This is to advise you that the Pitt County Technical Review Committee conditionally approved
the soil erosion and sedimentation control plan and stormwater plan for DOLLAR GENERAL —
CHICOD on February 12, 2020. Conditions and requirements as a part of this approval are
attached below. Copies of the draft minutes from the meeting will be available upon request
prior to the next Technical Review Committee meeting.
As stipulated on the financial responsibility form, you are responsible for ensuring compliance
with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control
Ordinance. Your primary objectives include, but are not limited to, preventing offsite
sedimentation, preventing sediment from entering watercourses, and establishing vegetation on
all disturbed areas within 7-14 calendar days, following any completion of a phase of grading.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to
the commencement of any land disturbing activity on the above named project. The NOI form
may be accessed at degnc.gov/NCG01. Please direct questions about the NOI form to Annette
Lucas at Aiiiiette.lucas@ncdenr.gov or Paul Clark at Paul.elark@ncdetlr.gov. After you submit a
complete and correct NOI Form, a COC will be emailed to you within three business days.
Please be aware that your project will be covered by requirements of the NPDES
Construction Stormwater General Permit NCGO10000. Please become familiar with all the
requirements and conditions of this permit in order to achieve compliance.
Upon discovery of noncompliance by our office, the following actions may be taken:
1. No further permits for building or other construction will be issued.
2. The authority to continue construction, other than for erosion control measures,
will be terminated.
3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately
comply upon notice of noncompliance will result in injunctive and/or criminal
action.
Other Comments:
4. This erosion control plan shall expire three years following the date of approval if
no land disturbing activity has been undertaken.
5. The Division of Water Quality may pursue legal action against you in order to
enforce requirements of the NPDES, Phase II permit.
6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes
County officials to inspect sites to ensure compliance with the Sedimentation
Pollution Control Act.
Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file
at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of
periodic inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the
commencement of this project, the erosion and sedimentation control plan is inadequate to meet
the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to insure compliance with the Act. Acceptance and approval of this plan is
conditioned upon your compliance with Federal and State water quality laws, regulations, and
rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing
activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form
if there is any change in the information included on the form. Land disturbance shall not
begin until a preconstruction meeting has taken place.
Please provide a copy of the certificate of coverage prior to beginning any land disturbance.

CONDITIONS AND REQUIREMENTS
[Planning]
1. Obtain Certificate of Coverage from NCDEQ prior to beginning land disturbance.
2. Show any proposed stockpile locations.
3. Based on the calculations submitted, this development will require the installation of
Best Management Practices (BMP's) and/or a payment must be approved and paid to a
private mitigation bank or the Environmental Enhancement Program (EEP) to meet the
nitrogen loading requirements of the Pitt County Stormwater Ordinance. This payment
must be made prior to approval of the plan.
4. Best Management Practices (BMP's) will be required due to the peak flow rates
increasing by more than ten percent.
5. All BMP's must meet the requirements of the Pitt County Stormwater Ordinance and
must be designed according the North Carolina BMP Manual.
6. The owner will be responsible for maintenance of all stormwater BMP's. A recorded
stormwater maintenance agreement is required.
7. 10' roadside and property line buffers are required along the road front and northern
property line. Buffer yards shall include 1 tree per 40 linear feet of road frontage or
property line and evergreen shrubs planted 4' on center. Trees shall be a minimum of
8' in height at time of planting and shrubs should be a species expected to reach a
minimum height of 36 inches and a minimum spread of 30 inches within 3 years of
planting.
8. Please indicate the location and type of any utility easements on the subject property.
9. Please show the location and type of any proposed on -premises signage for the
business. Please be advised that no more than one (1) free-standing or ground mounted
on -premises sign is permitted. Signage may not exceed 200 square feet in area and 35
feet in height. Signs must be setback a minimum of 10 feet from the road right-of-way
and property lines.
10. On Sheet C-11 (Landscaping Plan), the "Minimum Site Vegetation Requirements"
listed in the Landscape Calculations table is incorrect. Pitt County's landscaping
requirements are not calculated based upon acreage. Please recalculate the amount of
vegetation required as noted in Comment # 1 above.
11. Also on sheet C-11 (landscaping Plan) under the Landscape Calculations table, "South
Property Line" is listed twice under "Property Boundary Tree Requirements".

12. A fire hydrant is required to be within 400 feet of site.
13. A knox box is required.

14. Add a 30 foot electrical easement on all overhead powerlines.

15. The design engineer has submitted revised plans since the last meeting and has
addressed all concerns with this latest reviewed plan set.
