Coastal Area Management Act with ADIMONAL CONDITIONS
Dear Mr. and Ms. Renno,
You have our approval, in accorcince with the conditions listed below, to impact approximately 3,400 square feet
of the protected riparian buffers (approxi stely 1,400 square feet of Zone I and 2,000 square feet of Zone 2) for the
purpose of constructing the proposed sin# family home on the subject property as described within your variance
application form dated November 16, 201 with additional information provided within your letter dated February 17,
2002. This letter shall act as your apprond for the use of the "General" Major Variance; From the Neuse and Neuse
Riparian Buffer Rules for the Constructiciof Residential Structures on Existing Lots within the Coastal Counties as
defined by the Coastal Area ManagemetMct with ADDITIONAL CONDITIONS as approved by the Water Quality
Committee (WQC) of the Env iron mentallKanagement Commission (EMC) on May 10, 2001. In addition, you should get
any other required federal, state or local pffmits before you proceed with your project including (but not limited to)
Sediment and Erosion Control and CAMIpermits.
This approval is only valid for ttspurpose and design that you described in your variance request except as
modified below. If you change your pro¢t, you must notify us and you may be required to send us a new request for
approval. If the property is sold. the nevvewner must be given a copy of this approval and is thereby responsible for
complying with all conditions. For this Woval to be valid, you must follow the conditions listed below.
1. Stormwater shall be direwd as diffuse flow at non-erosive velocities through the protected stream buffers
as identified within 15A SCAC 213 .0233(5). Roof drainage from the house shall be directed to vegetated
areas at non-erosive velc;ities prior to entering the protected riparian buffers. Any additional stormwater
located on the remaindetrefthe property shall be directed as diffuse flow at non-erosive velocities prior to
entering the protected ripian buffers. No new ditching or piping of stormwater through the protected
buffers is allowed.
2. The outside boundary olfZone 1 (30 feet from the coastal wetland or mean high water line, whichever is
more landward) and for* areas approved for impacts under this variance shall be clearly marked with
orange fabric fencing (om ntilar clearly visible markers) for the length of the construction area that has
been approved to infrinpa within the buffer prior to and for the duration of any land disturbing activities
to ensure compliance wit I5A NCAC 213 .0233.

You are required to mitigate for your Zone 1 impacts. The required area of mitigation shall be equal to
1,400 ft2. The DWQ has determined that on-site mitigation will satisfy this mitigation requirement. To
satisfy this on-site mitigation, woody vegetation (native shrubs and trees) shall be planted in no less than
1,400 ft2 of the retained portions of the protected riparian buffer on the property. The preferred number of
individual plants shall be such that there are at least 200 to 300 trees or shrubs per acre at maturity within
the buffer and shall include planting no less than ten (10) individual plants. These plantings shall occur
no longer than sixteen (16) months after construction of the home has been completed. If you select this
option, you must notify us in writing within one month of the completion of the planting. You are
required to ensure that these plants survive for a period not less than five (5) years from the date of
planting. You are required to replace, any plants that die within this five year period.
If you determine that it is not practical to provide this additional planting on-site, then you shall submit a
request to this office to provide payment into the Riparian Buffer Restoration Fund to satisfy the
mitigation requirement of 1,400 ft2. This office will provide you with additional information about this
option once and if we receive your request.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh. NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection
Rules (15A NCAC 213 .0233 (9)(b)). Please call Mr. Bob Zarzecki at 919-733-9726 or Mr. Tom Steffens at 252-946-6481

On December 4, 2001, the Division of Water Quality (DWQ) received your request dated November 16, 2001 for
authorization to use the "General" Major Variance From the Neuse and Tar-Pamlico Riparian Buffer Rules for residential
structures on existing lots within the coastal counties as defined by the Coastal Area Management Act, Approved
5/9/2001(see attached).
After reviewing the information provided. the DNVQ has determined that you are eligible for the use of the
-General" Major Variance for Coastal Counties. Hov.e-.er. % e will need additional information before we can issue the
approval. Please provide the following information so that we can move forward with your approval.
1. Please indicate the location of the protected buffers on your property and provide the area of impact to Zone 1
and Zone 2 (in square feet).
The "General "Major Variance is a variance *Tom the Neuse River Riparian Area Protection Rules (i.e., Neuse
Buffer Rules)(15A NCAC 2B.0233). These rules protect 50 foot riparian areas along surface waters in the
Neuse River Basin. On your propem•, the protected riparian area (or buffer) most likely begins at the normal
high water level of Orchard Creek or edge of the coastal wetlands (as determined by the N. C. Division of
Coastal Management (DCM); on your proper, : is may be in the "marsh line" indicated on your survey),
whichever is more landward and extends land-,. and for a distance of 50 feet. It may also apply to any smaller
tributary strearar running through the properr: as indicated on either the USGS topographic quadrangle map
(see attached) or the USDA Pamlico Counhy Soil Survey (see attached). The 50 foot buffer is contains two
Zones. Zone I is the first 30 feet closest to the subject surface water or coastal wetland. Zone 2 is the outer
(most landward) portion of the 50 foot buffer.

2. Mitigation is required for any impacts to Zone 1 (30 feet closest to the surface water or coastal wetland) of the
protected buffers as per Condition No. 10 of the "General" Major Variance. Please provide information on the
area of impact to Zone 1 (in square feet) and how you propose to satisfy this mitigation requirement.
3. On-site stormwater management for run-off from any new impervious surfaces placed in the buffer (e.g., house,
garage, driveway, etc.) is required per Condition No. 9 of the "General" Major Variance. Please provide
information on how you intend to provide this stormwater management. Below is a standard condition that if
met can satisfy the stormwater management condition. If you believe that you can meet this condition please let
us know and will apply it to your approval letter to satisfy Condition No. 9 of the "General" Major Variance.

of your intent to obtain this information to me and to Ms. Deborah Sawyer of the DWQ Washington Regional Office at
(252) 946-6481. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project

2. Mitigation is required for any impacts to Zone 1 (30 feet closest to the surface water or coastal wetland) of the
protected buffers as per Condition No. 10 of the "General" Major Variance. Please provide information on the
area of impact to Zone 1 (in square feet) and how you propose to satisfy this mitigation requirement.
3. On-site stormwater management for run-off from any new impervious surfaces placed in the buffer (e.g., hous(
garage, driveway, etc.) is required per Condition No. 9 of the "General" Major Variance. Please provide
information on how you intend to provide this stormwater management. Below is a standard condition that if
met can satisfy the stormwater management condition. If you believe that you can meet this condition please 6
us know and will apply it to your approval letter to satisfy Condition No. 9 of the "General" Major Variance.
Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as
identified within 15A NCAC 2B.0233(5). Roof drainage from the house shall be directed to vegetated areas a
non-erosive velocities prior to entering the protected riparian buffers. Any additional stormwater located on
the remainder of the property shall be directed as diffuse flow at non-erosive velocities prior to entering the
protected riparian buffers. No new ditching or piping of stormwater through the protected buffers is allowed.
Please respond in writing within three weeks of the date of this letter by sending a copy of this information or notic
of your intent to obtain this information to me and to Ms. Deborah Sawyer of the DWQ Washington Regional Office at
(252) 946-6481. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this prcj(

install three pilings on Orchard Creek, Orchard Creek Estates, Pamlico County,
North Carolina.
On April 1, 1988, we renewed general permit No. CESAW-C078-N-000-0056
(copy enclosed) that authorizes the maintenance, repair, construction, and
installation of piers, docks, boathouses, boatshelters, mooring pilings,
dolphins and jetties in navigable waters of the United States in the State of
North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law.
