dated December 21, 2001. After reviewing your application, we have
decided that this fill is covered by the NC Division of Water Quality (DWQ) General Water Quality Certification Number
3288. This Certification allows you to use Nationwide Permit Number 12 when issued by the US Army Corps of
Engineers (USACE). This letter shall also act as your approved Aurzation Certificate for impacts to the protected
riparian buffers as required under 15A NCAC 2B -0233(8) In addifim you should get or otherwise comply with any
other required federal, state or local permits before you go ahead with your pmt including (but not limited to) Sediment
and Erosion Control Permit. Also, this approval will expire when tlae accompanying 404 permit expires finless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you deed in your application dated December 21, -
2001. If you change your project, you must?notify us and you maybe mquired to send us anew, application. If the
property is sold, the new owner must be given a copy of this Certifkmfion and approval letter and is thereby responsible
for complying with all conditions. If total fills for this project (now cTii>` the future) exceed one acre of wetland,
compensatory wetland mitigation may be required as described in 15ANCAC 211.0506 (h). For this approval to be valid
you must follow the conditions listed in the DWQ General CertificNo_ 3288, Neuse Buffer Rules 15A NCAC 2B
.0233 and the additional conditions listed below.

3. You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to
compensate for impacts to the protected riparian buffers is 8,634 square feet as required under this Authorization
Certificate and 15A NCAC 2B .0242.
We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC
Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to
be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242(7), this
contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the
WRP receives and.clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts
specified in this Authorization Certificate shall occur. Mr. Ron Ferrell should be contacted at (919) 733-5208 if you
have any questions concerning payment into the WRP. You have one month from the date of this approval to make
this payment. For accounting purposes, this Authorization Certificate authorizes payment into the Riparian
Buffer Restoration Fund to compensate for 8,634 fe of required riparian buffer mitigation for impacts to 2,878

On behalf of the Town of Garner (project owner), we hereby request authorization
from the U.S. Army Corps of Engineers to use Nationwide Permit 12 for the subject
project to cover temporary impact to wetlands and stream crossings. We also request
written concurrence from the N.C. Division of Water Quality (NC-DWQ) that the project
complies with the Neuse River Basin buffer rules. A Pre-Construction Application (PCN)
is attached. An agent authorization form from the Town of Garner is attached. A check in
the amount of $200.00 is attached in payment of the application fee.
The proposed project is a sanitary sewer outfall paralleling the west side of
Mahlers Creek. It extends from an existing City of Raleigh pump station near the
intersection of Highway 50 and Buffalo Road northward approximately 12,000 linear feet
to the Town of Garner's Bainbridge subdivision. The outfall will collect sewage from the
Bainbridge, Forest Landing and South Creek subdivisions, and eliminate two pump
stations. Please refer to the USGS topographic map except attached for the location of
the project. This project was originally proposed and designed in 1982 by the Town of
Garner. Although the Town obtained easements along the proposed route from property
owners they never obtained construction permits. In an effort to utilize the existing plans
and easements we requested vesting of the project in a letter dated March 8"'. We have
not received a response to our request for vesting. As time is of the essence with this
project due to annexation requirements for the Bainbridge subdivision and we have no
guarantee of vesting, we decided to walk those portions of the originally proposed outfall
that were felt to pose potential buffer and/or wetlands permitting problems with Bob
Zarzeki of your office. As a result of his comments, sections of the route were re-aligned
to avoid permitting complications and the cost of mitigation. These changes are reflected
in the attached construction plans being submitted with the PCN.

As a result of the realignment the total cumulative impact to the buffers by the
outfall's route parallel to Mahlers Creek will be only 2,877.82 s.f in Zone 1 and
13,121.52 s.f in Zone 2. Two perpendicular stream crossings along the route, limited to
40' in width each, will temporarily impact 6,416.93 s.f in Zone 1 and 6493.86 s.f in
Zone 2.
Cumulative temporary impacts to wetlands along the route will be .228 Acres and
stream impact at the perpendicular crossing points is a total of 91.59 l.f. Copies of the
relevant construction sheets (#1-4 & 6-11) are attached.
Because the cumulative impacts are so low, and temporary in nature, we believe
that wetland, stream channel or buffer mitigation should not be required by DWQ.

landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
